This Regulation stipulates the responsibility for coordination between the investor and the manager-user, from the project preparation stage to the construction completion stage for public investment projects in the province. It is applied to the investor (in case the investor is not a management and use unit, as defined in the Law on Public Investment) and the manager-user of public investment projects (civil works) under the investment decision-making authority of the Chairman of the Provincial People's Committee and the Chairman of the District People's Committee.
The investor actively cooperates with the manager-user to perform construction activities from the project preparation stage to the construction completion stage for a number of tasks: Making reports on investment policy proposals, construction planning (for the case > 5ha), setting up construction investment projects; compensation, site clearance, resettlement and land acquisition and delivery for project implementation (if any); setting up construction design and deploying after basic design; procurement, processing, manufacturing and installation of equipment, etc.
Management coordination ensures objectivity, consistency, on the basis of functions, tasks and powers of the Management Unit, departments, committees, and branches, People's Committees of districts, towns and cities and in accordance with the law in order to improve the quality of public investment projects. The coordination between agencies must comply with the functions and tasks of the participating parties in accordance with the provisions of law; at the same time, creating conditions for the parties to complete the assigned tasks, etc.
The investor is responsible for collecting opinions from the manager-user in writing in the process of making a report on investment policy proposals according to the prescribed contents. During the process of setting up construction planning tasks and projects (if any), the investor is responsible for collecting opinions on the required contents of each type of construction planning task and project from the manager-user; editing, completing and summarizing before submitting to competent agencies for appraisal of construction planning tasks and projects. Performing the function of the investor to coordinate with the manager-user in compensation, site clearance, resettlement and land acquisition and delivery to implement the project in accordance with the law, etc.
The manager-user has comments on the contents of the construction planning tasks and projects (if any) for the investor to edit, complete and summarize before submitting to competent agencies for appraisal of construction planning tasks and projects as prescribed. Coordinating when receiving requests from investor in compensation, site clearance, resettlement and land acquisition and delivery to implement the project in accordance with the law. During the process of construction, acceptance and handing over the works to put into use, the manager-user is responsible for attending the acceptance test at the end of a construction phase or a work part that needs to be inspected and accepted to evaluate the quality before moving on to the next construction phase or at the end of a construction contract; completing all construction items, construction works as prescribed in Article 23 of Decree no. 06/2021/ND-CP, etc.
