Guidance on settlement of support policies for workers affected by the Covid-19 pandemic

​PORTAL - Following the direction of the Provincial Party Committee and the Provincial People's Committee on speeding up the implementation of support for people and workers in the province, the Department of Labor, War Invalids and Social Affairs guides and supplements a number of contents to support subjects according to Decision no. 09/2021/QD-UBND right on July 16, 2021 of the Provincial People's Committee.

Accordingly, the subjects supported include: Street vendors; retail traders on the roadside with no fixed location; garbage and scrap collectors; porters; people transporting goods by means of 2-wheel motorcycles and other vehicles with a tonnage of 500kg or less; two-wheeled passenger motorcyclists; mobile lottery ticket sellers; freelance manual workers in the field of construction; people self-employing or working at household businesses in the fields of accommodation, catering, tourism, health care (including security); people who do jobs in a number of fields and professions must temporarily stop operating according to Official Dispatch no. 1954/UBND-VX of the Provincial People's Committee (workers working in services such as gyms, wedding restaurants, yoga studios, venues of entertainment and singing together, cinemas, discos, karaoke, game rooms, bars, beauty facilities, cosmetology clinics, massage and physiotherapy facilities); other cases such as workers in the agricultural sector (garden care, rubber removal, weeding, embankment, ditch construction, taking care and harvesting vegetables, tubers and fruits, sawing trees, etc.), workers in the service sector (childcare, home child care, domestic help, processing goods, car and motorcycle repair, welder, turner, electrician, lacquerer, sculptor, car driver), workers for household shops; employees working in enterprises without or having entered into labor contracts have terminated labor contracts with their employers but have not yet participated in Social insurance.

Other specific cases not mentioned above will be considered and decided by the commune-level People's Committee on the principle: The work being done is the main source of income, being deeply reduced or lost income source and affecting the daily life of individuals and families.

For employees who work at units and enterprises but have not yet entered into a labor contract or participated in Social Insurance (according to Official Dispatch no. 3897/UBND-VX dated August 11, 2021 of Binh Duong Provincial People's Committee), the Department of Labor, War Invalids and Social Affairs will have its own guiding document. The above subjects present at the time of making the list are permanent residents or are staying in boarding houses or rented houses (including temporary residents but have not yet registered their temporary residence or temporary absence with the local authorities).

Cases of workers who are working in the agricultural sector, the service sector, for household shops; employees working in enterprises without or having entered into labor contracts have terminated labor contracts with their employers but have not yet participated in Social insurance receive the application for the support policy through the Head of the residential group, the Head of quarter and hamlet, the community Covid group, the boarding house owner or other focal points assigned and tasked by the commune-level People's Committee. The workers only need to declare and commit to the content according to the application to submit, no need to attach any other documents.

In case employees who work at units and enterprises but have not yet entered into labor contracts or have not participated in social insurance, the employer shall make a list of requests for support and send it to the district-level People's Committee (through the Division of Labor, War Invalids and Social Affairs) to appraise and submit to the Department of Labor, War Invalids and Social Affairs for approval the list and support funding.

The process is performed according to the content of Official Dispatch no. 4192/SLDTBXH-CSLD dated July 16, 2021 of the Department of Labor, War Invalids and Social Affairs.
