STANDING PEOPLE'S COUNCIL
Comprises of Chairman of People's Council, Deputy Chairwoman, Deputy Chairmen of People's Council and members:
1 – Mrs. Nguyen Thi Thanh Mai - Head of Legal Affairs Board of People's Council Term X;
2 – Mrs. Tran Thi Minh Hanh – Head of Economy – Budget Board of People's Council Term X;
3 – Mrs. Nguyen Thi Thao Nguyen – Head of Culture and Social Affairs of People's Council Term X.
Standing People's Council is a standing body of the People's Council, perform the duties and powers in accordance with the Law on Local Government and other relevant laws; take responsibility and report on work to the People's Council.
TASKS AND POWERS OF THE PROVINCIAL PEOPLE'S COUNCIL
1. Tasks and powers of the Provincial People's Council in organizing and ensuring the implementation of the Constitution and laws:
a) Promulgating resolutions on issues within the tasks and powers of the Provincial People's Council;
b) Deciding measures to ensure social order and safety, fight against crimes and other law violations, and fight against bureaucratism and corruption within its decentralization scope; measures to protect assets of agencies and organizations, protect the lives, freedom, honor, dignity, properties, other legitimate rights and interests of citizens in the province;
c) Deciding measures to perform tasks and powers decentralized by superior-level state agencies; deciding the decentralization to local authorities at district and commune levels and subordinate state agencies to perform tasks and powers of local authorities in the province;
d) Abolishing one part or whole of illegal documents of the People's Committee and the Chairman of the Provincial People's Committee; abolishing one part or whole of illegal documents of the district-level People's Council;
e) Dissolution of the district-level People's Council where it causes serious damages to the interests of the People and submitting this issue to the National Assembly Standing Committee for approval; Approving resolution of district-level People's Council on the dissolution of commune-level People's Council.
2. Tasks and powers of the Provincial People's Council in building the government:
a) Voting, exempting and dismissing the Chairman of the People's Council, the Vice Chairman of the People's Council, the Head, the Deputy Head of the Provincial People's Council, the Chief of Office of the Provincial People's Council Office; voting, exempting and dismissing the Chairman of the People's Committee, Vice Chairman of the People's Committee and members of the Provincial People's Committee; voting, exempting and dismissing the Assessors of the Provincial People's Court;
b) Taking confidence votes, holding confidence votes for incumbents elected by the Provincial People's Council in accordance with Articles 88 and 89 of this Law;
c) Exempting delegates of the Provincial People's Council and accepting the resignation of delegates of the Provincial People's Council;
d) Deciding to establish or remove specialized agencies of the Provincial People's Committee;
e) Deciding the regular staffing in the agencies of the People's Councils, People's Committees and public non-business units of the People's Committees at all levels in the province according to the staffing criteria assigned by the Government; deciding the quantity and allowances for part-time members at commune, village and residential quarter levels and approving the total number of people working in public non-business units under the provincial management according to Government regulations;
f) Deciding the establishment, dissolution, merger, division of villages and residential quarters; naming and changing the names of villages, residential quarters, roads, streets, squares, public works in localities in accordance with law.
3. Tasks and powers of the Provincial People's Council in the fields of economy, natural resources and environment:
a) Deciding the provincial long-term, medium-term and annual socio-economic development plans; planning and plans on development of sectors and fields in the province within their decentralization scope;
b) Deciding the state budget revenue estimates in the province; estimates of local budget revenues and expenditures and allocation of budget estimates at each level; adjusting local budget estimates in case of necessity; approving the accounts of local budget. Deciding the investment policies, project/ programs of the province in accordance with law;
c) Deciding contents related to charges and fees as prescribed by law; people's contributions; deciding the borrowing of domestic capital sources through the issuance of local bonds, municipal bonds, project bonds and other forms of capital mobilization in accordance with law;
d) Deciding specific guidelines and measures to encourage and mobilize various economic sectors to participate in the provision of public services in the province in accordance with law;
e) Deciding other measures for socio-economic development in the province in accordance with law;
f) Deciding construction planning and urban planning within its decentralization scope as prescribed by law; the regional economic linkages among the levels of local governments in line with the situation and characteristics of the localities and in consistence with the national economy;
g) Deciding the planning for development of organizational system of industry, agriculture, forestry and fishery extension, networks of trade, service, tourism and transport in the province in accordance with law;
h) Approving the provincial land use planning and plans before submitting them to the Government for approval; deciding measures for management and use of land, water resources, mineral resources, resources in the seas, airspace and other natural resources, and protection of the environment within its decentralization scope.
4. Tasks and powers of the provincial People's Council in the fields of education, training, science, technology, culture, information, physical training and sports:
a) Deciding measures to develop the network of educational institutions and conditions to ensure education and training activities within its decentralization scope; deciding the prices of education and training services for public education and training institutions under the provincial management in accordance with law;
b) Deciding measures to encourage the development of scientific research, promotion of innovations, technical improvements and application of scientific and technological advances in the province;
c) Deciding measures to develop culture, information, physical training and sports; measures to protect and promote the value of local cultural heritage; measures to ensure the activities of culture, information, advertising, press, publication, physical training and sports in the province within its decentralization scope.
5. Tasks and powers of the Provincial People's Council in the fields of health, labor and implementation of social policies:
a) Deciding measures to develop the system of medical examination and treatment facilities at provincial, district and commune levels;
b) Deciding the prices of medical examination and treatment services for State-owned medical examination and treatment facilities under local management in accordance with law;
c) Deciding measures to protect and care for people's health; protect and care for mothers, children, the elderly, the disabled, the poor, helpless orphans and other disadvantaged people. Deciding measures to prevent and control epidemics; measures to implement population and family planning policies in the province;
d) Deciding measures to manage, use and develop local human resources; measures to create jobs, raise labor productivity, increase incomes and improve working conditions, ensure labor safety and hygiene;
e) Deciding policies on attraction and encouragement for cadres, civil servants, public servants and employees in localities in line with local conditions and budget capacity and regulations of the superior state agency;
f) Deciding measures to implement preferential policies for people with meritorious services to the revolution; measures to implement social security and welfare policies, measures to eradicate hunger and reduce poverty.
6. Tasks and powers of the Provincial People's Council on ethnic and religious affairs:
a) Deciding measures to implement ethnic policies, improve the material and spiritual life, raise the intellectual standards of ethnic minorities, ensure equality among ethnic groups, and strengthen the whole-people solidarity and create mutual assistance among local ethnic groups;
b) Deciding measures to implement religious policies within its decentralized scope; measures to ensure equality among religions, freedom of belief and religion in the province.
7. Tasks and powers of the Provincial People's Council in the fields of national defense and security, social order and safety:
a) Deciding measures to ensure the performance of national defense and security tasks in accordance with law; maintain political security, fight against corruption, crimes and other law violations, ensure social order and safety in the province;
b) Deciding policies and measures to promote local potentials to build a strong national defense and people's security, establish a solid defense area to meet the requirements of peacetime and wartime;
c) Deciding policies and measures to build militia and self-defense forces, mobilization reserve units, the communes' public security; Deciding the guidelines and measures to combine economy with national defense and security, shift local socio-economic activities from peacetime to wartime;
d) Deciding measures to ensure public order and traffic safety in the province.
8. Supervising the compliance with the Constitution and laws in the locality, the implementation of resolutions of the Provincial People's Council; supervising the activities of the Standing Committee of the People's Council, the People's Committee, the People's Court, the People's Procuracy of the same level, and the boards of the People's Council at its level; supervising legal documents of People's Committees of the same level and documents of district-level People's Council.
9. Performing other tasks and powers as prescribed by law.
