To abolish Decision No. 2544 / QD-UBND dated October 5, 2015 of the Provincial People's Committee promulgating the Regulation on criteria for considering and approving dossiers for establishment of notary office in Binh Duong province.
This regulation applies to notaries who submit dossiers of application for notary offices, state management agencies in charge of notarization, and relevant agencies and organizations in consideration and approval application dossiers for establishment of notary office.
The consideration of dossiers of application for the establishment of notary office must ensure fairness, publicity, objectivity and in accordance with the law. The approval dossier must comply with the provisions of the Law on Notarization, this Regulation and other relevant legal documents. The establishment of a Notary Office must measure to socio-economic development conditions and notarization needs of each district, town and city; notarization organizations are associated with residential areas, many notarization organizations should not be concentrated at the same area.
The minimum conditions that the Notary Office needs to meet in order to ensure the operation of the Notary Office: The notary office has a total minimum area of 140 m2, in which the area for welcoming residents is at least 60 m2, the storage area is at least 50 m2 and have an area for parking. The establishment of a Notary Office must measure to socio-economic development conditions and notarization needs of each district, town and city; notarization organizations are associated with residential areas, many notarization organizations should not be concentrated at the same area.
Notary offices must have at least two partnership notaries. The chief of notary office must be a partnership notary and has been practicing notary for 02 years or more. Notary offices must have plan for equipment to serve professional operations, have staff in charge of accounting, information technology and archives.
Criteria for calculating points when considering dossiers to establish notary offices (on a scale of 100) include: Criteria of office and facilities (45 points); personnel organization criteria (49 points); other criteria (6 points).
The Department of Justice is responsible for announcing, guiding and receiving applications for establishment of notary office. Notice of receipt of application for establishment of notary office must be posted on the website of the Provincial People's Committee and Department of Justice. The deadline for receipt is 45 days from the date of posting notice. The Director of the Department of Justice decides to set up the Team to consider the application for establishment of notary office, led by the leader of Department of Justice. Members of the Document Review Team work independently, based on the criteria and scale of the Regulation to review and score each application.
