Questioning the issuance of land use rights certificates and environmental protection

Urge the issuance of Certificates of land use rights and housing ownership

Deputy Tran Thanh Trong - Thuan An City Deputies Group asked: Voters reflected that currently, many households had received land, houses and paid up to 95% of the value of transfer and purchase contracts from before 2020 but had not yet received the Certificate. It is requested the Director of the Department of Natural Resources and Environment to inform them about the cause of this problem and solutions in the coming time to issue Certificates to people in residential areas in the province, especially the residential area in Thuan An city.

Mr. Ngo Quang Su said that in 2023, the Department of Natural Resources and Environment received and processed 196.195 eligible applications and issued 271.891 Certificates.

The remaining about 42 residential projects that are not eligible for transfer as prescribed in Decree No. 148/2020/ND-CP, because: the investors have not yet carried out land allocation procedures; have not fulfilled financial obligations; have not completed investment in infrastructure construction according to the approved 1/500-scale detailed planning, or have invested the infrastructure and signed a transfer contract to the people but have not yet contacted the Department of Construction for inspection and acceptance.

Faced with the above situation, the Provincial Party Committee and People's Committee directed the Department of Construction and Provincial Inspectorate to coordinate with the Department of Natural Resources and Environment, relevant departments, committees and branches and the district People's Committee to establish an inspection team to promptly remove difficulties and problems for enterprises.

The Department of Natural Resources and Environment will proactively contact, urge, and guide investors to complete the required conditions to submit the documents for Certificates. At the same time, preparing the necessary human and material resources to urgently issue the Certificates after receiving all documents from investors as soon as possible (10 working days).

Particularly for the Viet Sing Residential Area Project in Thuan An City, 6.382 out of 6.827 Certificates have been issued (accounting for 93.5%), the remaining 445 cases have not yet been issued Certificates. The reason is that Becamex IDC Corp is preparing procedures to adjust the land use purpose on the Certificate according to the approved 1/500-scale adjustment planning. It is expected that by August 2024, the issuance of Certificates for the remaining 455 cases will be completed.

Improve environmental monitoring efficiency

Mr. Ngo Quang Su said that to control wastewater discharge from enterprises, Binh Duong province had installed an automatic wastewater monitoring system since 2011 for 6 industrial parks. To date, industrial parks, industrial clusters and waste sources with wastewater flow of over 500 m3/day have been installed with automatic monitoring systems, with a total of 109 waste sources, continuously controlling 24/24 the operation of the treatment system and wastewater quality of waste sources with a flow of about 280,000 m3/day of industrial wastewater and 70,000 m3/day of urban wastewater, accounting for 85% of industrial wastewater and 36% of urban wastewater generated in the province. At the same time, installing an automatic emission monitoring system for 38 waste sources.

Many industrial parks and industrial clusters have been invested in upgrading and renovating to meet wastewater treatment standards such as: My Phuoc I and III, Song Than I, Song Than II, Dong An, Viet Huong II Industrial Parks, Tan Thanh Industrial Cluster, etc. Monitoring results show that the number of waste sources regularly treating wastewater meeting environmental standards in 2015 was about 70% and currently reaches over 96%.

In the coming time, the Natural Resources and Environment branch will install more automatic environmental monitoring stations for air, underground water, and surface water. Thus, strengthening the capacity to monitor environmental components will ensure full monitoring of environmental components and predict environmental quality in the province in the coming time.

The branch will also promote the construction of applications to connect with existing software to synchronize the environmental database in general and data from the automatic monitoring system in particular, connect and interconnect with the databases of ministries, branches, and localities, ensuring that data is connected and complete. Particularly, sharing monitoring data from the automatic wastewater, exhaust gas and environmental components monitoring system to the province's Intelligent Operation Center (IOC) and sharing with the community via mobile phone app and electronic display boards to improve openness, transparency, and people's supervision.

The branch will proactively notify and warn waste source owners of signs of wastewater exceeding standards for timely remediation, inspect and strictly manageswaste source owners who do not remediate and let wastewater exceed standards into the environment.

Regarding the question of deputy Nguyen Ngoc Van - Tan Uyen City Deputies Group about preferential policies and support for enterprises when implementing circular economy related to recycling and reuse of waste, Director of the Department of Natural Resources and Environment said that currently, enterprises implement circular economy in Binh Duong province, especially enterprises in the field of waste collection, treatment, recycling or reuse have been given incentives and land support (arranging land funds associated with technical infrastructure works such as transportation, electricity, water supply and drainage, communications, energy; exemption or reduction of land use fees, land lease according to the provisions of land law); incentives and support for investment capital (preferential loans from the Environmental Protection Fund); incentives on taxes and fees (entitled to incentives on corporate income tax and other taxes, fees and charges according to the provisions of law on taxes, fees and charges); subsidized prices for environmental protection products and services; priority in purchasing green products for investment projects and tasks using the State budget; support in promoting environmental protection activities.

The Department of Natural Resources and Environment will coordinate research and advise the PPC to guide and specify the above incentives and support to encourage and create conditions for enterprises to implement circular economy.

Regarding the roadmap for classifying domestic solid waste at source, Mr. Ngo Quang Su said that from now until December 2024, the Department of Natural Resources and Environment and People's Committees of districts, towns and cities would focus on implementing propaganda solutions, inspecting and monitoring the classification of domestic solid waste at source and the meeting of technical requirements of collection and transportation vehicles throughout the province to rectify. From January 01, 2025, violations will be managed according to the provisions of the Government's Decree No. 45/2022/ND-CP dated July 07, 2022.
