The Conference was attended by Mr. Mai Hung Dung - Member of the Provincial Standing Party Committee, Standing Vice Chairman of the Provincial People's Committee (PPC); representative leaders of departments and branches, as well as 300 delegates who are officials of the Division of Natural Resources and Environment; Planning and Finance Divisions of districts, towns, and cities; Center for Land Fund Development at provincial and district levels, representatives of land price consulting units.
Overview of the training conference
The conference aims to improve understanding of legal policies, propagate deeply and widely, and equip professional knowledge, and skills in land management, land valuation, and handling of administrative procedures in the land field, on that basis to help officials, civil servants, public employees, and workers supplement, update and master new legal regulations, ensuring compliance and proper implementation of regulations.

Speaking at the conference, Mr. Mai Hung Dung - Standing Vice Chairman of the PPC said that during the past time, with the drastic participation of the Provincial Party Committee, PPC, and all levels of government, work of determining land prices in the province has had positive changes, but still reveals many limitations and inadequacies, such as land prices in some places not guaranteed to be close to market prices; investigating, surveying, and establishing land prices faces many difficulties, etc. Decree No. 12/2024/ND-CP of the Government promptly resolves a number of difficulties and obstacles in State management of existing land prices in localities, promptly opening up land resources for socio-economic development. He requested departments, district-level People's Committees, and commune-level People's Committees to continue to strengthen and improve the quality and efficiency of land price determination; closely follow the direction and guidance of the Government and the Ministry of Natural Resources and Environment in determining land prices.
The rapporteur presents the newly amended and supplemented contents of Decree No. 12/2024/ND-CP
At the conference, the delegates listened to the rapporteur present the newly amended and supplemented contents of Decree No. 12/2024/ND-CP of the Government and answer related questions. From there, based on the actual situation of the branch, localities proactively and flexibly organize implementation and disseminate it promptly and widely to officials, civil servants, public employees, and workers to apply it in accordance with regulations.
Regarding regulations on land prices, Decree No. 12/2024/ND-CP has amended and supplemented 6 Articles and added 9 new Articles to Decree No. 44/2014/ND-CP. In addition, Decree No. 12/2024/ND-CP also regulates the transitional handling of land prices.
These include some new regulations on land prices. Specifically, regarding the land valuation method, the Decree abolishes the deduction method; amends and supplements the content, application conditions, order, and procedures for applying comparison methods, income, surplus, and land price adjustment coefficients; supplements regulations on factors affecting land prices in the comparison method; amends and supplements regulations on information to apply land valuation methods, and also stipulates the responsibilities of the land price determination unit when collecting information and the responsibilities of agencies and units in providing information.
Regarding specific land prices, the Decree adds the authority to determine specific land prices and the order and procedures for determining specific land prices of district-level People's Committees in cases authorized by provincial-level People's Committees under the Law on Organization of Local Governments; supplements regulations on the responsibilities of agencies, organizations, and individuals in organizing and determining specific land prices; amends and supplements regulations on completing land price plan documents; removes regulations on specific land pricing plans.
Regarding the selection of an organization with the function of consulting on determining specific land prices, the Decree supplements regulations for cases where an organization with the function of consulting on determining land prices cannot be selected, assigning tasks to public service units with the function of consulting on land price determination or establishing an interdisciplinary working group; amends the conditions for practicing consulting on land price determination.
Regarding the Specific Land Price Appraisal Council, the Decree amends and supplements the responsibilities of agencies and organizations in the process of preparing land price plan documents to submit to the Specific Land Price Appraisal Council, composition, sequence of operations, and appraisal content of the specific Land Price Appraisal Council.
Regarding transitional regulations, the Decree stipulates handling of cases where there has been a decision to allocate land, lease land, allow change of land use purpose, etc. by the provisions of land law and other relevant provisions of law that are not subject to cases where the State recovers land due to violations of land law before the effective date of Decree No. 12/2024/ND-CP but the specific land price has not been decided.
In addition, this Decree supplements the regulation that land users must pay an additional amount for the period not including land use fees and land rents, in accordance with the provisions of the Government's Decree on collection of land use fees and land rents.
