Binh Duong is located in the Southern Key Economic Region, one of the leading provinces in industrial development. With open policies, inviting investment and stable and sustainable development of the province, to date there have been more than 61,000 domestically invested enterprises and 4,087 foreign investment projects registered for production and business activities with over 1.2 million workers who are Vietnamese citizens and 27,347 foreigners living and working in the area. Foreigners reside mainly in accommodation establishments belonging to companies and enterprises (15,816 people), the remainder are other types of accommodation establishments.

According to Colonel Pham Quoc Dung - Deputy Director of the Provincial Police, reality shows that there are cases of foreign workers quitting their current jobs, not returning home, staying in Viet Nam to find another job but not complying with immigration and residence regulations. Enterprises and employers do not promptly carry out procedures to issue or extend work permits, or are not granted work permits due to ineligibility, etc. leading to delays in implementing visa application procedures and extension of temporary residence according to regulations, violating immigration regulations.
In addition, a number of cases have been detected where enterprises have no need to employ foreign workers but still make documents to sponsor foreigners to enter the country, then let foreigners come to work for other companies and partner enterprises. The situation where the company does not have a headquarters or is not physically operating at the registered business address or the company or enterprise is discontinued or inactive and still sponsors foreigners for entry continues, etc. creating many complex security and order problems and causing difficulties in the management of foreigners in the province.
Colonel Pham Quoc Dung emphasized that the issuance of Decision No. 1314/QD-UBND on Regulations on coordination in State management of entry, exit, residence and activities of foreigners in Binh Duong province between functional agencies, committees and branches from the province to the grassroots has contributed to performing well the coordination and management of foreigners' residence activities, ensuring harmony and unity, overcoming arising problems and overlaps between levels and branches, creating favorable conditions for foreigners to enter, exit and reside in Binh Duong province in accordance with the law.
Overview of the conference
Reporting at the conference, Major Tran Van Thanh - Deputy Head of the Immigration Division (PA08) of the Provincial Police said that the Provincial Police has advised the PPC to strictly implement the Law on Entry, Exit, Transit, and Residence of Foreigners in Viet Nam and the Law amending the Law on entry, exit, transit, and residence of foreigners in Viet Nam; declaration of foreigners' temporary residence on the Internet. Resolving promptly, preventing sudden and unexpected situations from occurring, contributing to maintaining security and order in the province in general and in the field of immigration in particular. Each force and each level in the Provincial Police proactively develops plans and organizes the work of capturing and managing foreigners and implementing measures to prevent, detect, and combat activities that violate national security, social order and safety by foreigners according to assigned functions and tasks. Focusing on implementing professional measures, firmly grasping the situation of foreigners entering, exiting, operating and residing in the province effectively.
From May 2018 to May 2023, the Provincial Police received and processed 43,430 entry and exit documents of foreigners, ensuring compliance with procedures and regulations. Through administrative inspection and receipt of documents related to foreigners, the Provincial Police detected, advised, and coordinated to handle administrative violations in 3,111 cases of foreign organizations and individuals violating regulations in the field of immigration; detected and handled 46 foreigners who illegally entered Viet Nam to Binh Duong province. Coordinating to arrest two internationally wanted individuals at the request of the Chinese Ministry of Public Security.

From January 2018 to August 2023; The Department of Labor, War Invalids and Social Affairs has sanctioned administrative violations against 09 enterprises and submitted to the PPC to sanction 01 enterprise for violations in using foreign workers.
The Department of Health has coordinated to organize Covid-19 vaccination for 34,450 turns of foreigners. The Department of Justice has received and processed documents requesting the issuance of criminal record certificates for 13,478 cases of foreigners residing in the province; prepared criminal records for 25 cases of foreigners with criminal convictions, etc.
Continue to strengthen coordination in management of foreigner activities
Talking at the conference, Mr. Pham Van Tuyen - Deputy Director of the Department of Labor, War Invalids and Social Affairs said that from January 01, 2023, the regulations on creating favorable conditions for foreign experts under Resolution No. 30/2021/QH15 will no longer be effective, causing difficulties for employers employing foreign workers who have worked for many years in Viet Nam (10 years or more). Employers report that it is very difficult to re-confirm work experience abroad as prescribed in Clause 4, Article 9, Decree No. 152/2020/ND-CP due to many different reasons such as the enterprise no longer operating, or having been out of work for a long time so it cannot be confirmed. Leaders of the Department of Labor, War Invalids and Social Affairs also raised difficulties in coordination between branches in exchanging information, inspecting and checking the situation of foreign workers entering and exiting the country, especially the coordination of data extraction and statistics to provide the number and nationality of foreigners working and residing in the province; inspecting and handling violations of foreigners in the field of labor and sponsoring foreigners entering the country for activities not in accordance with the purpose or program.

Mr. Le Thanh Toan - Deputy Director of the Department of Planning and Investment said that agencies need to regularly and proactively exchange, coordinate, and provide information, create favorable conditions for enterprises to access information, and shorten the time to carry out administrative procedures. At the same time, strengthening dialogue between State management agencies and enterprises and business households to raise awareness of law compliance in enterprise operations.

The representative of Bac Tan Uyen district proposed to amend and promulgate new Regulations to be consistent with the provisions of current law. Along with State management, promoting propaganda and dissemination of legal regulations for foreign-invested enterprises in the province is extremely necessary, so that enterprises can clearly understand and comply with Vietnamese law. State management officials in this field need to be trained and fostered to improve their professional qualifications, especially foreign language skills, to better perform their assigned tasks.
In the coming time, to improve the effectiveness of coordination and management of foreigners, creating the most stable and favorable environment for attracting foreign investment capital and socio-economic development, Binh Duong will continue to strengthen measures to prevent, fight and stop activities that violate national security and social order by foreigners; promptly detect and handle foreigners who violate the immigration field, especially cases of entry or activities not in accordance with the purpose or program for which visas have been requested. Completing the connection mechanism to exchange and share information and data between relevant agencies and units to serve the management of foreigners.
Branches and localities coordinate well to carry out propaganda and dissemination of legal education related to the management of foreigners; organize training courses on legal knowledge, professional skills, information technology, and foreign languages for officials working in the management of foreigners in the province.
The Provincial Police continue to advise the PPC to promulgate new coordination regulations on entry, exit, residence and activities of foreigners, thereby creating a legal basis for implementing State management functions in the province in accordance with the provisions of law and the local practical situation, ensuring the creation of favorable conditions to attract foreign organizations and enterprises to invest and highly qualified foreigners to work, live and participate in the fields as prescribed by law.
