Removing obstacles for people and businesses in carrying out administrative procedures

PORTAL - Continuing the program of the 16th Session - Provincial People's Council, term X, on the afternoon of July 22, members of the Provincial People's Committee (PPC) including Mr. Pham Trong Nhan - Director of the Department of Planning and Investment (DPI); Trinh Duc Tai - Director of the Department of Labor, Invalids and Social Affairs (DOLISA) and Vo Anh Tuan - Chief of Office of the PPC answered questions from delegates of the Provincial People's Council revolving around difficulties and obstacles in implementing administrative procedures related to citizen and businesses.

Speeding up the appraisal of investment projects

Mr. Huynh Tran Phi Long - Delegation of Di An City asked: "Recently, some enterprises have reported that it takes a long time for the PPC to consider and approve the project investment policies. The sectors also take a long time to give opinions, and some investment policies require many meetings. I would like to request the Director of DPI to inform us of the cause and solutions for this in the coming time."

Responding to the questions of the delegate, Mr. Pham Trong Nhan - Director of DPI said that the Department has presided over and coordinated with agencies and units to receive, organize appraisals, and advise the PPC to approve investment policies for projects that have fully met the conditions according to current legal regulations. In general, the coordination and consultation work of the PPC ensures the required time and quality.

However, investment projects using land, especially projects in the fields of real estate business, commercial housing, and social housing, are affected and regulated by many legal documents in many different fields (more than 10 Codes, more than 30 Decrees and Circulars guiding implementation), with many overlapping regulations. Therefore, some project dossiers take longer than prescribed, and many processes and procedures must be carried out before the PPC considers and approves the investment policy.

To improve the quality of project approval, the Department has developed and issued an Investment Handbook to support investors when preparing project proposal documents; increased the application of information technology in document processing; coordinated with the Department of Information and Communications to develop and implement the reception and processing of documents on the Provincial Administrative Procedure Information System for 04 procedures in the investment sector, contributing to overcoming difficulties in coordination and communication between State agencies; advised the PPC to issue documents with many solutions and directives to continue improving the quality of project approval.

At the same time, the Department has advised the PPC to establish a Steering Committee to resolve difficulties and obstacles for enterprises and in implementing real estate projects with the spirit of accompanying enterprises, considering the difficulties of enterprises as the difficulties of the provincial government. Up to now, the Steering Committee has been very active, organizing more than 18 meetings and resolving more than 129 difficulties and obstacles.

Removing difficulties in work permits for foreigners

Responding to the question of Ms. Nguyen Thi Thanh Mai - Delegation of Tan Uyen City, about the extension of work permits for foreigners still facing many difficulties and delays, affecting the production and business activities of enterprises, Mr. Trinh Duc Tai - Director of DOLISA said that in the first 6 months of 2024, the Department has issued 3,698 new work permits, reissued 997 work permits and extended 553 work permits for foreigners; received reports and confirmed 157 cases of foreign workers not subject to work permits.

Compared to the same period in 2023, the processing of work permit applications increased by 163%.

However, many businesses still face difficulties in extending work permits for foreigners, mainly related to the announcement of recruitment of Vietnamese workers, documents proving the position of manager, job titles of foreigners as legal representatives, investor representatives, and procedures for extending work permits.

To overcome these difficulties, the DOLISA has implemented many solutions: Regularly receiving citizens, arranging meetings with businesses to answer questions and provide guidance on procedures; establishing a Support Team for businesses facing difficulties related to the field of foreign labor; issuing documents guiding the implementation of Decree No. 70/2023/ND-CP, providing specific guidance forms for businesses; organizing conferences, exchanging and providing guidance on the implementation of legal regulations on foreign labor; directly handling documents for businesses, propagating and disseminating the law.

In addition, DOLISA has also implemented online fee collection through the Public Service Portal, digitized 100% of administrative procedure settlement results on foreign workers, issued regulations on coordination in granting licenses to foreign workers in the province, and enhanced the sense of responsibility of officials and civil servants, and increased the application of information technology in foreign worker management.

Creating favorable conditions for people to apply online

Questioning online public services, Ms. Nguyen Thi Thao Nguyen - Delegation of Tan Uyen City raised an issue: "I strongly agree with the province in drastically implementing online administrative procedures. However, in reality, many people are living far away, some are elderly people. When submitting their documents, the officers and civil servants of the One-Stop Department refuse to accept paper documents and force people to register digital signatures to submit documents online. I would like to ask the Chief Office of the PPC, whether submitting documents online is mandatory and in such cases, how should we resolve the issue to facilitate the people?"

Responding to this issue, Mr. Vo Anh Tuan - Chief Office of the PPC said that it is not mandatory. According to regulations, people can choose to submit their application online or submit paper documents.

However, Binh Duong province is encouraging people to submit applications online because of many benefits: reducing travel time; submitting applications anytime, anywhere; results are digitized and can be reused.

Currently, all One-Stop Departments have teams to support people in submitting online applications, providing instructions on how to use the Public Service Portal; creating accounts and signing digital signatures for free; and supporting the conversion to logging in with a VNeID account. Therefore, people should consider submitting applications online to save time and be more convenient.

Ms. Tran Thi Hong Hanh - Delegation of Ben Cat City said: "Some agencies, units, and enterprises require people and employees to provide notarized contracts and certified documents that are not in accordance with regulations when performing administrative procedures or when applying for jobs. Electronic copies are not yet accepted by many places (enterprises, banks, insurance, etc). Please give solutions to propagate, inspect, and monitor this issue."

Mr. Vo Anh Tuan - Chief Office of the PPC said that through the implementation process, the certification of electronic copies from the original has had many positive changes and results, the awareness of cadres, civil servants, businesses, and people in the province about electronic certification has been increasingly raised (in 2022, the People's Committees at district and commune levels electronically certified 27,328 records; in 2023, 167,380 records were electronically certified, an increase of 612.4% compared to 2022. In the first 6 months of 2024, 161,039 records were electronically certified, double that of the same period in 2023).

However, in the implementation process, the work of certifying electronic copies still faces many difficulties and limitations: This is quite new content, so some people do not trust enough to use it; many agencies, organizations, and businesses have not used certified electronic copies to resolve administrative procedures. Some people have not yet accessed and used information technology applications. Technical inadequacies. Institutions are not consistent, some fields and current legal documents still stipulate the reception and storage of paper documents and records when handling work, administrative procedures, etc.

In the coming time, the PPC will continue to direct departments, branches, and localities to strengthen the handling of administrative procedures in the electronic environment - Binh Duong Provincial Public Service Portal, National Public Service Portal, using electronically certified copies from the original according to Article 11 of Decree No. 45/2020/ND-CP on the process of receiving and handling administrative procedures in the electronic environment.

It will continue to promote propaganda and widely disseminate in many forms about the electronic certification process to resolve administrative procedures in the electronic environment, the utility of this service, and the use of electronic certification results.

It will also recommend competent authorities to amend and supplement institutional regulations to ensure legal consistency.

The province will apply information technology to resolve administrative procedures, which are being implemented by the entire political system in the province in all areas. Therefore, it is necessary to have the consensus and cooperation of businesses, people, and the government so that Binh Duong province can soon achieve a digital government, serving the people as expected.
