After more than 10 years of implementation, the Law on Inspection 2010 has created an important legal corridor in improving the organization and improving inspection activities, contributing to stabilizing socio-economic development, improving the efficiency of state management and preventing and combating corruption and negativity. However, the Law on Inspection 2010 also revealed many limitations, difficulties and obstacles that reduced the effectiveness and efficiency of inspection activities, did not meet the requirements of the new situation in the context of the development of the market economy and international integration, etc.The draft Law on Inspection (amended) is developed in the direction of rearranging and re-organizing inspection agencies to suit the management requirements of each field, ensuring the reduction of focal points of inspection agencies but still ensuring that State management activities in all fields are effectively inspected and examined. Inspection activities will be enhanced in a professional manner, both ensuring the initiative and self-responsibility of the inspection agencies, while also ensuring the leadership and direction of the heads of state management agencies. The Draft Law also delineates handling competence among inspection agencies, between inspection activities and audit activities, and inspection activities with regular inspection activities of management agencies. The draft Law maintains the organizational system of inspection agencies according to administrative levels, including: Government Inspectorate, Provincial Inspectorate, and District Inspectorate.
Deputies comment on the draft Law on Inspection (amended)
At the conference, the deputies commented on the inspection system by administrative level; inspection forms, order and procedures for conducting administrative and specialized inspection activities; the performance of tasks and powers by heads of state management agencies, inspection decision issuers, and heads of inspection teams; the value of inspection conclusions, etc. Many opinions agreed to continue maintaining the District Inspectorate as it is today. However, it is necessary to research and have solutions to strongly innovate the organization and operation in accordance with streamlining the apparatus, improve efficiency and operational efficiency and overcome inadequacies. The deputies also said that it is necessary to clearly define a close and effective coordination mechanism between state management agencies, inspection and audit agencies in the development of inspection orientations and plans to remove from the very beginning the contents and objects of inspection and audit that may lead to overlapping or duplication, ensuring that each agency properly performs its assigned functions and tasks.
Concluding the conference, Mr. Pham Trong Nhan highly appreciated the profound and enthusiastic contributions of the deputies, thereby contributing to providing the theoretical and practical basis for completing the draft Law.
