In which, area (m2) is the area of land specialized for wet-rice cultivation to be converted to non-agricultural land, specified in the the competent authority's decision permitting the conversion of use purpose from land specialized for wet-rice cultivation to non-agricultural land. The price of land for rice cultivation (VND/m2) is calculated according to the Land Price List that is being applied at the conversion time of land use purpose promulgated by the Provincial People's Committee.
The Provincial People's Committee organizes the implementation of this Resolution.
This Resolution mainly amends a number of phrases and contents specified in Article 1 of Resolution 53/2016/NQ-HDND9 to be consistent with current law provisions. Accordingly, amending the phrase "land for wet rice cultivation" to "land specialized for wet rice cultiation", because according to Article 5 of Decree no. 35/2015/ND-CP stipulating the collection of money for protection and development of land for rice cultivation when converting land specialized for wet rice cultivation to non-agricultural land; not converting land for wet rice cultivation as Resolution no. 53/2016/NQ-HDND9; at the same time, according to the explanation of terms in Article 3 of Decree 35/2015/ND-CP, “land specialized for wet rice cultivation” and “land for wet rice cultivation” are two different types of land.
Amending the "Rate of collecting money for the protection and development of land for wet rice cultivation" to the "Rate of collecting money for the protection and development of land for rice cultivation" in the calculation formula in Article 1 of Resolution no. 53/2016/NQ-HDND9 to suit accordance with Clause 3, Article 2 of Circular no. 18/2016/TT-BTC.
Removing the phrase "land allocation, land lease" in the annotation to the formula for calculating the rate of collecting money for the protection and development of land for rice cultivation. This amendment is consistent with Clause 2, Article 5 of Decree 35/2015/ND-CP.
