Tasks and powers of the Provincial People's Committee1. Developing and submitting to the Provincial People's Councils for decision the contents prescribed at Points a, b and c, Clause 1, Points d, đ and e, Clause 2, Clauses 3, 4, 5, 6 and 7. Article 19 of the Law on Organization of Local Governments and Implementation of Resolutions of the Provincial People's Council. 2. Stipulating the organizational structure and specific tasks and powers of the specialized agencies under the Provincial People's Committee. 3. Organizing the implementation of the provincial budget, tasks of socio-economic development, development of industry, construction, trade, services, tourism, agriculture, forestry, fishery and networks of transport and irrigation; the implementation of measures to manage and use land, forests, mountains, rivers, lakes, water resources, mineral resources, resources in the sea, airspace and other natural resources; implement measures to prevent and control natural disasters and protect environment in the province within its decentralized scope. 4. Formulating and organizing the implementation of provincial programs, projects and schemes for ethnic minority areas and areas with exceptionally difficult socio-economic conditions. 5. Implementing measures to build a national defense posture linked to the people's security posture in the province; directing the implementation of the plans for building a solid defense area in the province; organizing the national defense and security education and local military work; building and organizing operations of local soldiers and militia and self-defense force; building a reserve force and mobilize forces to meet the task requirements in accordance with law; building a movement in which the whole people protect the national security in the locality. 6. Performing the tasks of organizing and ensuring the implementation of the Constitution and laws, building the government and administrative boundaries, education, training, science, technology, culture and information, physical training, sports, health, labor, social policies, ethnic groups, religion, national defense, security, social order and safety, judicial administration, judicial assistance and duties, other powers as prescribed by law. 7. Performing tasks and powers decentralized and delegated by central state agencies. 8. Decentralizing and authorizing lower-level People's Committees, agencies and organizations to perform the tasks and powers of provincial-level People's Committee.
Tasks and powers of the Chairman of the Provincial People's Committee The Chairman of the Provincial People's Committee is the head of the Provincial People's Committee and has the following tasks and powers: 1. Leading and managing the work of the Provincial People's Committee and members of the Provincial People's Committee; leading and directing professional agencies under the Provincial People's Committee; 2. Approving the results of election, exemption and dismissal of Chairman and Vice-Chairman of district-level People's Committee; mobilizing, suspending and dismissing the Chairman and Vice Chairman of the district-level People's Committee; assigning the right of the Chairman of the district-level People's Committee in case of vacancy of the Chairman of the district-level People's Committee between two meetings of the district-level People's Council; requesting the Chairman of the district-level People's Committee to suspend or dismiss Chairman and Vice- Chairman of lower-level People's Committees when they fail to fulfill assigned tasks or violate law; appointing, exempting, transferring, dismissing, commending and disciplining officials, civil servants and public employees under its management scope in accordance with law; 3. Leading and directing the performance of the tasks of implementing the Constitution, laws, documents of superior state agencies, Provincial People's Councils and Provincial People's Committees; performing national defense and security tasks, ensuring social order and safety, fighting against crimes and other law violations, fighting against bureaucratism and corruption; organizing the implementation of measures to protect the assets of agencies and organizations, protect the lives, freedom, honor, dignity, properties, other lawful rights and interests of citizens; implementing measures to manage the population in the province in accordance with law; 4. Leading and taking responsibility for the operation of the State administration system from the provincial to grassroots levels, ensuring the consistency and smoothness of the administration system; directing the reforms of administration, public service and civil service in the local state administrative system; 5. Suspending the implementation or abolishing illegal documents by specialized agencies of the Provincial People's Committees and the illegal documents of the People's Committees and Chairmen of district-level People's Committees. Suspending the implementation of illegal documents of the district-level People's Councils, reporting them to the Provincial People's Committee to request the Provincial People's Council for abolition; 6. Organizing the coordination with superior state agencies located in the province to perform the tasks and powers in accordance with law; 7. Directing Chairmen of district-level People's Committees; authorizing the Vice Chairman of the Provincial People's Committee or the head of a specialized agency under the Provincial People's Committee to perform the tasks and powers within the authority of the Chairman of the Provincial People's Committee; 8. Managing and organizing the effective use of working offices, properties, facilities and state budget assigned in the province in accordance with law; 9. Directing the implementation of measures for environmental protection and fire prevention; directing and applying measures to solve unexpected and urgent tasks in the prevention and control of natural disasters, epidemics, security, social order and safety in the province in accordance with law; 10. Organizing the inspection, examination and settlement of complaints and denunciations, handling law violations and receiving citizens in accordance with law; 11. Performing tasks and powers decentralized and delegated by central state agencies. Information FUNCTIONS Department of Science and Technology acts as the professional agency, which counsels and supports the provincial people's committee to perform State management of science and technology, including scientific and technological operations; developing scientific and technological potentiality; standards, measures, quality; intellectual property; radioactive and isotope, and radiation application; nuclear and radiation safety, managing and implementing the public services in the sector managed by the Department in the province as stipulated by the law.
TASKS AND POWERS 1. Submitting the provincial People's Committee a) Drafting decisions, directions; long-term, five-year and annual plans of science and technology; programs and methods to organize and implement State administrative reform tasks and decentralized administration in the sector of science and technology in the province; b) Mechanisms, policies, methods to speed up the scientific researches and technological development, transfers of technology, develop the technological market, effectively use potentialities and apply the scientific and technological achievements; c) Drafting regulations on Department's functions, duties, rights and organizational structure; drafting establishment decisions and regulations on organization and operation for Fund of scientific and technological development in the locality; d) Drafting regulations on title standards for Head, Vice Head of organizations in the Department; the managerial titles of Economic Division under management of the district-level people's committee in the sector of science and technology; 2. Submitting Chairman of the provincial People's Committee: a) Drafting decisions on establishment, merging and dissolution for units managed by the Department as stipulated by the law; establishing the provincial scientific and technological council as stipulated in Law on Science and Technology, guided by Ministry of Science and Technology; b) Drafting decisions on the assignment of the right to possess and use the results of scientific research and technological development using the state budget within their management to organizations and individuals according to the provisions of law; c) Drafting specific decisions and directives under the promulgating competence of Chairman of the provincial People's Committee on science and technology; d) Drafting documents on the relationship and coordination of work between the Department of Science and Technology and related departments, agencies and district People's Committees. 3. Guiding, inspecting and organizing to implement the legal documents, plans, mechanisms, policies on science and technology enforced and approved by the relevant agencies; informing, propagandizing, guiding, popularizing, educating law on science and technology; guiding departments, committees, branches, district-level people's committee, scientific and technological organizations of the locality in scientific and technological management. 4. Managing, organizing inspection, registration, adjustment, revocation, extension for licenses, certificates, registration certificates within State management of science and technology as stipulated by the law, assigned or authorized by the provincial people's committee. 5. Planning and estimating expenditures on development investment, scientific and technological expenditures from the annual state budget for the province's science and technology fields on the basis of summarizing estimates of departments, branches and committees, district-level People's Committees and related agencies. Monitoring and inspecting the State budget for the provincial sector of science and technology as stipulated in Law on State Budget and the Law on Science and Technology 6. Managing scientific research and technological development activities: a) Organizing to identify, order, select, direct deliver, evaluate and pre-accept the science and technology tasks; organizing to assign the ownership and right to use results of scientific research and technological development using the state budget to organizations and individuals; b) Monitoring, inspecting and supervising the process of implementation and pre-acceptance test of science and technology tasks using the state budget; c) Receiving, organizing to apply and evaluate the effectiveness of applying the science and technology tasks proposed to order by the provincial People's Committee or ordered after being evaluated and accepted; d) Organizing to evaluate and accept the results of scientific research and technological development without using the state budget of organizations and individuals in the area of province in accordance with law; e) Combining with the local departments, committees, branches and the related agencies to propose lists of the State-level inter-branch science and technology tasks, lists of the State-level inter-region science and technology tasks for socio-economic development in the locality; f) Establishing Science and Technology Consulting Councils in accordance with the Law on Science and Technology and decentralization or authorization of Chairman of the provincial People's Committee. 7. Regarding the development of scientific and technological markets, science and technology enterprises, scientific and technological organizations and scientific and technological potentials: a) Organizing surveys and assessments of technological level and development of science and technology market; guiding and inspecting the operation of technology trading centers, technology exchanges, intermediary organizations of the science and technology market, science and technology enterprises in the localities; b) Guiding the organizations and individuals in technology incubation activities and incubation of science and technology enterprises; formulating and organizing to implement the solutions to support technological innovation; c) Organizing the registration and checking the activities of science and technology organizations, representative offices and branches of science and technology organizations; guiding the establishment and certification of science and technology enterprises in the area of province according to the provisions of law; d) Guiding and inspecting the implementation of the autonomy and self-responsibility mechanism of public scientific and technological organizations; the establishment and development of scientific and technological enterprises in the area; e) Guiding, managing technology transfer in the area, including technology transfer and assessment, valuation, technology appraisal, brokerage and technology transfer consultancy; technological appraisal for investment projects and appraisal for contents of science and technology of socio-economic development plans in the locality within jurisdiction; f) Proposing investment projects on developing the scientific and technological potentials of the province and organizing the implementation after approval by competent agencies; g) Organizing to perform mechanisms, policies to use scientific and technological officers; organizing the trainings to improve scientific and technological officers in the locality; 8. Organizing research and application of scientific - technical and technological advances; exploiting, publishing and propagating results of scientific research and technological development and other scientific and technological activities; coordinating in implementing national-level science and technology tasks using local state budgets. 9. Intellectual property: a) Organizing to implement methods to develop industrial property; guiding the industrial property operation for organizations and individuals; managing geographical indications, landmarks, and other signs indicating the geographical origin of local specialties; b) Guiding and assisting organizations and individuals to apply industrial property procedures; presiding, combining with relevant agencies in protecting industrial property rights and handling violations of industrial property law; c) Presiding to implement measures to popularize, encourage and promote local inventions and innovations; organizing to consider and recognize the State-funded initiatives, material and technical facilities according to the provisions of law; d) Assisting the Provincial People's Committee in performing the state management of intellectual property in the related fields according to the provisions of law and the decentralization or authorization of the provincial People's Committee. 10. Standards, measurement and quality a) Organizing building-up and joining building-up of the local technical standards; b) Organizing to popularize, apply the national technical codes, the local technical codes, the national standards, the international standards, the regional standards, the foreign standards; guiding to build up the basic standards for organizations and individuals in the area; checking the observance of laws on technical standards and regulations in the area; c) Organizing, managing, guiding production and trade organizations, individuals to perform announce standards applicable to products, goods, services, processes and environment as assigned by the relevant State agencies; d) Receiving standard conformity announcement of organizations, individuals that registered production and business in the locality; receiving regulation conformity announcement in the assigned sector; e) Performing communication, question and answer for standards, quality and technical corridor in commerce in the area; f) Organizing to implement tasks related to activities for improvement of productivity and product and goods quality; g) Organizing appraisal and adjustment network for measurement to satisfy demand of the locality; performing appraisal and adjustment of measurement in sectors and scope as accepted; h) Receiving the announcement of using the quantitative seal; certification of establishments' eligibility to use quantitative seals on pre-packed goods according to law provisions; i) Organizing to check the measurement standards, measuring devices, measurements, prepackaged goods, calibration and testing activities in accordance with law; organizing to implement methods so that organizations and individuals with related rights and obligations supervise and inspect the implementation of measurements, measuring methods, measuring devices, measurement standards and goods quality; j) Organizing testing to meet requirements of state management and needs of organizations and individuals on product and goods quality in the locality; k) Presiding, combining with the relevant agencies to organize, realize inspection for quality of products and goods in circulation in the area, import-export goods and goods labels, codes and bar codes as assigned, decentralized or authorized by competent state agencies. l) Organizing the application of the Quality Management System according to ISO 9001 to the operation of agencies and organizations under the state administrative system in accordance with law. 11. Radiation and radioactive isotope application, radiation and nuclear safety: a) Radiation and radioactive isotope application: - Organizing to implement programs, projects and methods in order to speed up radiation and radioactive isotope application for socio-economic development; organizing to deploy radiation and radioactive isotope application in the economic technical sectors in the area; - Managing observation of environmental radioactivity in the area; - Organizing to implement the relevant technical services of radiation and radioactive isotope application; b) Radiation and nuclear safety: - Organizing to implement registration of radiation and nuclear safety as stipulated by the law or assigned, authorized by the provincial people's committee; - Managing declaration, statistics for radioactive sources, radiation equipment, and radioactive waste in the area as stipulated by the law; - Organizing to control and handle radiation hazards, nuclear risks in the area; - Building and integrating the national database of radiation and nuclear safety control in the locality. 12. Science and technology information, statistics a) Organizing to guide and implement the collection, registration, storage and disclosure of information on scientific and technological tasks in the province; b) Building and developing scientific and technological information infrastructure; participating in building and developing the national database on science and technology, databases on science and technology of the province; c) Organizing and implementing the processing, analysis - summarizing and providing scientific and technological information for leadership, management, research, training, production, business and socio-economic development of the province; d) Directing, guiding, and organizing to implement the basic statistical reporting regime on the province's science and technology; presiding to implement the general statistical reporting regime on science and technology; e) Conducting statistical surveys on science and technology in the province;
f) Managing, building and developing provincial science and technology sources; joining the Vietnam Library Union on scientific and technological information sources; g) Organizing technology-equipment fairs, centers, technology information exchanges directly and on the Internet, science and technology fairs, exhibitions; popularizing, publishing publications and providing scientific and technological information; h) Organizing services on information, libraries, statistics and scientific and technological databases; printing and digitizing; organizing science and technology events. 13. Public service a) Guiding public service delivery organization to perform public services in the sector of science and technology in the area; b) Organizing to implement processes, procedures, economic-technical norms for supplies of public services in the sector of science and technology; c) Guiding, facilitating to support organizations in performance of public services of science and technology as stipulated by the law. 14. Supporting the provincial people's committee to perform State management on science and technology activities for enterprises, collective organizations, private organizations in the area stipulated by the law. 15. Performing international cooperation of science and technology as stipulated by the law and assigned or authorized by the provincial people's committee and Chairman of the provincial People's Committee. 16. Implementing the inspection, examination and solving complaints and denunciations on science and technology as stipulated by the law and assigned or authorized by the provincial people's committee; organizing citizen reception and implementing anti-corruption regulations and thrift practice and waste combat practices; handling as its competence or proposing competent agencies to handle law violations on science and technology as stipulated by the law. 17. Stipulating functions, tasks, rights, organization structure and job relations of the units under the Department according to the guidance of the Ministry of Science and Technology and the regulations of the provincial People's Committee; 18. Managing the organizational structure, payroll of civil servants, the number of people working in public non-business units under the Department; Salary and policy, remuneration, training, retraining, commendation and discipline policies for civil servants, officials and employees under the Department's management in accordance with the law and as decentralized or authorized by the Provincial People's Committee; organizing professional fostering for officials specialized in scientific and technological management of the Economic Divisions of districts, towns or provincial cities. 19. Guiding and inspecting the activities of associations and non-governmental organizations operating in the field of science and technology within the local jurisdiction as stipulated by the law. 20. Managing and taking responsibility for the Department's finance and assets as stipulated by the law and assigned by the provincial people's committee. 21. Compiling information, making periodical or annual reports on the implementation of assigned tasks with the provincial People's Committees and the Ministry of Science and Technology. 22. Performing other duties assigned by the provincial People's Committee, Chairman of the provincial People's Committee and as prescribed by law. FUNCTIONS The department advises and assists the provincial People's Committee in state management of caring and protecting people's health, including: preventive medicine; examining and treatment; functional rehabilitation; traditional medicine; preventive and curative medicines for people; cosmetics; food hygiene and safety; medical equipment; population; health insurance (hereinafter referred collectively to as health). TASKS
1. Advising the Provincial People's Committee a) Planning to develop the sector; planning the network of health facilities; long-term, 5-year and annual plans; projects, programs for health development, administrative reform and management decentralization, socialization in the local health sector; b) Decisions and directives promulgated by the provincial People's Committee on the health sector; c) Regulations, functions, tasks, rights and organizational structure of Branches under the Department; d) Regulating title standards for heads and deputy heads of units of the Department; Heads and Deputy Heads of Health Divisions. 2. Advising the Chairman of the provincial People's Committee a) Deciding to establish, merge, or dissolve units under the Department of Health and non-business units under the Branch as regulated by law. b) Decisions and directives promulgated by the provincial People's Committee in the health sector; c) Programs and solutions for mobilizing and combining interdisciplinary activities in epidemic prevention and control in locality. 3. Instructing, inspecting and implementing legal documents, policies, planning, plans, schemes, programs and other issues on health after being approved; informing, propagating, disseminating and educating laws on the fields under the Department's management. 4. In terms of preventive medicine a) Deciding on methods to investigate, monitor, detect and handle epidemics, making epidemic reports as provided by law. b) Guiding, inspecting, supervising and handling violations in the implementation of professional regulations and national technical regulations on prevention and control of infectious diseases; HIV AIDS; social disease; non-communicable disease; occupational diseases, injuries; environmental health, school health, hygiene and occupational health; community nutrition; border medical quarantine; insecticidal and germicidal chemicals and preparations for domestic and medical use in the province; c) Performing standing tasks in the field of HIV/AIDS prevention and control of the Steering Committee for AIDS prevention and control, drug and prostitution prevention and control in the province; directing, managing, implementing, inspecting and evaluating the performance of HIV/AIDS prevention and control activities in the province. 5. In terms of medical examination and treatment and functional rehabilitation a) Guiding, inspecting, inspecting and handling violations in the implementation of professional regulations and technical regulations applicable to facilities of medical examination and treatment, functional rehabilitation, plastic surgery, cosmetic surgery, medical examination, forensic examination or mental forensic examination under the regulations, directions from the Ministry of health under decentralization and technical delineation area; b) Granting, suspending and revoking practice certificates of medical examinations and treatment; certificates of eligibility for professional practice for private medical examination and treatment facilities as provided by law and decentralized. 6. In terms of traditional medicine a) Performing the inheritance, promotion and combination of traditional and modern medicine in disease prevention, medical examination and treatment, functional rehabilitation, personnel training, scientific research and production of traditional medicine and pharmacy in the locality; b) Guiding, inspecting, supervising and handling violations in the implementation of the law on traditional medicine and pharmacy in the province; c) Granting, suspending and revoking practice certificates, certificates of eligibility for private traditional medicine and pharmacy practice in the province as decentralized and regulated by law. 7. In terms of medicine and cosmetics a) Guiding, inspecting, supervising quality, inspecting and handling violations in the production, business and use of medicines as regulated by law; b) Granting, suspending and revoking pharmaceutical practice certificates; certificates of eligibility for medicine business; introducing medicines and cosmetics in the province as regulated by law and as decentralized. 8. In terms of food safety and hygiene a) Implementing national standards and technical regulations on food safety and hygiene; inspecting, supervising and handling law violations on food hygiene for organizations and individuals producing and trading food in the province as regulated by law. b) Certifying to announce food product standards; granting, suspending and revoking certificate of eligibility for food safety for organizations and individuals producing and trading food; receiving and appraising professional content registered for advertising products as decentralized and regulated by law. 9. In terms of medical equipment and facilities a) Guiding, supervising and evaluating the implementation of legal provisions on equipment and medical facilities; b) Inspecting, supervising and handling violations in the implementation of professional regulations, processes and regulations on medical equipment as regulated by law and as decentralized. 10. In terms of population - family planning and reproductive health a) Deploying to implement the system of norms and index in the field of population - family planning; directing and guiding national technical standards, professional processes for reproductive health care and family planning services; b) Deploying to perform, guide, inspect, supervise and evaluate the implementation of policies, programs, projects, projects and models related to the field of Population - Family Planning and Reproductive Health; c) Appraising and deciding to permit gender re-identification, give birth according to scientific methods and advisory services for facilities providing advisory service on population and family planning as regulated by law. 11. In terms of Health Insurance a) Implementing the provisions of the law on health insurance; b) Inspecting, supervising and handling law violations on health insurance. 12. In terms of training of human resources for health a) Implementing training and fostering plans for health human resources and policies for development of health human resources in the province; b) Managing training schools of medical staffs as assigned by the Provincial People's Committee. 13. Assisting the Provincial People's Committee in state management for enterprises, collective economic organizations, private economic organizations and public services in the health sector. Instructing and inspecting activities of organizations and non-governmental organizations in the health sector as regulated by law. 14. Implementing international corporation in health sector as regulated by law. 15. Being responsible for guiding professional skills on the fields under the Department's management for the District, town Health Divisions. 16. Researching and applying scientific and technical advances; building archive information system to serve the state management and professional skills in the assigned fields. 17. Inspecting, supervising, handling violations and settling complaints and denunciations in the health domain as regulated by law; preventing and fighting against corruption, practicing thrift and combating wastefulness. 18. Stipulating functions, tasks, rights, organizational structure, working relationships of organizations and non-business units under the Department; managing personnel, implementing regimes of salary and policies, remuneration, training, fostering, commendation and discipline for cadres, civil servants and officials under the Department's management as stipulated by law and decentralized by Provincial People's Committee. 19. Managing allocated finance and assets in the health network from province to district, town and health stations, regional polyclinics as stipulated by law and assigned and decentralize by the provincial People's Committee. 20. Periodically and unscheduledly informing and reporting the performance of tasks as stipulated by the provincial People's Committee and Ministry of Health. 21. Performing a number of other tasks assigned by the Provincial People's Committee and as stipulated by law. POWERS
1. The Department acts as the legal entity with its own seal and is allowed to open an account at the State Treasury. 2. Promulgating documents to guide and inspect activities in the health sector for health facilities operating in the province as stipulated by law, the Ministry of Culture, Sports and Tourism and as decentralized by the provincial People's Committee. 3. Deciding under its competence to implement regimes and policies for cadres and civil servants under its authority according to the management decentralization of provincial cadres and as regulated by the State on cadre work. 4. Promulgating internal working regulations on the basis of functions, tasks, rights and organizational structure issued by the provincial People's Committee. Standing People's Council is a standing body of the People's Council, perform the duties and powers in accordance with the Law on Local Government and other relevant laws; take responsibility and report on work to the People's Council.
TASKS AND POWERS OF THE PROVINCIAL PEOPLE'S COUNCIL 1. Tasks and powers of the Provincial People's Council in organizing and ensuring the implementation of the Constitution and laws: a) Promulgating resolutions on issues within the tasks and powers of the Provincial People's Council; b) Deciding measures to ensure social order and safety, fight against crimes and other law violations, and fight against bureaucratism and corruption within its decentralization scope; measures to protect assets of agencies and organizations, protect the lives, freedom, honor, dignity, properties, other legitimate rights and interests of citizens in the province; c) Deciding measures to perform tasks and powers decentralized by superior-level state agencies; deciding the decentralization to local authorities at district and commune levels and subordinate state agencies to perform tasks and powers of local authorities in the province; d) Abolishing one part or whole of illegal documents of the People's Committee and the Chairman of the Provincial People's Committee; abolishing one part or whole of illegal documents of the district-level People's Council; e) Dissolution of the district-level People's Council where it causes serious damages to the interests of the People and submitting this issue to the National Assembly Standing Committee for approval; Approving resolution of district-level People's Council on the dissolution of commune-level People's Council. 2. Tasks and powers of the Provincial People's Council in building the government: a) Voting, exempting and dismissing the Chairman of the People's Council, the Vice Chairman of the People's Council, the Head, the Deputy Head of the Provincial People's Council, the Chief of Office of the Provincial People's Council Office; voting, exempting and dismissing the Chairman of the People's Committee, Vice Chairman of the People's Committee and members of the Provincial People's Committee; voting, exempting and dismissing the Assessors of the Provincial People's Court; b) Taking confidence votes, holding confidence votes for incumbents elected by the Provincial People's Council in accordance with Articles 88 and 89 of this Law; c) Exempting delegates of the Provincial People's Council and accepting the resignation of delegates of the Provincial People's Council; d) Deciding to establish or remove specialized agencies of the Provincial People's Committee; e) Deciding the regular staffing in the agencies of the People's Councils, People's Committees and public non-business units of the People's Committees at all levels in the province according to the staffing criteria assigned by the Government; deciding the quantity and allowances for part-time members at commune, village and residential quarter levels and approving the total number of people working in public non-business units under the provincial management according to Government regulations; f) Deciding the establishment, dissolution, merger, division of villages and residential quarters; naming and changing the names of villages, residential quarters, roads, streets, squares, public works in localities in accordance with law. 3. Tasks and powers of the Provincial People's Council in the fields of economy, natural resources and environment: a) Deciding the provincial long-term, medium-term and annual socio-economic development plans; planning and plans on development of sectors and fields in the province within their decentralization scope; b) Deciding the state budget revenue estimates in the province; estimates of local budget revenues and expenditures and allocation of budget estimates at each level; adjusting local budget estimates in case of necessity; approving the accounts of local budget. Deciding the investment policies, project/ programs of the province in accordance with law; c) Deciding contents related to charges and fees as prescribed by law; people's contributions; deciding the borrowing of domestic capital sources through the issuance of local bonds, municipal bonds, project bonds and other forms of capital mobilization in accordance with law; d) Deciding specific guidelines and measures to encourage and mobilize various economic sectors to participate in the provision of public services in the province in accordance with law; e) Deciding other measures for socio-economic development in the province in accordance with law; f) Deciding construction planning and urban planning within its decentralization scope as prescribed by law; the regional economic linkages among the levels of local governments in line with the situation and characteristics of the localities and in consistence with the national economy; g) Deciding the planning for development of organizational system of industry, agriculture, forestry and fishery extension, networks of trade, service, tourism and transport in the province in accordance with law; h) Approving the provincial land use planning and plans before submitting them to the Government for approval; deciding measures for management and use of land, water resources, mineral resources, resources in the seas, airspace and other natural resources, and protection of the environment within its decentralization scope. 4. Tasks and powers of the provincial People's Council in the fields of education, training, science, technology, culture, information, physical training and sports: a) Deciding measures to develop the network of educational institutions and conditions to ensure education and training activities within its decentralization scope; deciding the prices of education and training services for public education and training institutions under the provincial management in accordance with law; b) Deciding measures to encourage the development of scientific research, promotion of innovations, technical improvements and application of scientific and technological advances in the province; c) Deciding measures to develop culture, information, physical training and sports; measures to protect and promote the value of local cultural heritage; measures to ensure the activities of culture, information, advertising, press, publication, physical training and sports in the province within its decentralization scope. 5. Tasks and powers of the Provincial People's Council in the fields of health, labor and implementation of social policies: a) Deciding measures to develop the system of medical examination and treatment facilities at provincial, district and commune levels; b) Deciding the prices of medical examination and treatment services for State-owned medical examination and treatment facilities under local management in accordance with law; c) Deciding measures to protect and care for people's health; protect and care for mothers, children, the elderly, the disabled, the poor, helpless orphans and other disadvantaged people. Deciding measures to prevent and control epidemics; measures to implement population and family planning policies in the province; d) Deciding measures to manage, use and develop local human resources; measures to create jobs, raise labor productivity, increase incomes and improve working conditions, ensure labor safety and hygiene; e) Deciding policies on attraction and encouragement for cadres, civil servants, public servants and employees in localities in line with local conditions and budget capacity and regulations of the superior state agency; f) Deciding measures to implement preferential policies for people with meritorious services to the revolution; measures to implement social security and welfare policies, measures to eradicate hunger and reduce poverty. 6. Tasks and powers of the Provincial People's Council on ethnic and religious affairs: a) Deciding measures to implement ethnic policies, improve the material and spiritual life, raise the intellectual standards of ethnic minorities, ensure equality among ethnic groups, and strengthen the whole-people solidarity and create mutual assistance among local ethnic groups; b) Deciding measures to implement religious policies within its decentralized scope; measures to ensure equality among religions, freedom of belief and religion in the province. 7. Tasks and powers of the Provincial People's Council in the fields of national defense and security, social order and safety: a) Deciding measures to ensure the performance of national defense and security tasks in accordance with law; maintain political security, fight against corruption, crimes and other law violations, ensure social order and safety in the province; b) Deciding policies and measures to promote local potentials to build a strong national defense and people's security, establish a solid defense area to meet the requirements of peacetime and wartime; c) Deciding policies and measures to build militia and self-defense forces, mobilization reserve units, the communes' public security; Deciding the guidelines and measures to combine economy with national defense and security, shift local socio-economic activities from peacetime to wartime; d) Deciding measures to ensure public order and traffic safety in the province. 8. Supervising the compliance with the Constitution and laws in the locality, the implementation of resolutions of the Provincial People's Council; supervising the activities of the Standing Committee of the People's Council, the People's Committee, the People's Court, the People's Procuracy of the same level, and the boards of the People's Council at its level; supervising legal documents of People's Committees of the same level and documents of district-level People's Council. 9. Performing other tasks and powers as prescribed by law. The Office of the Provincial People's Committee (hereinafter referred
to as the Office) is an agency of the Provincial People's Committee

Committee and under the direction, guidance and examination of

Organizing, managing and publishing official information on activities

direction and administration of the Provincial People's Committee and

Serving activities of the Provincial People's Committee, assisting the
Chairman of the Provincial People's Committee and Vice Chairman of the
People's Committee in performing tasks and powers within their
authority. e) Managing archives and internal governance work of the Office. TASKS AND POWERS 1. Submitting to the Provincial People's Committee for issuing: a) Working regulations of the Provincial People's Committee; b)
The document stipulating the functions, tasks, powers and
organizational structure of the Office of the Provincial People's
Committee; c) Documents specifying the
functions, tasks and powers of the Offices of the People's Councils and
the People's Committees of districts, towns and cities (hereinafter
collectively referred to as the Offices of the People's Councils -

Documents specifying conditions and standards for titles of Heads and
Deputy Heads of the units under the Office of the Provincial People's
Committee; Chief of Office, Deputy Chief of Office of the People's
Councils - People's Committees at district level. 2. Submitting to Chairman of Provincial People's Committee for issuing: a) Decisions for establishment, merger, separation and dissolution of the units under the Office; b) Other documents as assigned by the Chairman of the Provincial People's Committee. 3. Advising, developing and organizing the implementation of the work programs and plans of the Provincial People's Committee: a)
Summarizing proposals of departments, department- equivalent agencies,
agencies under the Provincial People's Committee (hereinafter referred
collectively to as departments), district-level People's Committees,
related agencies and organizations; b)
Proposing to the Chairman of the Provincial People's Committee to put
into the work program and plan the issues that should be focused to be
directed, executed or assigned to the related agencies for study,
formulation of schemes, projects and draft documents; c)
Developing and submitting to the Provincial People's Committee and the
Chairman of the Provincial People's Committee for promulgation or
approval of working programs and plans; d)
Monitoring and urging departments, district-level people's committees,
related agencies and organizations to implement the work program and
plan to ensure the progress and quality; đ)
Periodically or irregularly reporting implementation results; proposing
solutions to effectively implement the work program and plan; e)
Timely reporting and adjusting the work program and plan to meet the
requirements of management, direction and execution of the Provincial
People's Committee and the Chairman of the Provincial People's
Committee. 4. Serving the activities of the Provincial People's Committee: a)
Presiding and coordinating with related agencies to prepare programs
and contents for the meetings of the Provincial People's Committee; b) Implementing the summary and reporting regime; c)
Monitoring, urging and evaluating the results of the implementation of
the Working Regulations of the Provincial People's Committee; d) Organizing the reception of citizens, resolution of citizens' complaints and denunciations in accordance with law. 5. Advising and assisting the Chairman of the Provincial People's Committee in performing the following tasks and powers: a) Convening and presiding meetings; b)
Monitoring, urging, directing and inspecting the work for the
departments; People's Council and district-level People's Committee; c) Performing tasks before the Provincial People's Council; contacting, reporting and answering voters' petitions; d) Directing and applying necessary measures to solve the work in sudden and urgent cases; đ) Improving working practices; maintaining the disciplines of the State administrative apparatus in the locality. 6.
Receiving, processing and submitting to the Provincial People's
Committee and the Chairman of the Provincial People's Committee to
handle documents and records submitted by agencies, organizations and
individuals: a) For schemes, projects and draft documents submitted by agencies: - Checking the documents, drafting order and procedures, presentation forms and techniques of the draft documents; -
Summarizing the contents, stating the decision-making authority, the
consistence in the direction and execution of the Provincial People's
Committee, the Chairman of the Provincial People's Committee on related
issues, proposing one of the solutions: Promulgating and approving them;
submitting them to the meeting of the provincial People's Committee;
receiving comments from the members of the Provincial People's
Committee; informing the ideas of the Chairman of the Provincial
People's Committee to request the agency to complete them, collect
comments from other agencies, organizations, and individuals or perform
other responsibilities according to the regulations and working
regulations of the Provincial People's Committee; During
handling process, if the proposal, project or draft document contains
different opinions, presiding over meetings with related agencies and
organizations for discussion before submission; b)
For draft reports, speeches: Collaborating with related agencies to
edit and complete contents under the direction of the Chairman of the
Provincial People's Committee; c) For
other documents: Proposing to the Chairman of the Provincial People's
Committee to assign related agencies to implement; organize necessary
conditions for the Provincial People's Committee and Chairman of the
Provincial People's Committee to solve in accordance with law and
contents of received documents. 7.
Releasing, managing, monitoring, urging, checking the situation, results
of the implementation of documents of the Provincial People's
Committee, the Chairman of the Provincial People's Committee: a)
Managing, using seals, issuing documents of the Provincial People's
Committee and the Chairman of the Provincial People's Committee; b)
Monitoring, urging and inspecting the situation and results of the
implementation of documents of the Provincial People's Committee and the
Chairman of the Provincial People's Committee; periodically reviewing
and reporting to the Chairman of the Provincial People's Committee to
ensure uniformity in direction and execution; c)
Reviewing to find out problems related to the authority, records,
order, procedures and office skills in the process of direction and
execution of the Provincial People's Committee, Chairman of the
Provincial People's Committee; promptly reporting to the Provincial
People's Committee for amendments and supplements; annually, summarizing
and reporting to the Government Office; d) Archiving documents and records of the Provincial People's Committee and the Chairman of the Provincial People's Committee. 8. Implementation of the information regime: a)
Organizing the management and updating of information to serve the
direction and execution of the Provincial People's Committee and the
Chairman of the Provincial People's Committee; b)
Implementing the informing and reporting regime on the operation of the
web portal and connecting the electronic administrative information
system for direction and execution of the Provincial People's Committee
and the Chairman of the Provincial People's Committee; c) Publishing and issuing the Provincial Official Gazette; d) Establishing, managing and maintaining the network operation of the Provincial People's Committee. 9. Ensuring the material and technical conditions: a)

Benefit Protection: (+84-274) 3 840 067 FUNCTIONS The Department advises and assists the provincial People's Committee in performing the state management function of industry, cottage industries and handicrafts, covering sectors and fields: mechanics, metallurgy, electricity, new energy, renewable energy, chemicals, industrial explosive materials, mining and mineral processing industry, consumer industry, food industry, and other processing industry, goods circulation in the province, export, import, market management, competition management, trade promotion, monopoly control, anti-dumping, anti-subsidy to protect consumer rights, e-commerce, trade services, economic integration, management of industrial clusters and points in the province, industrial promotion activities, state management of public services under the Department's state management. TASKS 1. Advising and submitting to the Provincial People's Committee a) Planning, plans, key programs and projects on long-term, five-year and annual industrial and trade development; guidelines, policies, programs, methods and specific regulations on the development of industry and trade sector in the province in accordance with the master planning of socio-economic development of the province and the development planning of the sector; b) List of industry lines supported by the provincial industrial promotion fund in each period for all economic sectors operating in the industrial field; c) Decisions and directives promulgated by the provincial People's Committee in the field of industry and trade; d) Regulating the functions, tasks, rights and organizational structure of the Market Management Branch as stipulated by law; e) Regulating standards of titles for heads and deputy heads of units of the Department; titles of leaders in charge of industry and trade field under the Economic Division of the district People's Committee. 2. Advising and submitting to the Chairman of the provincial People's Committee: a) Decisions on establishment, merger, dissolution of Divisions and equivalent, units under the Department as stipulated by law; b) Particular decisions and directives under the promulgating authority of the Chairman of the provincial People's Committee in the field of industry and trade. 3. Guiding and inspecting the implementation of legal documents, policies, planning, plans, schemes, projects, programs and regulations on trade and industrial development after being approved; informing, propagandizing, guiding, popularizing, educating the laws on industry and trade. 4. Contributing comments on provincial programs and projects related to industrial and commercial activities; coordinating with relevant agencies to guide, support and inspect the production and business activities of enterprises in the province. 5. Assisting the provincial People's Committee: to appraise economic technical reports and basic designs of energy works, appraising documents for new issuance, reissuance and modification of licenses to use industrial explosive materials, appraising application documents for certificates of safety filling station to fill the bottles with liquefied petroleum gas. 6. Appraising and approving: plans to prevent and troubleshoot chemical incidents, basic design of mine works of Group B and C (except minerals used as construction materials and cement production), basic design of investment projects to build warehouse of industrial explosive materials. Appraising and granting the certificates of eligibility for trading in liquefied gas and gasoline; licenses to produce and trade wholesale liquor (producing liquor with investment projects and producing liquor with a capacity of under 3 million liters/year); electricity activity license. 7. Granting, amending, supplementing, extending and revoking licenses and certificates under the management responsibilities of the Department of Industry and Trade as stipulated by law, assigned or authorized by the provincial People's Committee, including: Certificates of: main machine in synchronous machinery line; machine and equipment registration with strict safety requirements specific to industry; declaration of dangerous chemicals; certificate of seal registration for commercial assessment; domestic franchise registration; tobacco business; multi-level sales organization; establishing representative offices of foreign traders in Vietnam. 8. In terms of industry and cottage industries and handicrafts: a) Management of clusters, points of industry and cottage industries and handicrafts: Acting as a focal point to assist the provincial People's Committee in building and implementing the planning of clusters, points of industry and cottage industries and handicrafts; monitoring and supervising construction process, implementing incentive mechanisms and policies, attracting investment, importing and exporting, taxes, finance, labor and constructing technical infrastructure, ground clearance, relocating production facilities, building new industrial clusters, points of industry and cottage industries and handicrafts in the province after being approved. b) Mechanics and metallurgy: Implementing planning, plans and policies on development of mechanics, metallurgy, development of key mechanical and mechatronics products, products with high technology content, combining techniques of mechanics, automation, and industrial electronics in the province. c) Consumer industry, food industry and other processing industries: - Implementing the planning, plans and policies to develop the sector after being approved, including: textile - garment, leather - shoes, paper, crockery, glass, plastic, beer, wine, beverage, tobacco, confectionery, milk, vegetable oil, processing flour and starch; - Guiding to inspect the implementation of industrial product quality standards and regulations, hygiene and safety, industrial environment and food hygiene and safety from the production stage to the circulation under the management of the Department of Industry and Trade. d) Mining and mineral processing industries (except minerals used as construction materials and cement production): - Presiding to implement the planning of mineral exploration, mining and processing in the province after being approved by competent authorities; - Implementing planning, plans and policies for developing mining and mineral processing sector in the province; inspecting the implementation of environmental protection methods, safety regulations in mining and mineral processing in the province. d) Chemicals, industrial explosive materials, machines and equipment with strict requirements on safety techniques specific to industry: - Implementing planning, plans and policies for developing chemical sector, industrial explosive materials, types of machinery and equipment with strict requirements on safety techniques in the province; - Presiding, combining with relevant provincial agencies in inspecting and handling law violations on management, use, storage and transport of chemicals, industrial explosive materials, liquefied gas and types of machinery and equipment with strict requirements on safety techniques as provided by law; e) Agricultural extension: - Presiding, combining with relevant agencies to implement programs, schemes, mechanisms, policies and plans for development of small and medium-sized industrial enterprises and collective economic organizations in the province (including sectors, rural craft villages, cooperatives in the field of industry and trade); - Implementing programs, plans and projects of agricultural extension in the locality, including activities carried out by the national agricultural extension fund and activities implemented by the local industrial promotion fund; - Training, fostering to raise the capacity to implement activities of agricultural extension for cadres in charge of agricultural extension in localities. g) Electricity and energy: - Drafting investment plan for power projects as decentralized for Department of Planning and Investment to consider and submit to the provincial People's Committee for approval; - Implementing planning and plans to develop electricity, develop the application of new and renewable energies in the province; - Training legal knowledge on electricity activities and use for electricity units; train and foster professional knowledge and skills, electrical safety for cadres and technical workers of rural electricity management organizations; - Implementing electricity price option in the province after being approved by competent authorities; - Combining with competent state agencies to conduct specialized inspection and supervision of electricity as provided by law. 9. In terms of Trade: a) Domestic trade - Implementing planning, plans, mechanisms and policies on development of wholesale and retail trade infrastructure networks, including: types of markets, trade centers, systems of supermarkets, systems of shops and trade cooperatives; system of commercial agents, franchises and other types of commercial infrastructure; - Presiding and combining with related agencies in guiding and implementing mechanisms and policies to encourage the expansion of business networks, development of organizations linking goods circulation, forming stable commodity circulation channels from production to consumption in the province; - Implementing incentive mechanisms and policies to encourage and support production, business and life for people in ethnic-minority regions, deep-lying, remote areas in the province (such as providing essential commodities, supporting the circulation of goods and commercial services, etc.) - Summarizing and handling market information in the province about total circulation of goods, total supply, total demand, circulation reserve and price fluctuation of essential commodities and policy items for people in ethnic-minority regions, deep-lying, remote areas. Proposing solutions to regulate goods circulation in each period to competent authorities. b) For import and export - Implementing policies, plans, programs, and schemes to develop and promote the export of goods; developing goods export and import services in the province; - Managing import and export activities of domestic and foreign-invested enterprises, foreign traders without representatives in Vietnam in the province. c) E-commerce - Presiding and combining with relevant agencies in building an e-commerce application infrastructure in the province; - Implementing policies, plans, and programs on fostering and developing human resources for e-commerce management in the area. d) Competition, antimonopoly, antidumping and anti-subsidy, protecting rights of consumers - Guiding and implementing the provisions of the law on competition, antimonopoly and antidumping; anti-subsidy, protecting rights of consumers and ensuring a healthy competitive environment in the province. Proposing to the relevant agencies to amend and supplement the regulations, the issued documents that are not consistent with the competition law. - Requesting relevant organizations and individuals in the province to provide necessary information and documents for the performance of assigned tasks in accordance with the law on competition, antimonopoly, antidumping and anti-subsidy, protecting rights of consumers; - Collecting, building databases, managing and providing information on enterprises with dominant positions in the market, exclusive enterprises with headquarters in the province; on the competition rules in the association; on exemption cases. e) Trade promotion - Implementing, inspecting and supervising the registration of organization of fairs, trade exhibitions and promotions for traders. - Implementing programs, plans and projects on trade promotion in order to strengthen exports, support enterprises in the province to build and develop Vietnamese brands. f) Economic integration - Implementing plans, programs, specific methods on economic integration, international trade in the province after being approved. - Presiding, combining with relevant agencies to popularize, propagandize and guide the implementation of local plans, programs and regulations on economic integration and international trade. g) Market management - Implementing market management activities in the province as regulated by the Government, guided by the Ministry of Industry and Trade and competent state management agencies; - Guiding, inspecting the implementation of the law in the industry and trade field of organizations and individuals trading in the province; implementing specialized inspection as stipulated by law; - Presiding, combining with relevant agencies to fight against smuggling, trading smuggled goods, banned goods, against manufacturing and trading fake goods, poor quality goods, goods that violate intellectual property regulations; to fight against speculative acts, market disruption, trade frauds of business organizations and individuals in the province. 10. Assisting the Provincial People's Committee in state management for enterprises, collective economic organizations, the private economic organizations, guiding and inspecting activities of associations and non-governmental organizations in the industry and trade sector in the locality as regulated by law. 11. Guiding and inspecting: the implementation of the mechanism of autonomy and self-responsibility of public non-business units under the Department of Industry and Trade as regulated by law. 12. Implementing international cooperation in the field of industry and trade as provided by law and decentralized by the provincial People's Committee. 13. Directing the professional knowledge in the field of industry and trade for the Economic Division of the district People's Committees. 14. Implementing the plan of research and application of scientific and technological advances in industry and trade under the Department's management scope, guiding to perform standards, regulations, economic-technical norms and quality of industrial products; building information storage systems, providing documents on industry and trade as regulated by law. 15. Deploying to perform administrative reform program of the Department under the goals and contents of the administrative reform program of the Provincial People's Committee. 16. Inspecting, supervising, handling violations, settling complaints and denunciations; preventing and fight against corruption and negative actions; practicing thrift and combating wastefulness in the industry and trade sector as provided by law or assigned and decentralized by the provincial People's Committee. 17. Performing public services in the industry and trade sector under the Department's management as regulated by law. 18. Stipulating the functions, tasks, rights, organizational structure and working relationships of organizations and non-business units under the Department; managing personnel, implementing salary and policy regimes, remuneration, training, fostering, commendation and discipline for cadres, civil servants and officials under the Department's management as regulated by law and decentralized by the provincial People's Committee. 19. Managing allocated finance and assets and performing allocated budget as regulated by law and decentralized by the provincial People's Committee. 20. Periodically and unscheduledly informing and reporting the performance of programs, plans and projects to develop the industry and trade sector in the locality as regulated by law and the provincial People's Committee and the Ministry of Industry and Trade. 21. Performing other tasks assigned by the Provincial People's Committee and as stipulated by law. POWERS 1. The Department acts as the legal entity with its own seal to transact and is allowed to open an account at the State Treasury. 2. Promulgating instruction documents to implement undertakings, policies and regulations of the Government, the Ministry of Industry and Trade, and the provincial People's Committees and inspecting activities in the field of industry and trade with individuals, organizations of all economic sectors in the province. 3. Requesting individuals and organizations operating in the industry and trade sector to provide information, make periodic and unscheduled reports as regulated by law. 4. Proposing or making decisions according to its competence regimes and policies for the Department's cadres and civil servants according to the State regulations and the provincial decentralization of cadre management. TASKS 1. Advising and submitting to the Provincial People's Committee a) the drafts of long-term, five-year and annual development planning and plans, information and communication programs, schemes and projects; programs and measures to organize the implementation of state administrative reform, management decentralization and socialization in fields assigned within the state management scope; b) the drafts of decisions and directives under the promulgation authority of the Provincial People's Committee in the fields of information and communication; c) the drafts of regulations on title criteria for the heads and deputy heads of organizations under the Department; The Head and Deputy Head of the Department of Culture and Information of the District People's Committee, after coordinating and reaching agreement with the Department of Culture, Sports and Tourism. 2. Advising and submitting to the Chairman of the Provincial People's Committee a) the drafts of decisions and directives under the promulgation authority of the Chairman of the Provincial People's Committee in the fields of information and communication. b) the drafts of decisions on establishment, merger, dissolution of units under the Department in accordance with law. 3. Guiding, inspecting and organizing the implementation of legal documents, planning, development plans, programs, schemes, projects, national standards and economic-technical norms about approved information and communications; organizing the propagation, dissemination and education of laws in the fields under the Department's management. 4. In terms of press (including printed newspaper, audio, video and electronic newspapers on the Internet): a) Guiding and organizing the implementation of legal provisions on press activities in the province; b) Organizing the examination of deposited press and the management of deposited press in the province; c) Issuing and revoking the newsletter licenses to agencies and organizations in the province; d) Replying to the requests for press conferences to local agencies and organizations; e) Receiving and appraising dossiers and requesting the competent authorities to grant press cards, license press activities, permits for publishing newspaper publications and other information publications in accordance with law for press agencies and other local agencies and organizations; f) Considering about allowing other local press agencies to set up representative offices, liaison offices and permanent agencies in the respective localities; g) Organizing the implementation of plans for development of local radio and television broadcasting after obtaining approval; h) Managing the use of equipment that receives radio and television signals directly from satellites for units, organizations and individuals in the respective localities in accordance with law. 5. In terms of publication a) Appraising the application for setting up the publishing house of organizations and agencies of the province in order to ask the Provincial People's Committee to request the Ministry of Information and Communications to grant the license for establishing the publishing house in accordance with law; b) Issuing and revoking licenses for publishing non-business documents to local agencies and organizations, branches, representative offices, and units under the central agencies in the province; issuing and revoking the permits for import of publications for non-business purposes to local agencies, organizations and individuals; issuing and revoking the permits for printing publication and licenses for processing publications for foreign countries, for publication-printing establishments in the province under the publishing law; c) Issuing and revoking the permits for publication exhibition and fair; temporarily suspending the organization of exhibitions and fairs of agencies, organizations and individuals licensed by the localities; d) Managing the depository of publications and organizing the reading of deposited publications licensed by the localities; inspecting and handling legal violations of deposited publications under its authority; e) Examining and inspecting the observance of the legislation on publication; settling complaints, denunciations and handling violations in publishing activities in the locality under its authority; f) Temporarily suspending the printing of publications or suspending the printing of publications in the locality in when detecting that the contents of the publication violate the Publishing Law and reporting to the Minister of Information and Communications, Chairman of the Provincial People's Committee; temporarily suspending the distribution of publications with contents violating the Publishing Law of local publishing establishments; g) Destroying publications that violate the law according to the decisions of the competent authorities. 6. In terms of advertising on newspapers, internet and publications: a) Guiding the implementation of advertisements in newspapers, internet and publications in localities according to the authority; b) Examining, inspecting and handling violations of agencies, organizations and individuals participating in advertising activities in newspapers, internet and publications in their localities under its authority. 7. In terms of postal and delivery a) Guiding, inspecting and organizing the implementation of safety and security assurance in postal and delivery activities in the province in accordance with law; b) Coordinating with relevant agencies to inspect the implementation of regulations on application of standards, service quality, safety, information security in postal and delivery in the province c) Confirming the notification of service business and delivery activities in writing to the delivery service provider within the province; d) Issuing, amending, supplementing and revoking licenses for mail delivery services under its authority; e) Coordinating to implement the state management over postage stamps in the province. 8. In terms of telecommunications, internet a) Guiding, inspecting and directing telecommunications and Internet enterprises in implementing information safety and security in the province in accordance with law; b) Cooperating with relevant agencies in examining and inspecting the implementation of regulations on rates, standards and quality in the field of telecommunications and Internet in the province and in accordance with law; c) Presiding to examine, inspect and handle violations of enterprises, telecommunication and internet service providers and users in the province in accordance with law and under the authorization of Ministry of Information and Communications; d) Supporting telecommunications businesses in the province to complete basic construction procedures to build telecommunications works under the licenses granted by the Ministry of Information and Communications in accordance with the local development planning and the provisions of law; e) Coordinating with functional units of the Ministry of Information and Communications to participate in a number of stages in the licensing process, resolve disputes on connection and common use of infrastructure; f) Directing the Department of Culture and Information to examine, inspect activities and handle violations of telecommunications and Internet service agents and users in the province in accordance with law. 9. In terms of transmission and radio frequency a) Guiding and inspecting the implementation of the planning on frequency channel distribution for radio and television in the province; regulations on conditions and techniques for the exploitation of radio devices under conditional use; b) Implementing annual inspection and examination of organizations and individuals that use radio frequencies and equipment of exclusive radio communication, radio and television networks under limited operating scope in the province; coordinating with regional radio frequency organizations to examine and inspect based on plans and irregular basis with other networks and stations; c) under its authority, applying sanctions to administrative violations against organizations and individuals violating the regulations on the use of radio transmitters and frequencies in the province. 10. In terms of information technology and electronics a) Organizing the implementation of programs, schemes, plans on application and development of information technology; mechanisms and policies for development of industries of hardware, software, electronics, digital contents and information technology services; on construction and management of centralized information technology parks; on the list and regulation of national database exploitation, regulations on management in investment, application and development of information technology in the city after obtaining approval; b) Organizing the implementation, making periodical reports, review of the implementation of plans on information technology application in operations of state agencies in the province; c) Formulating regulations on the local information technology application; d) Developing a plan for training, fostering and developing information technology human resources in the province and organizing the implementation after obtaining approval; e) Organizing and guiding the implementation of regulations on the information technology safety under its authority; f) Organizing, guiding the implementation of information technology application projects for collection, storage and processing digital information to serve the provincial leaders' direction and administration; g) Developing regulations on management and operation to ensure information technology and safety; guiding the use of information infrastructure to serve the direction, administration and operation of the Provincial People's Committee; h) Developing or maintaining, upgrading, ensuring technical and information safety for the operation of the website (website, portal) of the Provincial People's Committee; guiding units in the province to unify the connection and provision of information contents and public administration services in the province according to the assignment of the Provincial People's Committee; i) Surveying, investigating and making statistics on the application and development of information technology industry; creating a database of products and local businesses for making periodic reports as prescribed; j) Performing tasks of the unit specializing in information technology in the province. 11. In terms of copyright and intellectual property a) Organizing the implementation of the provisions of the law on the copyright on the press and publishing products; the copyright on information technology products and services; intellectual property rights of inventions and discoveries in the field of information and communication in the province; b) Implementing legal protection measures in the field of copyright and intellectual property in the province in accordance with law; c) Providing professional guidance on the protection of legal rights in the field of copyright and intellectual property for sectors, localities, enterprises, social organizations and citizens for products and services in accordance with the law. 12. Assisting the Provincial People's Committee in State management over enterprises, collective and private economic organizations; guiding and inspecting the activities of associations and non-governmental organizations in the fields of information and communication in the province in accordance with law. 13. Guiding and inspecting the implementation of the autonomy and self-responsibility mechanism of public non-business units under the Department of Information and Communications in accordance with law. 14. Providing professional guidance on the fields of information and communication for the Department of Culture and Information of the district-level People's Committee. 15. Performing the task of state management over public services in the fields of information and communication: a) Management of public service For public services under the deciding authority of the Central Government, the Department shall coordinate to guide enterprises and related units to formulate the plans and projects of service provision, supervise and inspect the implementation and report on the results of implementation in the province under the guidance of the Ministry of Information and Communications.
For public services under the deciding authority of the province: The Department shall preside and coordinate with relevant branches to promulgate and submit to the Provincial People's Committees for approval of the plans and projects of service provision and organize to implement and manage the implementation of plans and projects in accordance with law; b) Implementing the state management over other public services as prescribed by law. 16. Performing the task of state management over investment projects specializing in information and communication in the province in accordance with law in terms of investment, construction and according to the assignment and decentralization of the Provincial People's Committee. 18. Performing the formulation and coordination in formulating economic-technical norms in information and communication according to the guidance of the Ministry of Information and Communications. 19. Organizing the study and application of scientific and technological advances, building an information system to serve the state management and professional skills in the fields of information and communication; guiding the implementation of the State's regulations on the application of technical standards and announcement of product and service quality over enterprises in the field of information and communication in the province. 20. Implementing the administrative reform program of the Department according to the objectives and administrative reform program of the Provincial People's Committee. 21. Making the regular and irregular reports on the performance of assigned tasks according to the regulations of the Provincial People's Committee and the Ministry of Information and Communications; participating in conducting surveys, statistics and providing information on events and information and communication activities under the guidance of the Ministry of Information and Communications. 22. Managing and organizing the implementation of international cooperation in the fields of information and communication assigned by the Provincial People's Committee, at the request of the Ministry of Information and Communications and in accordance with law. 23. Managing the assigned finance and properties and organizing the implementation of the allocated budget in accordance with law and the decentralization of the Provincial People's Committee. 26. Performing other tasks assigned by the Provincial People's Committee and in accordance with the law. POWERS 1. Inspection FUNCTIONS The Department acts as a professional agency which counsels and supports the Provincial People's Committee in State management of planning and investment including the fields: general consultation on socio-economic development planning and plans; organizing implementation, making recommendations and proposals on socio-economic management mechanisms and policies in the province; making domestic and foreign investment in localities; management of official development assistance (ODA), bidding, business registration within the locality; consultation on public services under the Department's management in accordance with law; performing a number of tasks and powers as authorized by the Provincial People's Committee and as prescribed by law.
TASKS
1. Submitting to the provincial People's Committee for promulgation of decisions and directives on the management of planning, plans and investment fields under its management in accordance with law, decentralization of the Ministry of Planning and Investment and taking responsibility for the contents of the submitted documents. 2. Submitting to the Provincial People's Committee for decision on the assignment and decentralization of management in the fields of planning and investment to the district-level People's Committees and Provincial departments, committees and branches in accordance with law; taking responsibility for guiding and inspecting the organization of implementation of such decentralization regulations. 3. Organizing, guiding, inspecting and taking responsibility for organizing the implementation of legal documents on planning and investment in the locality; including national socio-economic development strategies, planning and plans in the province and issues related to the formulation and implementation of planning, plans and use of resources for socio-economic development of the province. 4. In terms of planning and plans 4.1 Presiding for consolidating and submitting to the Provincial People's Committees the overall planning, long-term plans, 5-year and annual plans, and arranging the plans of investment capital belonging to the local budget; key socio-economic balances of the province; including accumulation and consumption balance, development investment capital balance and financial balance. Announcing and taking responsibility for organizing the implementation of master plan on the provincial socio-economic development after obtaining approval according to regulations. 4.2 Submitting to the Provincial People's Committee the program and activities for implementation of the socio-economic development plan according to the Resolution of the Provincial People's Council and taking responsibility for monitoring and synthetizing the implementation of the monthly, quarterly and yearly plans to report to the Provincial People's Committee for adjustment and coordination of the implementation of major socio-economic balances of the province. 4.3 Taking responsibilities for management and administration of a number of fields related to the implementation of the plan assigned by the Provincial People's Committee; 4.4 Guiding the departments, committees and branches and the People's Committees at the districts and towns in developing the planning and plans in line with the approved general planning and plans of the provincial socio-economic development; 4.5 Appraising the planning and plans of the departments, committees and branches and the planning and plans of the People's Committees in the districts and towns, and the planning and plans of the People's Committees of districts and towns in line with the provincial socio-economic development master plan and submitting them to the Chairman of the Provincial People's Committee for approval; 4.6 Coordinating with Department of Finance to prepare the provincial budget estimates and allocate budgets to units in the province and submit them to the Provincial People's Committee; 5. In terms of domestic and foreign investment 5.1 Submitting and taking responsibility for the contents of the documents submitted to the Provincial People's Committee on the list of domestic investment projects and projects attracting foreign investment for each planning period and adjustments in the necessary case; 5.2 Submitting and taking responsibility for the contents of the documents submitted to the Provincial People's Committee on the total investment capital of the whole province; on the arrangement of investment capital structure by branches, arrangement of the list of investment projects and the level of capital for each project under the local state management budget; total annual State credit support, share and venture capitals of the State; synthesizing the plans for allocation of investment capital and non-business capital of national target programs and other project programs managed by the province; 5.3 Presiding and coordinating with the Department of Finance and related departments, committees and branches in supervising, examining and evaluating the investment efficiency of basic construction projects, national target programs, and other project programs managed by the province; 5.4 Appraising investment projects under the decision-making authority of the Chairman of the Provincial People's Committee; submitting them to the Provincial People's Committee for granting the licenses of investment preference for investment projects in the province according to the decentralization; 5.5 Acting as a focal point to assist the Provincial People's Committee in managing domestic investment and foreign direct investment in the province in accordance with law; organizing the investment promotion activities, guiding investment procedures and submitting to grant investment licenses within its authority; 6. In terms of management of ODA and non-governmental aids 6.1 Acting as a focal point to apply, attract and coordinate the management of ODA and non-governmental aids of the province; guiding the departments, committees and branches to develop the list and contents of ODA and non-governmental aid programs; synthesizing the list of ODA-funded projects and non-governmental aids and submitting them to the Provincial People's Committee for approval and reporting to the Ministry of Planning and Investment; 6.2 Presiding, monitoring and evaluating the implementation of ODA projects and non-governmental aids; acting as a focal point to handle under its authority or proposing the Chairman of the Provincial People's Committee to solve problems between the Department of Finance and the Department of Planning and Investment in allocating counterpart funds to implement the projects of ODA and non-governmental aids related to many departments, committees and branches at district and commune levels; periodically synthesizing the reports on the situation and efficacy of attraction and utility of ODA and non-governmental aids. 7. In terms of bidding management 7.1 Presiding, assessing and taking responsibility for the contents of the documents submitted to the Chairman of the Provincial People's Committee on bidding plans, bid evaluation results, bidding documents for the projects or packages under its decision-making authority of the President of the Provincial People's Committee; 7.2 Guiding, monitoring, supervising, inspecting and examining the implementation of the provisions of the bidding law and synthesizing the implementation situation of the approved projects and the situation of bidding implementation. 8. In terms of management of industrial parks and export processing zones 8.1 Presiding and coordinating with relevant departments, committees and branches in appraising and submitting to the Provincial People's Committee a master plan of industrial parks and export processing zones in the locality so that the Provincial People's Committee shall submit it to the Government and Prime Minister; 8.2 Coordinating with relevant departments, committees and branches to submit to the Provincial People's Committee the planning for development of industrial clusters and management mechanisms for industrial clusters in line with the actual development situation of the locality. 9. In terms of enterprises, business registration and cooperative economy 9.1. Coordinating with relevant departments, committees and branches in submitting to the provincial People's Committees the programs and plans on arrangement and renovation of state-owned enterprises under its management; management mechanism and assistance policies for the arrangement of state-owned enterprises and development of small and medium-sized enterprises of all economic sectors in the province; 9.2. Organizing the business registration for subjects in the province under the authority of the Department; guiding the professional business registration to the specialized agencies which manage the planning and investment at the district level; coordinating with the branches in examining, monitoring, synthesizing the situation and under its authority, handling violations after business registration of local enterprises; collection, storage and management of information on business registration in accordance with law; 9.3. Coordinating with departments, committees and branches to propose models, mechanisms and policies for cooperative economic development. Household economy; guiding, monitoring, synthesizing and reporting to the Provincial People's Committee and the Ministry of Planning and Investment on the situation of cooperative economic development, household economy in the province. 10. Directing and providing professional guidance to the specialized agencies of the People's Committees at the districts and towns and performing the task of State management in planning and investment in the province; monitoring and inspecting the organization of implementation. 11. Organizing and directing the implementation of the study on application of scientific and technological advances; implementing international cooperation in the field of planning and investment in accordance with law; organizing the management and direction of activities for public non-business organizations (if any) under the Department 12. Inspecting, examining and handling under its authority violations in the implementation of policies and laws on planning and investment within the scope of its State management; solving complaints and denunciations in accordance with law. 13. Making periodical and irregular reviews and reports on the implementation of assigned tasks according to regulations to the Provincial People's Committee and the Ministry of Planning and Investment. 14. Managing the organizational structure, staffing, officials, civil servants and public employees in accordance with law and the decentralization of the Provincial People's Committees; organizing the training and fostering in professional skills for government officials, civil servants and public employees under the Department's management and developing human resource of the planning and investment sector in the province. 15. Managing the assigned finance and properties and implementing the allocated budget in accordance with law and the decentralization of the Provincial People's Committee. 16. : khtc@sgdbinhduong.edu.vn FUNCTIONS Department of Education and Training acts as an professional agency which counsels and supports the provincial people's committee to perform State management of education and training, including: targets, programs, contents of education and training, standards of teachers and standards of educational heads; standards of material facilities, equipment in schools and children's toys; examination rules and degree and certificate issuance; public services under the Department's state management in accordance with the law.
TASKS 1. Counseling the Provincial People's Committee 1.1 Drafting the decisions, directives and other documents under the competent issuance of the Provincial People's Committee on education and training. 1.2 Drafting the five-year and annual plannings, plans, programs and projects on education and training, methods to organize and perform the State administrative reform tasks concerning with education and training sector within jurisdiction of the provincial for educational development. 1.3 Drafting specific tuition rate fees for the educational establishments within management of the locality so that they are submitted to the provincial people's council by the provincial people's committee for decision as stipulated by the law. 1.4 Drafting regulations of title standards for heads, vice heads of units under management of Department of Education and Training, Education and Training Division under management of the district-level people's committee. 2. Counseling Chairman of the provincial People's Committee. 2.1 Drafting decisions of establishment, merging, separation, dissolution, changing types of educational units, dissolution of public educational institutions under the Department; establishment under license, suspension and dissolution of non-public educational establishments under the Department's management according to the provisions of law. 2.2 Drafting regulations on work relation between Department of Education and Training and the relevant departments and the district-level people's committee; 2.3 Drafting decisions on recognition of preschools and high schools meeting the national standards according to the regulations on national standard schools promulgated by the Ministry of Education and Training. 2.4 Other specific decisions and directives under the competent issuance of the Chairman of the provincial People's Committee. 3. Counseling and organizing to implement the legal documents, policies, plannings, plans, schemes, programs and other contents on education and training after approval; organizing to inform, propagate and disseminate legal education on education and training under the Department's management. 4. Providing professional guidance for units under the Department of Education and Training on implementing the objectives, programs, contents, plans and other educational and training activities as prescribed of the law and the Ministry of Education and Training. 5. Managing the enrollment, examination, approval, granting of diplomas and certificates based on the regulations of the Ministry of Education and Training; guiding, inspecting and inspecting the quality management of education and training for local education and training establishments. 6. Guiding and organizing to implement the education universalization in the province under the guidance of the Ministry of Education and Training and the provisions of law. 7. Counseling, checking, inspecting and organizing to perform emulation and commendation for educational and training establishments in the locality; building and replicating the advanced examples of education and training in the province. 10. Counseling and organizing to implement the mechanisms and policies on educational socialization; mobilizing, managing and using the resources to develop the education in the area. 11. Assisting the Provincial People's Committee in performing the state management of businesses, collective and private economic organizations related to the local education sector; counseling and inspecting the activities of non-governmental organizations and associations on education in localities according to the provisions of law. 12. Performing the function of State management on education and training for colleges, professional secondary schools, public and non-public foreign language - informatics centers in the locality. 13. Presiding, combining with the relevant agencies in appraising conditions and criteria for submission to competent authorities for grant and revocation of establishment and operation licenses for educational institutions involving investment of foreign organizations and individuals; counseling, checking and inspecting the operation of these educational institutions according to the provisions of law. 14. Granting and revoking the operation registration of service organizations that are in charge of backpacking tourism abroad at the general, intermediate, college and university levels under the Department's state management; inspecting its activities in accordance with the regulations of the Ministry of Education and Training and the law; collecting and summing up the statistics of people who go to study and research abroad under the state management scope of the Department in the province, reporting to the competent agencies as prescribed. 15. Performing international cooperation tasks on education and training as decentralized by the provincial People's Committee and the provisions of law. 16. Counseling, checking and inspecting the implementation of the mechanism of autonomy and self-responsibility in terms of tasks, organization, personnel and finance of the non-business education and training units under the Department according to the assigned management of the provincial People's Committee and the law. 17. Developing and summarizing the annual staffing plans for education and training of the locality; allocating public education payroll targets to the units under the Department after they are approved by competent authorities; counseling, checking, inspecting and organizing the recruitment of annual education service officers in area of the province according to the provisions of law. 18. Presiding, combining with Department of Finance, Department of Planning and Investment in building and making annual estimates of educational budget including: budget for recurrent expenditure, budget for capital construction, budget for purchasing school equipment, children's toys, national target program submitting to competent authorities for approval; allocating and balancing estimates of budget expenditures assigned to education; counseling and inspecting the implementation. 19. Checking, inspecting and handling violations according to their competence in implementing the policies, laws, plannings, plans, programs, schemes and regulations of competent authorities on education and training; solving complaints, denunciations and recommendations of citizens related to education under the jurisdiction of the Department; practicing thrift, fighting against corruption and waste in accordance with the decentralization of the provincial People's Committee and the provisions of law. 20. In cases of necessity to help education and training development in localities, Director of the Department of Education and Training may decide to mobilize officials and teachers of the branch after being accepted by competent authorities. 21. Managing assigned finance, assets, facilities and organizing to implement the allocated budget according to the decentralization of the provincial People's Committee and the provisions of law. 22Regular and irregular reports on performing the tasks assigned to the Provincial People's Committee and the Ministry of Education and Training. 23. Performing other duties assigned by the Provincial People's Committee or as prescribed by law.

Submitting the Provincial People's Committee a) Drafting the decisions, directives and other documents under the authority of the provincial People's Committee in the field of transportation; b) Drafting the long-term, 5-year and annual plannings, plans, programs and projects on transportation; measures to organize the implementation of administrative reform on transportation within the scope of governmental management of the Department; c) Investment projects on transportation under the decision-making authority of the provincial People's Committee; d) Drafting the legal normative documents defining title criteria for head and vice heads of branches of Department of Transport; joining with the relevant agencies in drafting regulations on criteria for professional head and vice heads with government management functions on transport and communications under the district-level People's Committees. 2. Submitting the Chairman of the provincial People's Committee a) Drafting the documents under the competent issuance of the Chairman of the provincial People's Committee on transportation; b) Drafting the decision on establishment, merger, dissolution, reorganization of units under the Department; coordinating with the Department of Home Affairs in submitting to the Chairman of the provincial People's Committee a draft decision on ranking of public non-business units and services managed by Department of Transport following the guidance of Ministry of Transport and Ministry of Internal Affairs. 3. Implementing the legal documents, plannings, plans, programs, schemes, projects, standards, technical regulations and techno-economic norms in the field of transportation that are issues by competent state agencies for promulgation or approval; Information, propagation, dissemination and legal education on transportation in the province. 4. Traffic infrastructure a) Organizing to perform duties, rights of the agencies, which make investment decisions, investors of traffic infrastructure constructing projects as assigned and arranged by the Provincial People's Committee; b) Organizing to manage, maintain, ensure technical standards of network of road traffic works, inland waterway traffic works under exploitation, managed by the province or authorized by the province; c) Performing methods to security traffic safety corridors and traffic works in the area as stipulated by the law, guided by Ministry of Transportation and State management agencies in the professional sectors; d) Counseling, supporting the Provincial People's Committee in classification, adjustment of system of the provincial roads, other roads as stipulated by the law and arranged by the Provincial people's committee; e) Within jurisdiction, publicizing closing and opening the local inland waterway route and closing, opening ports, inland wharfs on the inland waterway route, specialized route connected with the inland waterway route as stipulated by the law; organizing to issue operational licences for cross-river wharfs; f) Establishing and managing system of road signs, system of local inland waterway signs within range of management; g) Giving ideas to projects of work construction on the local inland waterways and the specialized waterways connected with the local inland waterways as stipulated; issuing construction licenses for road routes under exploitation managed by the province or authorized to manage by the central agencies; h) Organizing to implement the state management duties and rights at coach stations, car park areas, stop stations and ports, wharfs on road routes, inland waterways managed by the province. 5. For vehicles, loading and unloading equipment, vehicles used in transportation and professional transport equipment: a) Organizing to perform the registration for inland waterway transport; registering to issue license numbers for special motorbikes of organizations and individuals in the locality as stipulated by the law and arranged by Ministry of Transportation; b) Organizing to implement inspection of technical safety quality and environmental protection for road vehicles, inland waterway transport as stipulated by the law and arranged by Ministry of Transportation; c) Assessing the technical designs in repair, modification of means of transport, loading and unloading means, special means used in road transport, inland waterway transport as stipulated by the law and arranged by Ministry of Transportation; 6. Training and testing for driving licenses Organizing trainings, testing, issuance, change, revocation for licenses, degrees, certificates of competency, certificates for attending law class for operators of vehicles, special means and equipment in transportation; issuing certificates for driving instructors (practice) of driving training units in the province; issuing or proposing to issue, revoke licenses and manage driving training for driving training units in the area as stipulated by the law and arranged by Ministry of Transport; issuing certificates for trading design services for road vehicle and inland waterway transport to individuals in the locality. 7. Transportation: a) Presiding or coordinating with the relevant agencies to deploy policies of public passenger transporting development as stipulated by the Provincial People's Committee; b) Organizing to implementing the management for passenger transport using cars on the fixed route, according to contracts, tourist transport and public passenger transport using buses as stipulated by the law; licensing international transport, licensing special circulation for road vehicles as stipulated by the law and arranged by Ministry of Transportation; c) Guiding, inspecting construction of coach stations in the area in accordance with the approved plan; managing passenger transport routes; organizing, managing passenger transport service in the area; d) Promulgating operations, monitoring fast train test and announcing, registering routes of passenger transport on local inland waterway. 8. Traffic safety a) Presiding or coordinating with the relevant agencies to perform road, railway, inland waterway, maritime and aviation search, rescue occurred in the area as stipulated by the law and arranged by the provincial people's committee; combining to handle traffic accidents in the area as required; b) Organizing to perform methods of accident prevention and minimization, stopping and handling violations to traffic works, encroachment on traffic safety corridor; c) Acting as the standing body of the provincial traffic safety committee; d) Assessing traffic safety on the provincial road routes; connection points between the district-level roads, commune- level roads, and provincial roads; connections of production and trading facilities along two sides of the provincial roads. 9. Organizing to perform the legal regulations on environmental protection in transportation within State management of the Department as stipulated by the law. 10. Supporting the Provincial People's Committee to perform State management for businesses, collective economic organizations, private economic organization; guiding, inspecting operations for associations and non-government organizations in transportation sector in the province as stipulated by the law 11. Performing the professional instructions of transportation for technical agencies under management of district-level people's committee. 12. Guiding, inspecting performance for the mechanism of autonomy and self-responsibility in public service delivery units under management the Department as assigned by the Provincial People's Committee and stipulated by the law. 13. Performing the international cooperation in transportation as stipulated by the law and assigned or authorized by Provincial People's Committee; presiding or attending assessment, evaluation and organization, performance for researches, projects of advanced technology application related to transportation in the province. 14. Inspecting, checking and handling violations to the law of road, inland waterway transportation and protection for traffic works, ensuring traffic safety and order in area of the province; solving complaints, petitions, preventing and fighting against corruptions as stipulated by the law or assigned by the Provincial People's Committee. 15. Stipulating functions, duties and rights of Office, Inspection, professional divisions, and public service delivery units belonging to the Department, except non-business units that are fully responsible for operation fee; managing personnel, deploying salary regulations and policies, treatment regulations, training, improvement, commendation and award, discipline for officers, civil servants, officials belonging to State management of the Department as stipulated by the law and assigned by the provincial people's committee. 16. Managing the allocated finance, assets as stipulated by the law and assigned by the provincial people's committee. 17. Periodically and unscheduledly informing and reporting performance of the assigned tasks as stipulated by the provincial people's committee, Ministry of Transportation, and the National Traffic Safety Committee. 18. Performing other duties as assigned by the Provincial People's Committee or stipulated by the law. POWERS 1. The Department of Transport acts as the legal entity with its own seal, funds for its operation and is allowed to open an account at the State Treasury. 2. It has the right to promulgate guiding documents on the implementation of policies and regulations of the Government, the Ministry of Communications and Transport, the provincial People's Committees and inspect activities under the Department's management according to regulations as prescribed by law and as assigned and arranged by the Ministry of Transport and of the provincial People's Committee. 3. It has the right to request individuals and organizations operating in the field of transportation to provide information, make periodic and irregular reports in accordance with law. 4. It has the right to propose or decide under the authority of the regimes and policies for officials, public servants and employees of the Department in accordance with the State regulations and assigned and arranged management of provincial officials. FUNCTIONS Department of Justice acts as a professional agency which counsels and supports the Provincial People's Committee in state management over: law development and enforcement; monitoring law enforcement; inspecting and handling legal documents; control of administrative procedures; legislation; law dissemination and education; grassroots conciliation; civil status; nationality; authentication; child adoption; judicial records; state compensation; legal aid; lawyer; legal advice; notarization; judicial examination; property auction; commercial arbitration; managing the implementation of law on handling of administrative violations and other judicial tasks in accordance with law.
TASKS AND POWERS 1. Submitting to the Provincial People's Committee: a) The drafts of decisions, directives and other documents under its promulgating authority of the Provincial People's Council and People's Committee in the field of justice; b) The drafts of long-term, five-year, annual plans and schemes, projects, programs and measures to organize the implementation of tasks of state administration reform, judicial reform, law development and completion under the deciding authority of the People's Council and Provincial People's Committee in the field of justice; c) The drafts of master plan on development of the professions of lawyer, notarization, property auction and other judicial professions in the province under the state management of the Provincial People's Committee; d) The drafts of written documents specifying conditions and criteria for titles of the Heads and Deputy Heads of units of the Department of Justice; Heads and deputy heads Department of Justice under People's Committees of districts, towns and provincial cities (hereinafter collectively referred to as district-level People's Committee). 2. Submitting to the Chairman of the Provincial People's Committee: a) The drafts of decision on establishment, merger, division, dissolution of organizations and units under the Department of Justice as prescribed by law; b) The drafts of decisions and directives under the promulgating authority of the Chairman of the Provincial People's Committee on judicial work in the province. 3. Organizing the implementation of legal documents, planning, plans, programs, schemes and projects in the judicial field decided and approved by competent authorities. 4. In terms of legal documents formulation: a) Coordinating with the Office of the Provincial People's Committee in submitting to the Provincial People's Committee for approval and adjustment of legal document formulation program of the Provincial People's Committee; coordinating with the Office of the Provincial People's Committee in drafting the resolution development program of the Provincial People's Council so that the Provincial People's Committee submit it to the People's Council in accordance with law; b) Participating in drafting of legal documents under its promulgating authority of the Provincial People's Committee drafted by other specialized agencies of the Provincial People's Committee; c) Appraising the drafts of legal documents under its promulgating authority of the Provincial People's Council and People's Committee in accordance with law; d) Organizing the collection of people's opinions on projects and drafts of legal documents under the direction of the Provincial People's Committee and the Ministry of Justice. 5. In terms of law enforcement monitoring: a) Formulating and submitting to the Provincial People's Committee for promulgation and organization of the implementation of plans to monitor the law enforcement in the province; b) Guiding, urging and inspecting specialized agencies of the Provincial and District-level People's Committees in monitoring the law enforcement in the respective localities; proposing to the Provincial People's Committee on handling of results of monitoring the law enforcement; c) Reviewing and preparing a report on the law enforcement in the locality and proposing measures to solve difficulties and problems in law enforcement to the Provincial People's Committee and the Ministry of Justice; d) Monitoring the law enforcement in the fields of justice within the state management of the Provincial People's Committee. 6. In terms of the inspection and handling of legal documents: a) Assisting the Provincial People's Committee in self-examining documents promulgated by the provincial People's Committee; b) Examining legal documents of People's Councils and People's Committees of districts; guiding the specialized agencies of the district-level People's Committees to self-examine legal documents and examining legal documents of People's Councils and People's Committees of communes, wards or towns (Hereinafter collectively referred to as commune-level People's Committee) in accordance with law; c) Advising with the Chairman of the Provincial People's Committee on handling the detected illegal documents; inspecting and urging the implementation of measures to handle illegal documents in accordance with law. 7. Organizing the review and systematization of legal documents of the Provincial People's Councils and People's Committees in accordance with law; urging, guiding and synthesizing the results of the review and systematization of specialized agencies under the Provincial People's Committees and district-level People's Committees. 8. In terms of administrative procedures control: a) Providing professional guidance and training on administrative procedure control and reform; organizing the review and assessment of administrative procedures under the authority of local administrative levels in accordance with law; b) Giving comments and assessments on administrative procedures in drafting legal documents within the promulgating authority of the Provincial People's Council and People's Committee; c) Urging relevant departments, committees, branches, agencies and units to make statistics of newly promulgated administrative procedures, the amended, supplemented or replaced administrative procedures, and the abrogated or abolished administrative procedures; quality control and data entry of administrative procedures, related documents published into the National Database on administrative procedures; creating a link between the Provincial People's Committee website and the National Database on administrative procedures; d) Organizing the receipt, study and proposing the assignment of handling feedbacks and proposals of individuals and organizations on administrative regulations under the authority of the Provincial People's Committee and the Chairman of the Provincial People's Committee; monitoring and urging the handling of feedbacks and proposals of individuals and organizations on administrative regulations at departments, committees, branches, district-level People's Committees, commune-level People's Committees and other relevant units; e) Organizing the research, proposing and submitting to the Provincial People's Committee initiatives on reforming administrative procedures and related regulations; monitoring, urging and guiding relevant units to organize the implementation after obtaining approval by the Chairman of the Provincial People's Committee; f) Assisting the Provincial People's Committee in inspecting the implementation of administrative procedure control activities at the provincial departments, committees, branches and district-level People's Committees; g) Proposing to the Provincial People's Committee to establish a system of focal public servants for performing the task of administrative procedures control according to the part-time regime at the departments, committees, branches and People's Committees of districts and communes. and relevant local units; h) Performing tasks of administrative procedures control and reforming in the fields under the management of the Department of Justice. 9. In terms of law dissemination, education and grassroots conciliation: a) Formulating and submitting to the Provincial People's Committee for promulgation of the programs and plans on law dissemination, education and organization of the implementation after such programs and plans have been issued; b) Monitoring and guiding the law dissemination and education in the province; urging and inspecting specialized agencies under the Provincial People's Committees, relevant agencies and organizations and the district-level People's Committees in organizing the Law Day of the Socialist Republic of Vietnam; c) Performing the tasks of the standing agency of the Provincial People's Council to coordinate for law dissemination and education of the province; d) Establishing and managing a contingent of law reporters and propagandists; participating with relevant agencies in standardizing the contingent of civic educators, law teachers and lecturers in accordance with law; e) Guiding the development, management and application of legal bookshelves at the commune level, agencies and units in accordance with law; f) Guiding the organization and activities of grassroots conciliation in accordance with law; providing professional guidance and grassroots conciliation skills to conciliators in accordance with a Regulation on coordination between the Government and the Central Committee of the Vietnam Fatherland Front and instructions of the Ministry of Justice. 10. Presiding and coordinating with the Department of Culture, Sports and Tourism and other related Departments to assist the Provincial People's Committee in guiding the formulation of conventions of residential groups, quarters, hamlets and some other forms (collectively referred to as residential group) in accordance with law. 11. Assisting the Provincial People's Committee in performing tasks of building communes, wards and towns in access to law as prescribed. 12. In terms of civil status, nationality, authentication and adoption: a) Directing and guiding the organization of implementation of civil status and nationality registration and management in respective localities; providing professional guidance to the specialized agencies under the district-level People's Committees and the civil status-justice officials under the commune-level People's Committees on the issuance of copies from original registers, authentication of copies from originals and signature authentication; b) Establishing a system of organization of civil status registration and management; managing, updating and exploiting the database of civil status as prescribed; performing the tasks of civil status registration in accordance with law; c) Settling the child adoption issues involving foreign elements under its authority in accordance with law and direction of the Provincial People's Committee; d) Evaluating dossiers and submitting to the Provincial People's Committees the settlement of the child adoption issues involving foreign elements within the authority of the Provincial People's Committees in accordance with law; requesting the Provincial People's Committee to decide on revocation and cancellation of civil status papers decided by the Provincial People's Committee to revoke, cancel the civil status papers issued by the district People's Committees in contravention of the law's regulations (except for illegal marriages); e) Performing tasks to handle dossiers of application for admission, resignation, or restoration of Vietnamese nationality; certification of Vietnamese nationality; application for a certificate of Vietnamese nationality; notice of Vietnamese nationality; management and archive of nationality records in accordance with law. 13. In terms of judicial records: a) Developing, managing, exploiting, protecting and using local judicial record database in accordance with law; b) Receiving and processing judicial record information provided by the Court, civil judgment enforcement agencies, relevant agencies and organizations, and the National Center for Judicial Records; providing judicial records and additional information to the National Center for Judicial Records; providing judicial record information to other Departments of Justice; c) Making judicial records, updating additional judicial record information according to regulations; d) Issuing the criminal record certificates under its authority. 14. In terms of state compensation: a) Guiding the skills and profession of the state compensation work for public employees who perform the state compensation work of specialized agencies of the provincial and district-level People's Committees; b) Proposing and submitting to the Provincial People's Committee to identify the agency in charge of state compensation if requested by the victims or there is no agreement on the identification of the agency in charge of state compensation in accordance with law; monitoring, urging and inspecting the settlement and payment of compensation and performing the repayment responsibility in accordance with law; c) Providing information and guiding procedures to assist the aggrieved persons in exercising their right to claim compensation in administrative management. 15. In terms of legal aid: a) Managing and guiding the organization and operation of centers and branches of state legal aid centers; activities of legal aid of lawyer's offices, law firms, legal consultancy centers in accordance with law; b) Performing the tasks of the standing agency of the Interdisciplinary Coordinating Council on legal aid in provincial proceedings; c) Proposing the Chairman of the Provincial People's Committee to appoint and dismiss legal aid officers; decisions on recognition, granting and revocation of the certificates of legal aid collaborators; granting, changing and revoking the registration papers for participation of legal aid of lawyer's offices, law firms and legal consultancy centers. 16. In terms of lawyers and legal advice: a) Advising and proposing to the provincial People's Committee to implement measures to support the development of law-practicing organizations, organizations and legal consultancy activities in the locality; b) Examining the dossiers and submitting them to the provincial People's Committee for permission to establish and approve the congress results of the Bar Association, dissolution of Bar Association; presiding and coordinating with the Department of Home Affairs for appraisal and submission to the provincial People's Committees for consideration and approval of the Scheme on organization of the term-based congress, the plans to establish the Steering Board, Council of Reward and Discipline in the new term; c) Issuing and revoking the operation registration papers of domestic law-practicing organizations, foreign law-practicing organizations, legal consultancy centers; issuing and revoking the certificate of solicitor; d) Providing information on the registration of activities of domestic law-practicing organizations, foreign law-practicing organizations to state agencies, organizations and individuals at the request of law; requesting the Bar Association to provide information on the organization and operation of lawyers, requesting the law-practicing organization to report on the organization and operation when necessary; e) Making a list and monitoring the register for practicing at the local Bar Association. 17. In terms of notarization: a) Organizing the implementation of the Master Plan on development of notarization-practicing organizations approved by the Prime Minister in the locality; b) Proposing the Minister of Justice to appoint and exempt the Notaries; decisions to suspend notarization practice for notaries; c) Submitting to the Provincial People's Committee for decision on establishment, conversion and dissolution of the Notary Public Office and permitting the establishment, change, consolidation, merger, transfer and revocation of decisions on the establishment of Notary Offices according to regulations; d) Issuing and revoking the operation registration certificate of notary offices; recognizing the change of list of notaries known as general partners of the Notary Office; considering and notifying in writing the Notary Office on the registration of the list of notaries working under the contract regime; e) Developing, exploiting and using the notarization database according to regulations. 18. In terms of judicial examination: a) Submitting to the Provincial People's Committee for decision to permit the establishment of judicial examination office; conversion of operation type, changing or supplementing the examination fields of the judicial examination office; b) Issuing the operation registration certificates to judicial examination offices; coordinating with specialized agencies under the Provincial People's Committee in appointing and dismissing judicial assessors in the locality; c) Assessing the organization and quality of judicial examination in the locality; proposing solutions to ensure the quantity and quality of judicial assessors at the request of local procedural activities; d) Presiding and coordinating with specialized agencies in, assisting the Provincial People's Committees in state management over the operation of judicial examination office in accordance with law. 19. In terms of property auction: a) Organizing the implementation of the Planning on development of local auction organizations after obtaining the approval by the Provincial People's Committee; advising and proposing to the Provincial People's Committee to implement measures to support the development of the organization and contingent of auctioneers in the locality; b) Guiding the property auction operation for the property auction organizations in the respective localities. 20. Assisting the Provincial People's Committee in state management over commercial arbitration in accordance with the law. 21. In terms of security transactions registration: a) Conducting periodic inspections of local offices of land use right registration in accordance with law; b) Making periodical reports to the Ministry of Justice on the registration of security transactions related to land use rights and properties attached to land in the respective localities. 22. In terms of legal work: a) Formulating and submitting to the Provincial People's Committee for promulgation of annual legislative programs and plans in the locality and organizing the implementation after the programs and plans have been issued; b) Managing and inspecting the legal work of specialized legal officers and the Legal Department in the organizational structure of specialized agencies under the Provincial People's Committee; c) Assisting the Provincial People's Committee in presiding or coordinating with other ministries and sectors in guiding and organizing the fostering of skills, profession in legal affairs for specialized legal officers and Legal Department in the organizational structure of specialized agencies under the Provincial People's Committee; d) Managing, inspecting, guiding and organizing the fostering of skills, profession in legal affairs for legal organizations of local State-owned enterprises; e) Advising and proposing to the provincial People's Committee in establishing and strengthening legal organizations, implementing measures to improve the efficiency of legal work in the locality. 23. Organizing the implementation or coordinating with the specialized agencies of the Provincial People's Committees in performing the legal support activities for enterprises in accordance with law. 24. In terms of management of law enforcement in handling administrative violations: a) Assisting the Provincial People's Committee in monitoring, guiding, urging, inspecting and reporting on the implementation of laws on handling of administrative violations in the locality; proposing the study and addressing of administrative violations handling regulations that are infeasible and inconsistent with reality or in overlaps and contradictions in accordance with law; b) Disseminating and providing the professional training on the application of the law on handling of administrative violations under local management; c) Making statistics on handling of administrative violations under local management; establishing and managing a database on handling of administrative violations and integrating it into a national database on handling of administrative violations at the Ministry of Justice. 25. Assisting the Provincial People's Committee in performing tasks and powers of the execution of civil and administrative judgments in accordance with law and the Regulation on the working coordination between judicial agencies and civil judgment enforcement agencies under promulgation of the Ministry of Justice. 26. Organizing training and fostering of professional skills in the legal and judicial work for the Department of Justice at district-level, the civil status- justice officials at the communal level, other relevant organizations and individuals in accordance with law. 27. Examining and inspecting agencies, organizations and individuals in law enforcement under the management of the Department of Justice; settling complaints, denunciations and fighting against corruption in accordance with law or the decentralization and authorization of the Chairman of the Provincial People's Committee. 28. Performing international cooperation on legal and judicial work in accordance with law and the decentralization and authorization of the Chairman of the provincial People's Committee. 29. Organizing the study and application of science and information technology in fields under the state management of the Department of Justice. 30. Specifying the functions, tasks, powers and working relations of the Offices, specialized departments and public non-business units under the Department of Justice; managing organizational structure, staffing of civil servants, structure of civil servant ranks, job positions, public employees' structure according to job titles and number of members in public non-business units; implementing salary and policies, remuneration, training, fostering, rewards and disciplines for cadres, civil servants, public employees under the management of the Department of Justice in accordance with law and the decentralization and authorization of the Provincial People's Committee. 31. Managing and taking responsibility for assigned finance and properties in accordance with law and the assignment, decentralization and authorization of the Provincial People's Committees. 32. Performing the provision of information, statistics, synthesis, making regular and irregular reports on the status of task performance in the fields assigned to the Provincial People's Committee and the Ministry of Justice. 33. Guiding and inspecting the implementation of the autonomy and self-responsibility mechanism of non-business organizations under the Department of Justice in accordance with law. 34. Performing other tasks assigned by the Provincial People's Committee or as prescribed by law. Department of Foreign Affairs acts as the professional agency, which counsels and supports the provincial People's Committee in State management of foreign affairs and performs several duties and rights as authorized by the provincial people's committee and as stipulated by the law. TASKS AND POWERS 1. Submitting Provincial people's committee for approval of the general long-term, annual plans on foreign affairs, programs, projects within management of the Department in convenience with the socio-economic development strategies of the province. 2. Supporting the provincial people's committee to build the annual foreign affair programs so as to report to Ministry of Foreign Affairs and total up to submit to Prime Minister for approval; 3. Submitting the provincial people's committee to enforce decisions, directions, documents, which will assign, arrange on State management of foreign affairs in area of the province and responsible for contents of those documents. 4. Organizing to perform legal normative acts related to the province's foreign affairs, the approved general plans of foreign affairs; communicating, propagandizing, popularizing, educating fields within management of the department. 5. Organizing and managing in-delegations and out-delegations: a) Supporting the provincial people's committee to unify management of in-delegations and out-delegations; b) Organizing and welcoming the international delegations, who come to visit and work with the provincial people's committee c) Organizing abroad working delegations of leaders of the provincial committee of the Party; d) Coordinating the management and guiding departments, agencies and People's Committees of districts and towns in welcoming and working with foreign organizations and individuals to attend seminars and talks, negotiating, signing aid projects, business cooperation or sightseeing, studying, researching, etc. in the locality; e) supporting the provincial people's committee to monitor, manage the abroad working delegations of officers, civil servants within its management; checking the passport management of cadres and civil servants according to the regulations of the provincial People's Committee. 6. Consular task a) Combining with departments, committees, branches and related agencies to perform exit and entering of Vietnamese persons and foreign persons in area of the province; b) Combining with the related agencies to handle sensitive, complicated matters occurred in consular tasks in the province; c) Guiding and combining to manage operations of foreign individuals and organizations concerned with relations, assets, travelling, living, learning, mission, tourism, businesses, investments in area of the province in compliance with the regulations of Vietnamese law. 7. Working with non-government organizations and foreign individuals: a) Combining with the related agencies, supporting the provincial people's committee to manage operations of non-government organizations and foreign individuals in the locality as stipulated by the law; b) Receiving and performing humanity projects of non-government organizations and foreign individuals as stipulated by the law. c) Organizing, guiding the management and use of humanitarian aid sources as the State's regulations and agreements between foreign parties and partners of the province to ensure the right purpose and high efficiency. . 8. Foreign economic operation: a) Supporting the provincial people's committee to build foreign affair programs of action for economic development of the province; b) Combining with the related agencies to select, assess foreign partners coming to cooperate, invest into production, business and services in the province as assigned by the provincial people's committee; c) Attending commercial promotions, tourism, building investment environment in convenience with the features of the province. d) Coordinating on research, proposing and implementing the guidelines and plans to expand the province's foreign relations and international cooperation with other countries, territories, international organizations, and diplomatic representative agencies and non-governmental organizations. 9. Oversea Vietnamese persons: a) Supporting the provincial people's committee to research, assess performance of policies on oversea Vietnamese persons in the locality as guided by Ministry of Foreign Affairs (State Committee For Overseas Vietnamese); b) Combining with departments, committees, branches of the province in support, guidance, communication, propaganda, movement and performance of policies on oversea Vietnamese persons and their relations; 10. Organizing conferences, seminars, contracting and performing international agreements. a) Supporting the provincial people's committee to unify and manage conferences, seminars, contracting and performing international agreements as stipulated by the law; reporting and asking the upper level authority opinions in case of occurred matters related to foreign affairs and politics. b) Supporting the provincial People's Committee to monitor and promote the implementation of cooperation agreements signed with foreign countries. 11. Coordinating and supporting departments, committees, branches of the central authorities and People's Committees of districts and towns in the province to perform foreign operation in area of the province as required. 12. Combining with the related departments, committees and branches in collection, analysis, information synthesis related to politic situation, security, economics in the world and region affecting the province and proposing the provincial people's committee to make direction and solutions for performance. 13. Performing administrative reform programs in accordance with targets and contents as approved by the provincial people's committee. 14. Specifying functions, duties, rights of specialized divisions and public service delivery units of the Department, managing personnel, organization, deploying salary regulations and policies, treatment regulations, training, improvement, commendation and award, discipline for officers, civil servants, officials belonging to State management of the Department and assigned by the provincial people's committee; organizing trainings and improving professional skill and knowledge of foreign affairs for team of the State officers, civil servants, officials in charge of foreign affairs of the province. 15. Periodically and unexpectedly totaling up, reporting performance of the provincial assigned foreign affairs to the provincial people's committee and Ministry of Foreign Affairs as stipulated by the law. 16. Performing inspection, solving complaints, petitions, fight against corruptions, negative actions and handling violations to the law on foreign affairs within jurisdiction of the Department as stipulated by the law. 17. Managing the assigned finance and assets, organizing to perform the allocated budget in accordance with the law and assigned by the provincial people's committee 18. Performing other duties as assigned by the Provincial People's Committee in accordance with the legal regulations. 3.823.513. FUNCTIONS The department advises and assists the provincial People's Committee in performing the state management of: culture, family, physical training, sport, tourism and advertising (except ads in newspapers, computer information networks and publications), public services under the Department's management and implementing some tasks and rights as authorized by the Provincial People's Committee and as regulated by law. TASKS
1. Advising the Provincial People's Committee a) Decisions and directives; long-term, five-year and annual planning and plans; schemes, projects and programs on cultural, family, physical training, sports and tourism development; programs and measures to perform state administrative reform tasks; decentralize management and socialize in the fields of culture, family, physical training, sports and tourism in the locality; b) Legal documents specify title standards for Heads, Deputy Heads of organizations and units under the Department; Heads, Deputy Heads of Division of Culture and Information under the District, Town People's Committees, after coordinating and agreeing with the Department of Information and Communications. 2. Advising the Chairman of the provincial People's Committee a) Decisions and directives under promulgating authority of the Chairman of the provincial People's Committee on culture, family, physical training, sports and tourism; b) Decision on establishment, merger, dissolution of units under the Department and specialized Councils in culture, family, physical training, sports and tourism as regulated by law. 3. Guiding, inspecting and implementing legal documents, policies, planning, plans, schemes, projects and programs after being approved; informing, propagandizing, disseminating and educating laws on fields under the Department's management. 4. In terms of cultural heritage a) Implementing regulations and solutions to mobilize, manage and use resources to protect and promote the value of local cultural heritage after being approved; b) Guiding and implementing projects on preservation, restoration and restoration of relics under the locality's management after being approved; c) Investigating, discovering, making statistics, classifying and documenting intangible cultural heritage in the province; d) Guiding procedures and granting licenses to research and collect intangible cultural heritage in the province for foreign organizations and individuals and Vietnamese residing abroad; e) Inventorying, classifying and documenting on ranking of cultural and historical relics and landscapes in the province; f) Appraising projects to renovate and construct works outside the provincial-level relics protection areas likely to affect the landscapes and environment of the relics; g) Organizing the collection and preservation of relics, antiques and national treasures handed over and seized by organizations and individuals in the locality as provided by law; h) Registering and managing national relics, antiques and treasures within the province; granting licenses to make copies of national relics, antiques, treasures belonging to provincial museums and private ownership. i) Managing and guiding the organization of activities of preserving and promoting the values of cultural heritage and traditional festivals, beliefs associated with local historical relics and figures. 5. In terms of performing arts a) Guiding and performing plan to arrange and organize the performing arts units under local management in accordance with the planning of the Ministry of Culture, Sports and Tourism in the development of performing arts sector; b) Implementing regulations on organizing festivals, contests, shows on performing arts organized by the locality in the province; c) Appraising and granting licenses to perform the shows, repertoires, plays; fashion shows in the country and with foreign elements for the subjects: - Professional performing arts units, units organizing local performing arts and fashion shows; - Socio-economic organizations, when organizing professional art performances without selling tickets at restaurants and discotheques; - State agencies, economic, political, cultural and social organizations that do not have the function of organizing art performances and wish to organize professional art performances with revenues for the purpose of serving social and charitable work in the locality. - Foreign economic, political, cultural and social organizations, international organizations legally operating on the Vietnamese territory headquartered in the locality. d) Allowing local art troupes and actors under local management to go abroad to perform, foreign art troupes and actors to perform arts in the locality; granting licenses to organize beauty contests in the locality after being approved by competent authorities; e) Implementing to grant practice cards to professional artists and performers as decentralized by the Ministry of Culture, Sports and Tourism; f) Implementing the regulations managing the production and distribution of music tapes, discs and plays. 6. In terms of cinema a) Implementing the plan of using the state budget to ensure funding for film screenings in cinemas and mobile film screenings serving political, social and external tasks, serving children and ethnic minority people in remote areas and armed forces; b) Performing standing tasks of Literary Script Evaluation Council for film production ordered from the state budget, the provincial Film Evaluation Council as regulated by law on cinema. c) Granting and revoking licenses for dissemination of reportage films, documentary films, scientific films and cartoons produced or imported by local cinematographic establishments. d) Granting and revoking licenses for dissemination of feature films produced or imported by local cinematographic establishments as regulated by law on cinema; e) Inspecting the dissemination of films in theaters, mobile films and films broadcast on other media at places of cultural activities, public recreation and entertainment; f) Guiding to implement and inspecting the implementation of the regulations on trading film tapes and discs and other film activities in the locality; 7. In terms of fine arts, photography, exhibition a) Performing standing tasks as Art council of statues, monumental pictures of provincial level as regulations of building statues, monumental pictures of Ministry of Culture, Sports and Tourism; b) Implementing activities of fine arts, photography, exhibitions with provincial-level scale; c) Granting, revoking, adjusting licenses, inspecting and guiding activities of art exhibition, picture exhibition, installation arts, performance of types of contemporary art and other exhibitions under the management scale of culture, sports and tourism agency; organizing art photo contests, photography festivals; managing reproduction of artworks in the locality under the regulations issued by Ministry of Culture, Sports and Tourism; d) Verifying, granting licenses expressing arts part for construction or renovation, restoration projects of statues, monumental pictures, and works related to religion in the province as authorized by the Chairman of the provincial People's Committee and decentralized by the Ministry of Culture, Sports and Tourism. 8. In terms of copyright, rights related to literary and artistic works: a) Implementing methods of protecting legal rights of State, organizations and individuals in the field of the copyright, rights related to literary and artistic works in province as stipulated by law; b) Implementing and guiding, inspecting the execution of regulations on the provision, cooperation, ordering, use and guarantee of copyright for the work, rights related to the performance, audio recording, image recording, broadcast programs and royalty regime, remuneration for authors, copyright owners, relevant rights; c) Verifying copyright, related rights when there is a dispute at the request of a competent organization, individual or state agency. 9. In terms of library a) Presiding, combining with Department of Information and Communications to hand over publications stored at locality to provincial library as regulated; b) Guiding the registration of library activities in the province as regulated by the Ministry of Culture, Sports and Tourism; the registration of activities for provincial Library; c) Guiding libraries in the province to develop regulation on organization and operation on the basis of model regulations of the Ministry of Culture, Sports and Tourism. 10. In terms of advertisement a) Verifying documents of granting, modifying, supplementing, revoking licenses for establishment of representative offices of foreign organizations and individuals providing advertising services which are located in the province to submit to competent authorities for approval; b) Granting, modifying, supplementing, revoking licenses of advertisement in board, plate, panel, banner, screen placed in public, luminous objects, objects in the air and water, transportation means, other moving objects and similar forms hung, placed, sticked, erected outdoors or in public places in the province; c) Supervising, inspecting, and handling law violations according to its competence on advertisement operation in the advertising media (except for ads on newspaper, computer information networks and publications). 11. In terms of public and national culture, propaganda a) Guiding, implementing the planning on grassroots cultural institutions in the locality after being approved by the Provincial People's Committee; b) Guiding to develop regulations on organization and operation of grassroots cultural institutions in the province, basing on model regulations of the Ministry of Culture, Sports and Tourism; c) Guiding to organize festivals; implementing civilized lifestyle in weddings, mourning; developing cultural families, villages, authorities, units in the province; d) Presiding, combining with departments, committees, agencies, unions to direct and guiding movement: "All people unite to build a cultural life"; performing standing tasks of Steering Committee of the movement "All people unite to build a cultural life"; e) Implementing and inspecting the implementation of policies on national culture, conserving, promoting and developing tangible and intangible cultural values of ethnic communities residing in the province; f) Guiding and implementing plan of propaganda activities to serve the political, economic, cultural and social tasks and planning visual propagation system in the province; g) Holding contests, public art festivals, competition of propaganda arts, propaganda panels and posters, providing propaganda documents, propaganda arts for the politic, economic, cultural and social tasks in the province; h) Guiding and inspecting the implementation of regulation on managing karaoke, discotheques, regulations on organizing parties, contests, public art festivals and other cultural activities in the locality; i) Managing composition and popularization of literary works as stipulated by law. 12. In terms of families a) Implementing and inspecting the execution of the legal regulations on families, ensuring the equal right and fighting against violence in families; b) Propagandizing, educating moral values, lifestyle, behavior in the Vietnamese families; c) Collecting, storing information about families. 13. In terms of physical training, sports for people a) Guiding and implementing planning and plans to develop physical training and sport for people in the locality after being approved; b) Developing and implementing the plans training team of guides, freelancers, physical training and sport referees after being approved by Chairman of the provincial People's Committee; c) Presiding, combining with the professional social associations of sports, mobilizing the people to develop physical training and sport movements; popularizing, guiding to exercise gym, sports suitable for interests, age, gender, occupation; d) Developing system of tournament system, competition plan and directing, guiding to hold the provincial sports competitions for the people; e) Assisting the provincial People's committee in State management for sport and entertainment activities in entertainment places, tourist areas, sites of tourism, culture and sport areas in the province; f) Presiding, combining with concerned organizations and agencies to facilitate and guide the elderly, the disabled, children, teenagers and other people to participate in physical training and sports activities; g) Guiding to practice, perform and compete national sports, traditional methods of health training;; h) Guiding, inspecting the recognition of sports families in the province; i) Combining with the Department of Education and Training, the Provincial Military Command, the Provincial Public Security, and the Border Defense Force to implement physical education and sports in schools and physical training and sports in the armed forces in the locality. 14. In terms of high performance sports and professional sports a) Implementing plans on recruitment, training and coaching of athletes; plans for competition of provincial sports teams after being approved by competent authorities; b) Implementing the provincial Physical Training and Sports Festival and national, regional and international competitions after being assigned and approved by competent authorities; c) Implementing specific regimes for provincial coaches, referees and athletes in activities of physical training and sports competitions after being approved by competent authorities and as prescribed by law; d) Inspecting business conditions for professional sports clubs and enterprises trading sport activities; granting certificates of eligibility for trading sports activities to professional sports clubs and enterprises trading sport activities as decentralized by the provincial People's Committee and as prescribed by law; e) Implementing the decision on ranking for athletes, coaches and referees under the management of the Department. 15. In terms of tourism a) Publishing the planning after being approved; b) Implementing to investigate, evaluate, categorize and build a database of tourism resources of the province under the Regulation of the Ministry of Culture, Sports and Tourism; c) Implementing methods to protect, embellish, exploit, suitably use and develop tourism resources, tourism environment, tourist resorts and tourist destination of the province; d) Documenting to propose the recognition of a local tourism area, a local tourist destination and a local tourist route; announcing after there is a recognition decision; e) Granting, amending, supplementing, re-granting, extending, revoking licenses for establishment of representative offices of foreign tourism enterprises located in the province as regulated by law and as decentralized and authorized by Provincial People's Committee; f) Appraising proposal for competent authorities to grant international travel business licenses of enterprises in the province as prescribed by law; g) Deciding to rank 1 star, 2 star class for hotels, tourist villages, class satisfying standards for trading villas, tourist apartments; class satisfying standards for trading accommodation for camping grounds, tourist hostels, houses with rooms for tourists to rent, other tourist accommodation establishments; h) Appraising and granting signboards satisfying standards serving tourists for establishments trading tourist service in tourist resorts, tourist destinations and tourist cities; i) Granting, re-granting, exchanging and revoking tour guide cards; granting and revoking certificates of speakers as prescribed by the Ministry of Culture, Sports and Tourism; j) Developing plans and programs of tourism promotion and implementing programs for promotion of local tourism, events, fairs, seminars and exhibitions after being approved. 16. Presiding or combining with concerned agencies to implement methods for preventing, fighting against illegal activities on culture, family, physical training, sports and tourism. 17. Appraising, participating in the appraisal of investment and development projects related to culture, physical training, sports and tourism in the province. 18. Assisting the provincial People's Committee in state management for enterprises, collective economic organizations, private economic organizations; guiding and inspecting activities in the fields of culture, family, physical training, sports and tourism for associations and non-governmental organizations as stipulated by law. 19. Guiding and inspecting the implementation of autonomy mechanism, self-responsibility of public non-business units in culture, sports and tourism as stipulated by law. 20. Advising the provincial People's Committee on the organization of provincial-scale cultural, sports and tourism festivals. 21. Implementing international cooperation in the fields of culture, family, physical training, sports and tourism as stipulated by law and assigned by the provincial People's Committee. 22. Providing professional guidance on culture, family, physical training, sports and tourism for the Culture and Information Divisions of the district and town People's Committees. 23. Researching and applying scientific and technological advances; building archive information system serving the state management and professional skills of the Department. 24. Inspecting, supervising and solving complaints and denunciations, preventing and combating corruption and handling law violations on culture, family, physical training, sports and tourism as stipulated by law or assigned by the Provincial People's Committee. 25. Training, fostering and coaching talents in culture, art, physical training and sports; training and fostering professional skills for cadres, civil servants and officials in the fields of culture, family, physical training, sports and tourism in the province. 26. Stipulating the Functions, tasks and powers of the Offices, the inspectors, the professional sections and public non-business units under the Department; managing personnel, implementing regime of salary and policies, regime of remuneration, commendation and discipline for cadres, civil servants and officials under the Department's management as stipulated by law and assigned by Provincial People's Committee. 27. Managing finance and assets as assigned and implementing the allocated budget as stipulated by law and assigned by Provincial People's Committee. 28. Periodically and unscheduledly informing and reporting the performance of assigned tasks as stipulated by the provincial People's Committee and Ministry of Culture, Sports and Tourism. 29. Performing other tasks assigned by the Provincial People's Committee and as stipulated by law.
POWERS 1. The Department acts as the legal entity with its own seal and is allowed to open an account at the State Treasury. 2. Promulgating guidance documents and inspecting activities in the field of management as stipulated by law, the Ministry of Culture, Sports and Tourism and as decentralized by the provincial People's Committee. 3. Deciding by authority to implement regimes and policies for cadres and civil servants under the authority according to the management decentralization of provincial cadres and as regulated by the State on cadre work. 4. Promulgating the Operation regulations within internal agency on the basis of functions, tasks, rights and organizational structure promulgated by the provincial People's Committee. FUNCTIONS Department of Labor, War Invalids and Social affairs acts as the professional agency, which counsels and supports the provincial People's Committee in State management of the following fields: jobs, vocational training, labor; salary, wages, social insurance (compulsory social insurance, voluntary social insurance, unemployment insurance); work safety; accredited persons; social protection; child protection and care; sexual equality; Preventing and fighting against social evils (named as the sector of labor, accredited persons and social affairs); public services within management of the Department and perform several other duties and rights as assigned, authorized by the Provincial People's Committee and as stipulated by the law.
TASKS 1. Counseling the Provincial People's Committee: a) Drafting decisions, directions; long-term, five-year and annual plan; administration reform programs, project within management of the Department; b) Drafting documents stipulating functions, duties, rights and organization structure of branches directly under the Department. c) Draft documents specifying title standards for Head, Vice Head of units in the Department; Manager, Deputy Manager of Division of Labor, War Invalids and Social Affairs belonging to district-level, town-level and city-level people's committee as stipulated by the law. 2. Counseling Chairman of Provincial People's Committee: a) Drafting decisions, directions enforced within jurisdiction of Chairman of the provincial people's committee in the sector of labor, accredited persons and social affairs; b) Drafting decisions on establishment, merging, dissolution for units of the Department as stipulated by the law. 3. Guiding, inspecting and organizing to perform the legal normative acts, plans, projects, programs and other matters with regard to labor, accredited persons and social affairs after they are approved; organizing to inform, propagandize, popularize the legal education of the fields within management of the Department. 4. Employment and unemployment insurance a) Organizing to implement programs, solutions of employment, and development policies for labor market of the province on basis of the national target program on employment; b) Guiding and performing the legal regulations on: - Unemployment insurance; - Targets and solutions for new jobs; - Job-making policies for enterprises, co-operatives, types of collective economy, private economy; - Organizing to manage and use labor source; information of labor market; - Employment policies for the special subjects (teenagers, invalids, elderly persons and other subjects), at-home workers, movable labor; - Issuing labor books, monitoring management and use of labor book. c) Managing the job-introducing centers as stipulated by the law; d) Issuing, changing, revoking employment licenses for foreign labors working at enterprises, economic organizations in the province as stipulated by the law. 5. Vietnamese contractual laborers working abroad: a) Guiding and organizing to take Vietnamese contractual laborers to go abroad for work in the locality as stipulated by the law; b) Propagandizing, popularizing the State policies and laws on Vietnamese contractual laborers going to work abroad; c) Guiding and organizing to train labor source, recruit laborers to go to abroad for work within State management of the Department; d) Guiding and inspecting contract registration of enterprises and laborers going to abroad for work based on the personal contracts; supervising contract performance of enterprises taking laborers to go abroad for work in accordance with probation form for raising skills; e) Summarizing the number of enterprises taking the Vietnamese contractual laborers to go abroad for work in area of the province; number of contractual laborers working abroad; f) Informing persons, who will finish their contracts of abroad employment to return to home country, of domestic recruitment demand; guiding, introducing laborers to register for employment; g) Presiding, combining with the relevant agencies to solve, within jurisdiction, requests, petitions of organizations and individuals in the sector of Vietnamese laborers working aboard. 6. Vocational education: a) Organizing to implement plans, programs, projects for development of vocational education in the locality after they are approved; b) Guiding and inspecting organization and performance for the legal regulations on vocational education; standards of vocational teachers and managerial officials; enrollment regulations, examination regulations, tests, graduation recognition and degree issuance, vocational certificates; policies for managerial officers, vocational teachers and vocational pupils, students as stipulated by the law; c) Guiding and organizing to perform training, improvement, use of vocational teachers and managerial officers; holding teaching festivals for vocational teachers, festivals of competition for self-made vocational equipment, the provincial festivals of good vocational learners. 7. Labor, salary and wages: a) Guiding to perform employment contracts, collective employment agreements, negotiation, making collective employment agreements; labor disciplines and material responsibility; solving employment disputes and strikes; policies for laborers in case of arrangement, reorganization and conversion of State enterprises, bankrupted enterprises, dissolved enterprises, capitalized enterprises, enterprises for leasing; b) Guiding to perform regulations on salaries, wages as stipulated by the law. 8. Compulsory social insurance, voluntary social insurance: a) Guiding, inspecting and handling violations in performing the legal regulations on compulsory social insurance, voluntary social insurance within jurisdiction; b) Receiving documents and organizing to assess conditions for suspending payment for compulsory social insurance for consideration and determination made by Provincial People's Committee; c) Performing policies on social insurance as assigned or authorized by Provincial People's Committee and as stipulated by the law. 9. Labor safety: a) Guiding, organizing to implement the national programs on labor protection, labor safety, labor hygiene; the national week of labor safety, labor hygiene, prevention and fighting against fires and explosions in area of the province; b) Organizing to train and issue training certificate of labor safety, labor hygiene for employers in area of the province; c) Performing regulations on registration for machines, equipment, materials with strictly requests of labor safety in area of the province as stipulated by the law; d) Guiding to inspect labor safety quality of particular products and goods as stipulated by the law; e) Presiding, combining to investigate critical labor accidents occurred in the area; totaling and reporting situation of labor accidents in the locality to the Provincial People's Committee and Ministry of Labor, War Invalids and Social affairs; guiding organizations, individuals using laborers to declare, investigate, take minutes, total up and report the labor accidents. 10. Accredited persons: a) Guiding and organizing to perform the State's regulations for the persons accredited with the revolution in the area; b) Guiding and organizing to perform planning and construction of revolutionary martyr cemetery, monument and the works citing revolutionary martyrs in the assigned area; c) Presiding, combining to organize reassembling, receipt, burial for remains of revolutionary martyrs, informing tombs of revolutionary martyrs, visiting tombs of revolutionary martyrs, moving remains of revolutionary martyrs; d) Attending the medical appraisal council of injuries and working ability for the persons accredited with the revolution; e) Managing subjects and expenditures used to perform the preferential mechanisms, policies for the persons accredited with the revolution as stipulated; f) Guiding and organizing movements of repaying someagency for his favor; managing and using the province's fund of repaying someagency for his favor as stipulated by the law. 11. Social protection: a) Guiding to perform mechanisms, policies for subjects of social protection; b) Guiding and organizing to perform policies of poverty elimination; the national target programs of poverty elimination and programs, projects of social assistance; c) Summarizing, totaling up number of subjects received social protection, poor households in area of the province; d) Organizing to build a network of social protection units in area of the province. 12. Child protection and care: a) Guiding and organizing to perform programs, plans of action for child protection and care in area of the province; b) Guiding and inspecting compliance to the legal regulations on child protection and care within management of the Department; c) Organizing to perform the national programs of action for children, the national protection and care programs, projects and plans for children and children with special situation; d) Organizing, monitoring, supervising, assessing performance of children's rights as stipulated by the law; child protection and care mechanisms, policies; e) Managing and using the provincial child protection fund as stipulated by the law. 13. Prevention, fight against the social evils: a) Guiding and organizing to perform programs, plans and solutions for prevention and fight against prostitution evils, drug detoxication; prevention and fight against HIV/AIDS for sex workers, drug users at the concentrated and community units; supporting to reintegrate into the community for women and children, who are sold to foreign countries and returned to home country; b) Guiding professional skill and knowledge for social labor education units (managing drug addicts, whores, detoxicated persons) in area of the province. 14. Sex equality: a) Guiding and organizing to perform the approved policies, programs, plans, projects of sex equality after they are approved; b) Guiding to join programs of sex equality in building and performing socio-economic plans of the locality; organizing to perform methods to speed up sex equality in convenience with the socio-economic conditions of the locality. 15. Supporting the Provincial People's Committee to perform State management for enterprises, collective economic organization, private economic organizations; guiding and inspecting associations and non-Government organization in area of the province in field of labor, accredited persons and social affairs. 16. Guiding, inspecting performance of autonomy and self-responsibility mechanisms for public service delivery units in Department of Labor, War Invalids and Social affairs as stipulated by the law. 17. Performing international cooperation in field of labor, accredited persons and social affairs as assigned or authorized by the Provincial People's Committee and as stipulated by the law. 18. Guiding professional skill and knowledge in field of labor, accredited persons and social affairs for district-level division of labor – war invalids – social affairs. 19. Organizing researches, applying scientific and technological improvements; building database, information system, storage system for State management and professional operations in the fields as assigned. 20. Deploying the administrative reform programs of the Department in accordance with the targets and contents of the administrative reform programs of the provincial people's committee. 21. Within jurisdiction, inspecting, handling violations and solving complaints, petitions; preventing, fighting against corruptions, negative matters; thrift practice and waste combat in the field of labor, accredited persons and social affairs within State management of the Department as stipulated by the law. 22. Organizing to perform public services in the field of labor, accredited persons and social affairs within State management of the Department as stipulated by the law. 23. Performing summary, statistics, information, periodical and unscheduled reports of the assigned tasks as stipulated by the Provincial People's Committee and Ministry of Labor, War Invalids and Social affairs. 24. Specifying functions, duties, rights, organization structure and job relations of public service delivery organizations, units of the Department (excluding units under the authority of Chairman of the provincial People's Committee), managing personnel, organization, deploying salary regulations and policies, treatment regulations, training, improvement, commendation and award, discipline for officers, civil servants, officials belonging to State management of the Department as stipulated by the law and assigned by the provincial people's committee. 25. Managing the assigned finance and assets, organizing to perform the allocated budget as assigned in accordance with the law and assigned by the provincial people's committee. 26. Performing other duties as assigned by the Provincial People's Committee in accordance with the legal regulations.

TASKS 1. Submitting to the provincial People's Committees for decisions and directives on the financial management in the province as stipulated by law and the Government's decentralization. 2. Drafting programs, schedules of long term, 5 years, or every year about financial field as the overall planning, scheme of the local socio-economic development; 3. Organizing and directing to implement the legal documents, programs, projects, plannings and plans on the financial field; guiding the provincial and financial agencies of districts, towns and communes, wards to organize the implementation of the State's laws, policies, regimes and regulations on finance locality; propaganda, dissemination, legal education and financial information. 4. Submitting to the Provincial People's Committee plan on decentralizing the revenue sources and spending tasks of each local budget level; submitting to the provincial People's Committee to submit to the provincial People's Council for approval the norms of allocating the local budget expenditure estimates, deciding on the regimes of fee collection and contributions of the people as stipulated by the law. Guiding and organizing to implement the financial - budget disclosure regime, financial management regime, accounting reports as stipulated by the law. 5. Submit to the Provincial People's Committee regulations on tasks and measures of management and administration of the provincial annual budget. Guiding and inspecting the administrative agencies, public-service units (hereinafter referred collectively to as administrative and non-business agencies) of the province and financial agencies of districts and towns in elaborating annual state budget estimates as stipulated by the Law. Appraising and take responsibility for the appraisal of budget estimates of agencies, units of the same level and People's Committees of districts and towns. Make state budget revenue estimates in the area, make local budget revenues and expenditures, set up provincial budget allocation plans, and report to the provincial People's Committee for submission to the provincial People's Council for decision. 6. Reporting to the provincial People's Committee to review and submit to the provincial People's Council for decision on local budget adjustment estimates in case of necessity, proposing budget balancing plans and necessary methods to complete budget revenue and expenditure missions, practising thrift and fighting against embezzlement. Verifying the allocation of budget estimates to affiliated units of the same level agency as regulated. 7. Combining with revenue agencies in the management of taxes, charges, fees and other revenues in the area. 8. Appraising the settlement of state budget revenues arising in the districts and towns, the settlement of district, town budget revenues and expenditures; appraising and notifying the settlement of administrative agencies, non-business units and other organizations that use the provincial budget and take responsibility for the appraisal results. Summarizing the situation of state budget revenue and expenditure, making total annual budget settlement of the province, reporting to the provincial People's Committee and submitting to the provincial People's Council for approval and reporting to the Ministry of Finance. 9. Managing authorized funds of the Central, managing local financial reserve fund as regulated by the law. 10. Inspecting and supervising the implementation of budget expenditure and use at provincial agencies and units using the state budget. 11. Requesting the State Treasury to suspend payment as detecting expenditure in excess of estimates, wrong policies or regimes or disobeying reporting and statistical regimes. 12. Combining with Department of Planning and Investment, relevant agencies to consult with Provincial People's Committee on strategy of attracting, mobilizing and using domestic and foreign short-term and long-term investment capital; building policies and methods to coordinate and improve the effectiveness of the use of official development assistance capital (ODA) in the locality. Assisting the Provincial People's Committee in state management of territorial finance for all ODA programs and projects in the province, including the programs and projects of Ministries, central agencies or other provinces in charge of implementing. 13. Combining with Department of Planning and Investment and other relevant agencies to build estimates and plan for allocation of annual capital construction investment expenditure estimates, presiding and combining with the concerned agencies in allocating other capital sources with nature of annual capital construction investment to submit to the provincial People's Committee for decision. Participating in investment policy, apprising finance of investment projects managed by the province; participating in bid evaluation for investment projects under competence decided by the provincial People's Committee and other projects in the locality at the request of the investor. Guiding investors in making annual investment capital plans as regulated by Law on State Budget; combining with the Department of Planning and Investment in submitting to the provincial People's Committee to decide the allocation of investment capital, list of investment projects using provincial budget capital under investment management regulations, building plan of additional adjustment and reconciliation of paid investment capital for investment projects from the local budget. Reporting to the provincial People's Committee on adjusting the plan of capital allocation in case of necessity. 14. Guiding, directing and inspecting investors in implementing investment plans, repaying loans as committed in credit contracts, receiving and using investment capital, performing investment capital settlement strictly as regulated by the State, solving problems arising in the process of making settlement reports of investment capital. Guiding and inspecting the verification and approval of the settlement for investment projects decentralized according to regulations. 15. Unifying the management of loans and aid for locality as provided by law. Assisting the provincial People's Committee in issuing bonds and other local loans as regulated by Law on State Budget. 16. Inspecting the implementation of investment capital plans, the management and use of investment capital, settlement of investment capital belonging to the local budget of investors and district and commune financial agencies, the control of payment of investment capital of the State Treasury in province and districts. 17. Verifying investment capital settlement, submitting to the Chairman of the provincial People's Committee for approval (for projects approved by the Chairman of the provincial People's Committee investment capital). Verifying, approving and taking responsibility for approving the settlement of investment projects funded with non-business capital with nature of local construction investment as prescribed. Presiding the inspection of settlement report of Group A projects financed by the state budget and decided to invest by the Chairman of the provincial People's Committee and submitting to the provincial People's Committee for approval as prescribed by law. 18. Summarizing and analyzing the mobilization and use of investment capital, evaluating the effectiveness of management, use of investment capital, settlement of provincial investment capital, and reporting it to the Ministry of Finance and the provincial People's Committee as specified. 19. Assisting the Provincial People's Committee to direct and manage the activities of local development investment funds. Inspecting and supervising the local Development Assistance Fund's branches in lending, interest rate support, guarantee, re-guarantee for capital from local budget entrusted by provincial People's Committees to the Branches of Development Assistance Fund for implementation. 20. Assisting the Provincial People's Committee and the Minister of Finance to perform the state management of enterprise finance: - Guiding to implement policies and regimes of enterprise financial management (State enterprises, other enterprises, cooperatives and cooperative groups), regimes of management, preservation and development of state capital in enterprises; forecasting financial mobilization ability from enterprises in the locality. - Inspecting the implementation of law on finance and accounting at various types of enterprises in their localities as provided by law. - Assisting the Provincial People's Committee to manage State owned capital and properties at enterprises established or contributed capital by the province as regulated by law. - Summarizing, analyzing and evaluating the situation of enterprise's finance in the locality, the management, preservation and development of state capital in enterprises established or contributed by the province, reporting to the provincial People's Committee and Minister of Finance. 21. Guiding the administrative and non-business agencies in the province to implement the regime of state property management; proposing financial methods to ensure effective management and use of natural resources and public properties in the province. Guiding and inspecting local State organizations and agencies in implementing compensation policies, support for resettlement when the State recovers land, collects land use fees, leases land, contributes capital to joint ventures with the value of land use right. Receiving, managing, and submitting to the provincial People's Committee to handle or handle under competence for abandoned properties, newly found properties, confiscated properties added to the State fund, non-refundable aid properties when the project is completed and transferred. Inspecting, handling or submitting to competent authorities to handle problems with state-owned properties at other administrative and non-business agencies as provided by law and guided by the Ministry of Finance. Managing State properties at associations and semi-public organizations. Assisting the Provincial People's Committee to unify the management of price in the province as regulated by law; implementing State policies and methods on prices. Submitting to the Chairman of the provincial People's Committee to decide pricing plan developed by Departments, district, town People's Committees or State enterprises on prices of important properties, goods and services, price of exclusive products, price of land use right transfer, price of clearance compensation as regulated by law. Combining with relevant agencies to organize price consultations, exclusive price control, anti-dumping, price listing as prescribed by law. Collecting information, analyzing situation and price fluctuations; reporting market price situation and the implementation of state management of prices in the province as prescribed by the Minister of Finance and the provincial People's Committee. Presiding and combining with concerned agencies to inspect the implementation of law on prices of organizations and individuals operating in the province; handling or proposing competent agencies to handle law violations on prices as prescribed by the State. 23. Implementing the application of information technology and performing statistics, forecast analysis at financial units in the locality. Acting as a focal point to manage, orient the construction and deploy information technology applications, support directly technique, and transfer applications to district, city, commune and town financial units. Acting as a focal point to collect information and data from financial units in the locality, to build a local financial database and provide data information to the Ministry's general database. 24. Guiding, managing and inspecting the performance of financial services, lottery business and entertainment with bets and amusement with rewards as prescribed by law. 25. Directing and providing professional guidance on financial management at district and commune levels. 26. Inspecting finance for administrative and non-business agencies, economic, social - cultural organization, enterprises and citizens under competence; inspecting agencies and organizations under the Department as prescribed by law. Combining with the Central Financial Inspectorate in performing financial inspection of administrative and non-business enterprises and enterprises under Central management in respective localities as regulated by the Minister of Finance. Reviewing and settling disputes, complaints and denunciations and handling financial violations as regulated by law. 27. Training and fostering financial and accounting cadres and civil servants in the locality; managing finance, properties, cadres and civil servants of the Department as prescribed. 28. Performing other missions as prescribed by law or as assigned by the Provincial People's Committee.

Submitting the provincial People's Committee: a) Drafting decisions, directions; long-term, 5 –year and annual plans; agriculture, forestry, aquiculture, irrigation and rural development programs, projects; natural calamity prevention, fight and mitigation plans in convenience with the general socio-economic development plan, defence and security goals of the locality; programs and methods for implementation of State administrative reform tasks in the assigned fields of State management. b) Drafting the documents stipulating functions, duties and rights of the branches directly under the Department; c) Drafting the legal normative acts specifying conditions, standards, titles for Head and Vice Head of the organizations under management of the Department; drafting regulations on conditions, standards and titles of leaders in charge of agricultural sector of the Economic Division of the districts and towns- level People's Committees. 2. Submitting Chairman of the provincial People's Committee: a) Drafting decision on establishment, merging, dissolution for units under management of the Department as stipulated by the law; b) Drafting decisions, directions enforced within jurisdiction of Chairman of the provincial people's committee; c) Enforcing regulations on management, assignment combination, communication, and report of the organizations under management of provincial agriculture and rural development branch located in the district-level area to the district-level people's committee; the technical staff in the commune-level area to the commune-level people's committee.
3. Guiding and organizing to implement the legal normative acts, plans, development plans, programs, projects, the national standards, the national technical standards, the approved economic-technical norms of agriculture, forestry, aquiculture, irrigation and rural development; communication, propaganda, popularization, legal education of the fields within the assigned State management. 4. Agriculture (Farming, breeding): a) Responsible for organizing and implementing the approved land use projects for farming and breeding after being approved and the projects for prevention from the agricultural land degradation in the area as stipulated; b) Guiding, inspecting implementation of the State management regulations on seed, crop variety, animal breed, fertilizers, animal feed, pesticide, veterinary medicine and other materials for the agricultural production as stipulated by the law; c) Supporting the provincial people's committee in direction of the agricultural production, harvest, maintenance, processing the agricultural products; breeding, crops, cultivation and techniques; d) Organizing plant, veterinary protecting tasks (including aquatic veterinary medicine), preventing, fighting and overcoming the consequences of epidemic diseases for animals and plants; guiding and organizing to implement the domestic quarantine for domestic animals and crop plants in area of the province as stipulated; e) Organizing to prevent, fight against and overcome the consequences of acts of God, pestilent insects, epidemic diseases for the agricultural production; f) Managing and using the local reserve of crop variety, animal breed, pesticide, veterinary medicine, goods and materials in the farming and breeding field in the area after the approval made by the provincial people's committee. 5. Forestry: a) Guiding to establish and being responsible for assessment of forest protection and development plans of the district-level people's committee; b) Supporting the provincial people's committee for decision and establishment of the protective forest areas, production forest areas within management of the locality after the approval; organizing to implement forest classification, determine border amongst types of forest, statistics, inventory, monitoring forest changes as guided by Ministry of Agriculture & Rural Development; c) Organizing to implement forest allocation methods for districts and communes after the approval; organizing to implement forest allocations, forest revocations, exchange the purpose of forest use right, production-forest ownership right into the purpose of planted forest use right and ownership right for the Vietnamese organizations, individuals residing abroad and the abroad organizations, individuals performing the forestry investment projects in Vietnam; organizing to establish and manage the forest and land allocation, renting documents for forest planting; Supporting the provincial people's committee for directing the district-level people's committee to allocate forests to the populated areas in hamlets, mountain villages, and allocate forest, hire forest for households and individuals as stipulated; d) Organizing voting and acceptance for mother plants, seedling and seed forests in area of the province. Building methods, directing, inspecting and being responsible for production of forest tree seeds and using forestry materials; afforestation; processing and maintaining forest products; preventing and fighting against the epidemic diseases, which can damage and fire forests; e) Being responsible for approving forest preparation methods, forest design and exploiting methods; supporting the provincial people's committee for directing and inspecting afforestation, protection for watershed forests, production forests and protection forests as stipulated; f) Guiding, inspecting permit for forest exploitation and assigning the exploitation plan to forest owner acting as the organization and the district-level people's committee after the approval; implementing the regulations on responsibilities of the district-level people's committee, the commune-level people's committee in management, protection of forests in the localities; combining and mobilizing personnel and means of the organizations and individuals in the area in forest product protection and management, prevention and fight against the fires. 6. Aquiculture: a) Guiding and inspecting the storage and processing of salt in the locality; b) Organizing to implement the salt storage of the provincial plan after it is approved. 7. Aquiculture a) Guiding, inspecting implementation for the corridor regulations on the moving aquatic products when applying types of aquiculture exploitation; announcing Ministry of Agriculture & Rural Development's the regulation on the list of aquatic products banned to exploit and the banning duration; exploitation methods, type of exploitation, fishing equipment banned to use or restrained to use; species and the minimum size of aquatic products allowable to exploit; time of exploitation; the areas banned to exploit and the areas banned to exploit in a specific time in convenience with the province's exploitation of aquatic resources; b) Guiding, inspecting implementation of decisions enforced by the provincial people's committee on the aquatic exploitation area in rivers, lakes, lagoons and the other natural water area under management of the province as guided by Ministry of Agriculture & Rural Development; c) Organizing assessments of aquatic resource in area of the province under the assigned State management; d) Guiding, inspecting the detailed planning of aquaculture areas. Being responsible for assessment of the district-level aquaculture plan and organizing to implement management of the centralized aquaculture area; e) Organizing quality and quarantine test for the aquatic breeds in the aquatic breeding units; organizing to implement prevention, fight against, and overcome the consequences of the aquatic epidemic diseases in area of the province as stipulated; g) Guiding, inspecting and organizing to implement the regulations on management and decentralization of fishing vessels, fishing habour and fishing port; the regulations and managerial organization of activities of wholesale aquatic product markets. 8. Irrigation: a) Guiding, inspecting implementation of the provincial people's committee's the regulations on the decentralized administration for the small and medium scale irrigation works, and the target programs of water supply and drainage in the rural areas in province; guiding and being responsible for construction, exploitation, use and protection of the small and medium scale irrigation works; organizing to implement the programs, the targets of the rural water supply and drainage as approved; b) Performing the regulations on management of rivers, streams, exploitation, use and development of rivers and streams in area of the province in accordance with the planning as approved by the relevant authorities; c) Guiding, inspecting and being responsible for construction, exploitation, protection of flood and storm prevention and fight works; building up methods and organizing to implement prevention and fight against foods and storms, droughts, water-logging, aluminous soil, collapse at river inshore in area of the province; d) Guiding establishment of irrigation land use planning, setting up landmarks in the site area and building up of plans, methods to move the works and domestic houses related to the dyke and river-bank protection scale as stipulated; e) Guiding, inspecting implementation of the State management regulations on exploitation and protection of irrigation works; the protective corridors for the IV-level, V-level dykes; determine to diverge freshets, slow down floods for dyke protection in scale of the locality as stipulated. 9. For the rural development: a) Summarizing, submitting incentive mechanisms, policies and methods for rural development; economic development for households, rural farms, cooperative economy, agriculture, forestry and aquaculture co-operatives and the rural trading branches, villages in area of the commune. Monitoring, summarizing, and reporting to the provincial people's committee on rural development in the area; b) Guiding, inspecting implementation of the regulations on assignment, assessment of projects related to emigration, resettlement in the rural areas; plans of economic structure movement and rural development programs; development of careers, trade villages connecting with households, combination in area of the province; directing, guiding, inspecting implementation after the approval; c) Guiding to develop household economics, farm economics, cooperative economics, cooperatives, develop careers, the rural trade villages in area of the province; d) Instructing, inspecting implementation of emigration, resettlement in agriculture and rural area in convenience with the socio-economic development in the localities; e) Organizing to implement programs, projects or parts of the poverty alleviation programs, projects, new rural construction programs; construction of residential areas, building the rural infrastructures as assigned or authorized by the provincial people's committee. 10. Processing and commerce of agricultural products, forest products and aquatic products: a) Guiding, inspecting performance of plans, programs, mechanisms, policies, developing the processing field suitable with production and the market of goods under State management of the Department; mechanical, electrical and agricultural development policies, career branches, trade villages suitable with households and cooperatives after the relevant authorities approve; b) Instructing, inspecting, assessing development of the processing field for the mechanical and electrical fields, industries, the rural trade villages, maintenance after harvest within State management of the Department; c) Organizing to implement the commercial promotion for agricultural products, forest products and aquatic products within State management of the Department; d) Combining with the related agencies to organize the market forecast, the commercial promotion for agricultural products, forest products and aquatic products. 11. Organizing to encourage the agricultural expansion, applying the scientific and technological progresses into production of agriculture, forestry and aquaculture. 12. Building up and directing to implement the environmental protection methods in agriculture, forestry and aquaculture production and the rural development in the locality. 13. Organizing to implement and being responsible for registration, issuance and revocation of operational permits, certificates within management of the Department as stipulated by the law or assigned, authorized by the provincial people's committee and guided by Ministry of Agriculture and Rural Development. 14. Building up information system, storage system of agriculture, forestry, irrigation and rural development; implementing statistics of changes in agricultural land, forestry land, forests, and water surface for aquaculture as stipulated. 15. Guiding, inspecting implementation of projects and building up development models of agriculture, forestry, aquaculture, irrigation and rural development in area of the province; being responsible for performance of the assigned programs and projects. 16. Implementing the international cooperation of the fields within management of the Department as assigned by the provincial people's committee and as stipulated by the law. 17. Instructing, inspecting performance of autonomy, self-responsibility mechanism of public service delivery units directly under management of the Department and public service delivery units operating in the province's the field of agriculture, forestry, aquaculture, irrigation and rural development as stipulated by the law; being responsible for public services organized and implemented by the Department. 18. Supporting the provincial people's committee in State management for enterprises, collective economic organizations, and private economic organizations; guiding, inspecting operations of non-government associations and organizations in the fields of agriculture, forestry, aquaculture, irrigation and rural development as stipulated by the law. 19. Guiding the professional knowledge and skills for Economic Division and inspecting performance of regulations on management and combination in assignments and communication and report of the provincial level agricultural and rural development organizations located in area of the commune to the commune-level people's committee. 20. Organizing researches and application of science and technologies into production of the agricultural and rural development branch in area of the province. 21. Inspecting and solving complaints, petitions, prevention from corruptions, the negative actions and handling violations to the law in agriculture, forestry, aquaculture, irrigation and rural development within management as stipulated by the law. 22. Performing the permanent tasks of the committee for flood and storm control; search and rescue; the province's emergent issues in protection and prevention from fires, and the Steering Committee of rural clean water and environmental sanitation program as stipulated by the law; attending to overcome the consequences of acts of God such as foods and storms, droughts, water-logging, aluminous soil, the epidemic diseases in agriculture, forestry and aquaculture production in area of the province. 23. Directing and organizing to implement the administrative reform programs in the fields within State management of the Department after the provincial people's committee approves them. 24. Specifying functions, duties, rights and organization structure, job relation of the organizations, public service delivery units directly under management of the Department; managing officers, civil servants, officials and laborers in accordance with the regulations of the law and assigned by the provincial people's committee; organizing trainings and improvements for officers, civil servants, officials and personnel of communes, precincts, towns to implement management of agriculture, forestry, aquaculture, irrigation and rural development as stipulated by Ministry of Agriculture and Rural Development and the provincial people's committee. 25. Managing the finance, assets of the Department as stipulated by the law and assigned by the provincial people's committee. 26. Periodically and unscheduledly informing and reporting performance of the assigned State management as stipulated by the provincial people's committee and Ministry of Agriculture and Rural Development. 27. Implementing several another tasks as assigned by the provincial people's committee or as as stipulated by the law.
POWERS 1. The Department has legal entity, seal and private account at State Treasury. 2. Participating in reviewing, evaluating the efficiency and acceptance of scientific and technical application topics on agriculture and rural development. 3. Rewarding and handling violations against organizations and individuals under the management of the Department according to the regulations of the Ministry and the provincial People's Committee. 4. The Director of the Department manages and implements the policies for cadres and civil servants of the Department as stipulated by the State policy regime and decentralized administration for provincial cadres. 5. Issuing the internal working regulations based on functions, tasks, powers and organizational structure approved by provincial People's Committees. The department acts as a professional agency which counsels and supports the Provincial People's Committee in performing the state management function in the fields of construction; architecture, construction planning; urban technical infrastructure, industrial park, export processing zone, economic zone and hi-tech park (including the infrastructure of urban transport; water supply and drainage, water treatment, lighting, green parks, cemeteries and solid wastes in urban areas, industrial parks, export processing zones, economic zones and hi-tech parks); development of urban areas; housing and office; trading the property; building materials; public services in the fields of state management of the Department; performing a number of other tasks and powers as decentralized and authorized by the Provincial People's Committees and prescribed by law.
TASKS 1. Submitting to the Provincial People's Committee a) The drafts of decisions, directives, and documents regulating the assignment, decentralization and authorization in the fields of state management of the Department within the responsibility and authority of the Provincial People's Committee; b) The drafts of development planning, five-year and annual long-term plans, important programs, projects, and works in the fields of state management of the Department in accordance with the master plan of socio-economic development in the province, regional planning, sectoral and specialized development planning of the whole country; c) The drafts of programs and measures to organize the implementation of State administration reform tasks in the state management fields of the Department in the province, ensuring their consistence with the objectives and contents of the entire program of the State administration reform of the Provincial People's Committee; d) The drafts of legal documents specifying the title criteria for heads and deputy heads of units under the Department; The Heads and Deputy Heads of the Urban Management Division of the People's Committee of the district or town (hereinafter referred to as the district level) after coordinating and reaching an agreement with the departments in charge of relevant sectors and fields. 2. Submitting to the Chairman of the Provincial People's Committee a) The drafts of decisions, directives and other documents under the authority of the Chairman of the Provincial People's Committee in the fields of state management of the Department; b) The drafts of decisions on establishment, merger, separation, reorganization and dissolution of units under the Department in accordance with law. 3. Guiding, inspecting and taking responsibility for organizing the implementation of legal documents, regulations, standards, development planning, plans, programs and projects which have been approved within the scope of state management of the Department; Propagating, disseminating, educating about laws and information in the fields of state management of the Department. 4. In terms of construction a) Guiding and inspecting the implementation of law provisions in the field of construction, including the stages: preparation and management of the implementation of work construction investment projects, surveying, designing and constructing construction works and acceptance (volume and quality), handover, warranty and maintenance of construction works according to the decentralization and assignment of the Provincial People's Committee; b) Issuing, extending, adjusting, revoking construction permits and inspecting the construction of works under the granted permits in the province and in accordance with law; guiding and inspecting the district-level People's Committees and the People's Committees of communes, wards and towns (hereinafter referred to as the commune level) to grant, extend, adjust and revoke the construction permits according to decentralization; c) Guiding and inspecting the implementation of law provisions on the construction practice capacities for individuals and conditions of construction implementation for organizations (including foreign contractors, foreign consultancy organizations, foreign consultants) participating in construction activities in the province; monitoring, confirming, synthesizing and providing information on the capacity of organizations and individuals participating in construction activities in the province; d) Issuing and managing the construction practice certificates in accordance with law; đ) Guiding and inspecting the selection of contractors in construction activities in accordance with the Construction Law and the legislation on bidding for the work construction investment projects under the management authority of the Provincial People's Committee; e) Acting as a focal point to assist the Provincial People's Committee in organizing the performance of State management tasks related to the quality of construction works in the province; submitting to the Provincial People's Committee the regulations on the assignment and decentralization of state management related to the quality of construction works in the province; guiding and inspecting the quality management of construction works for Departments in charge of managing the specialized construction works, People's Committees at district and commune levels and organizations and individuals that participate in construction activities in the province; g) Examining and inspecting the operation of specialized construction laboratories (LAS-XD) in the province, reporting the results of examination, inspection and proposing the measures for handling violations (if any) to the Ministry of Construction in accordance with law; h) Monitoring, synthesizing and reporting to the Provincial People's Committee and the Ministry of Construction on the situation of quality management of construction works and the quality of construction works of ministries, branches, organizations and individuals that make construction investments in the province; i) Organizing the assessment of construction work quality and supervision of construction work incidents according to the decentralization and assignment of the Provincial People's Committee; monitoring, synthesizing and reporting on incidents of construction works in the province; k) Guiding the formulation and management of construction investment costs in the province; organizing to prepare the following documents to be announced by the Provincial People's Committee or the Department according to decentralization: sets of construction unit prices, price of machine shift and construction equipment, price of construction materials, price of construction survey, price of testing construction materials and components, cost norms of specific jobs under construction investment projects in the province, which have not been included in construction norms announced by the Ministry of Construction; advising and proposing to the Provincial People's Committee to guide the application of norms, unit prices of construction, construction price indexes, supply of investment capital for construction investment projects using local budget capital; l) Guiding the entities participating in construction activities in the province to implement the provisions of law on contracts in construction activities; m) Instructing and organizing the hand-over and archive of the documents of the survey, construction design, construction completion documents under the management of the Provincial People's Committee in accordance with law; n) Assessing the basic designs of investment projects for construction of civil works, technical infrastructure, construction materials industry according to decentralization; guiding and inspecting the assessment of work construction investment projects, technical designs, construction drawing designs and cost estimates for construction work according to regulations on management of construction investment projects; o) Appraising investment projects for construction of new urban areas in the province for the Provincial People's Committee to submit them to the Prime Minister for consideration and investment permission under its authority or the Provincial People's Committee for consideration and permission invest under its authority; Appraising investment projects for construction of residential houses in the province for the Provincial People's Committee to consider and approve the investment. 5. In terms of architecture and construction planning (including: regional construction planning, urban construction planning, rural residential area construction planning, industrial park, export processing zone, economic zone, high-tech parks, planning for construction of important international border gates): a) Guiding, inspecting and organizing the implementation of architectural regulations and standards, construction planning, regulations on formulation, assessment and approval of the construction planning design projects; b) Organizing the preparation and assessment of the Regulations on management of grade-I urban architecture; guiding and coordinating with district-level People's Committees in preparation and assessment of the Regulation on management of grade-II urban architecture; guiding and inspecting the implementation of the Regulations on urban architectural management after obtaining approval by competent authorities; c) Formulating, appraising and submitting to the Provincial People's Committee for approval, or formulating for the provincial People's Committee to submit to the competent authorities for appraisal and approval of the construction planning projects in the province in accordance with law; d) Guiding the district-level People's Committees in formulating, appraising and approving construction planning projects in its districts under decentralization; guiding the commune-level People's Committees to organize the formulation of planning projects for construction of rural settlement points in the commune; đ) Managing and organizing the implementation of the approved construction planning in the province according to the decentralization, including: organizing the publication of construction planning; managing landmarks, construction boundaries, construction elevation; granting the construction planning certificates, introducing construction sites; providing information on architecture and construction planning; e) Guiding and inspecting the implementation of law provisions on conditions for architect practice, capacity conditions of individuals and organizations participating in designing the construction planning in the province. 6. In terms of urban technical infrastructure, industrial parks, export processing zones, economic zones and hi-tech parks, including: infrastructure of urban transport; water supply, drainage, sewage treatment, lighting, green parks, cemeteries and solid wastes in urban centers, industrial parks, export processing zones, economic zones and hi-tech parks (hereinafter referred collectively to as technical infrastructure): a) Presiding and coordinating with relevant agencies for development of mechanisms and policies to mobilize resources, encourage and socialize investment in development, management, exploitation and provision of services of technical infrastructure; organizing the implementation after obtaining approval and promulgation by the Provincial People's Committee; b) Organizing the implementation of development investment plans, programs and projects and improving the efficiency of management of technical infrastructure, and criteria of technical infrastructure in the socio-economic development task in the province under approval of the competent authority; c) Guiding, inspecting and organizing the implementation of technical infrastructure regulations and standards, regulations on formulation, appraisal and approval of specialized technical infrastructure planning projects (such as planning of water supply, drainage and solid waste management, etc). d) Organizing the formulation and assessment of specialized technical infrastructure planning projects under the approving authority of the Provincial People's Committees in accordance with law; managing and organizing the implementation of the planning after obtaining the approval; đ) Guiding the establishment and management of costs of technical infrastructure services; organizing the establishment for the Provincial People's Committee to announce or promulgate the norms of cost estimates for technical infrastructure services in the province which are not yet included in the norms of cost estimates announced by the Ministry of Construction, or are existing but not in accordance with local technical processes and conditions; advising and proposing to the Provincial People's Committee the guidance on the application of norms and unit prices of technical infrastructure services in the province and cost estimates of technical infrastructure services using the local budget capital; e) Guiding, inspecting and summarizing the management of construction investment, exploitation, utility, maintenance, repair of technical infrastructure works in the province according to the assignment of the Provincial People's Committee; g) Performing tasks of managing investment and construction of technical infrastructure works in the province in accordance with law and the assignment of the Provincial People's Committee; h) Organizing the development and management of database systems, providing information on technical infrastructure in the province. 7. In terms of urban development a) Formulating the planning on development of a system of urban centers and concentrated population areas (including industrial and rural residential areas) in the province, ensuring compliance with the strategy and regulations. master plan for development of national urban system, inter-provincial construction planning under the approval of the Prime Minister; organizing the implementation after obtaining approval from the Provincial People's Committee; b) Presiding and coordinating with relevant agencies in formulating mechanisms, policies and solutions to attract and mobilize resources for investing in construction and development of synchronous urban areas and new urban area models, policies and solutions for management of urbanization process, urban management models; organizing the implementation after obtaining approval and promulgation from the Provincial People's Committee. c) Organizing the implementation of urban development investment programs and projects approved by competent authorities the assignment of the Provincial People's Committee (such as: programs of upgrading urban areas, preserving and embellishing old urban areas; projects on improving the urban environment, increasing the urban management capacity; investment projects for development of new urban areas, etc); d) Organizing the annual assessment and classification of urban areas according to the criteria prescribed by the Government and preparing dossiers to be submitted to the competent authorities for decision on recognition of urban classes in the province; đ) Guiding and inspecting activities of construction investment, urban development, exploitation and use of urban construction land according to the approved planning, and implementing the regulations of new urban areas; guiding the management of urban construction order; e) Presiding and coordinating with the relevant agencies in organizing activities of promoting urban development investment; mobilizing, exploiting and coordinating domestic and foreign resources for investment in construction and development of urban systems in the province according to the assignment of the Provincial People's Committee; g) Organizing the development and management of database system, providing information on urban development in the province. 8. In terms of housing and offices a) Developing the provincial housing development programs, housing development targets and social housing development plans in the province's socio-economic development tasks in each period; organizing the implementation after obtaining approval from the competent authorities; b) Presiding and cooperating with relevant agencies in formulating and appraising the planning on construction of the systems of offices for the state administration agencies and state-owned working offices of agencies, socio-political organizations, public non-business units in the province; directing the implementation after obtaining approval from the Provincial People's Committee; c) Guiding and inspecting the implementation of standards for construction of houses, offices and headquarters; guiding the implementation of classification, model design, standard design, regulations on management, utility, warranty, maintenance of houses, offices and headquarters in the province; d) Presiding and cooperating with Department of Finance to formulate and submit to the Provincial People's Committees for promulgation the price lists of official-duty houses for rent, price lists of leasing, purchasing social houses, price lists of leasing and selling the state-owned houses in the province; đ) Organizing the implementation of tasks of selling the state-owned houses according to the provisions of the Government's Decree No.61/CP dated July 5th, 1994 and No.21/CP dated April 16th, 1996 on housing trading; implementing the regime of housing improvement assistance for people with meritorious services in accordance with law; e) Organizing the grant of the certificates of housing and construction work ownership in accordance with law; guiding and inspecting the district-level People's Committees in granting the certificates of housing and construction work ownership according to decentralization; summarizing the situation of registration and transfer of housing and construction work ownership in the province; g) Presiding and coordinating with relevant agencies in conducting periodic surveys, statistics, and assessments of housing and offices in the province; organizing the establishment and management of the database and providing information on the state-owned housing, offices and headquarters in the province. 9. In terms of real estate business a) Presiding and coordinating with relevant agencies to develop mechanisms and policies on real estate development and management, measures for transparency of real estate transactions and trading in the province; organizing the implementation after obtaining approval and promulgation from the Provincial People's Committee; b) Guiding the regulations on: real estate made available for trading; capacity conditions of investors of the projects of new urban areas, residential areas, technical infrastructure of industrial parks; activities of purchase and sale of housing and construction works; transfer of the projects of new urban areas, residential areas, technical infrastructure of industrial parks; trading real estate service; c) Assessing the dossiers for transfer of the entire projects of new urban areas, residential area, technical infrastructure of industrial parks so that the Provincial People's Committee submits them to the Prime Minister for decision or the Provincial People's Committee shall decide to permit the transfer of the project under its authority; d) Inspecting the knowledge training and fostering activities in real estate brokerage, real estate valuation, management and operation of real estate trading floors; issuance and management of real estate brokerage certificates and real estate valuation certificates; đ) Monitoring and synthesizing the situation, organizing the establishment of information systems in the real estate market, real estate business activities, real estate service business in the province; e) Examining, inspecting and handling violations in real estate business and real estate service business in accordance with law. 10. In terms of construction materials a) Formulating and appraising the construction materials development planning of the province to ensure consistence with the national master plans of construction materials development, regional planning of construction materials development, main planning of construction materials development; management and organization of the implementation of the planning after obtaining the approval from the Provincial People's Committee; b) Managing and organizing the implementation of the plans for exploration, mining and processing of minerals as construction materials, raw materials for cement production under the approval in the province in accordance with law; c) Guiding assessment and appraisal activities on: technologies of exploitation and processing of minerals as construction materials and raw materials for cement production; technology for producing construction materials; product quality of construction materials; d) Organizing the appraisal of investment projects for mining and processing minerals into construction materials and raw materials for cement production as decentralized by the Government and assigned by the Provincial People's Committees; đ) Guiding, inspecting and organizing the implementation of technical standards and regulations on occupational safety and hygiene in activities of exploiting and processing minerals into construction materials and raw materials for cement production; Production of construction materials; e) Guiding the provisions of law on trading construction materials for organizations and individuals trading construction materials in the province according to the assignment of the Provincial People's Committee; g) Checking the quality of products, goods and construction materials produced, circulated and put into use in construction works in the province in accordance with law; h) Monitoring and reviewing the situation of investment in exploitation and processing of minerals into construction materials, raw materials for cement production, the situation of production of construction materials by organizations and individuals in the province. 11. Guiding and inspecting the activities of public service organizations in the fields under the Department's management; managing and directing activities and implementing autonomy and self-responsibility mechanism for public service agencies under the Department in accordance with law. 12. Supporting the Provincial People's Committee in state management over enterprises, collective and private economic organizations, guiding and inspecting the activities of non-governmental associations and organizations operating in State management fields of the Department in the province in accordance with law. 13. Implementing international cooperation in the fields under the Department's management; in accordance with law, the assignment or authorization of the Provincial People's Committee. 14. Building, directing and organizing the implementation of plans for research and application of scientific and technological advances and environmental protection; establishing information systems and materials to serve the state management and professional activities of the Department assigned in accordance with law. 15. Providing professional guidance in the fields of state management of the Department for Urban Management Division under the district-level People's Committee and cadres specialized in cadastral - construction in the Commune People's Committee. 16. Examining and inspecting organizations and individuals in terms of law enforcement in the construction industry, handling the issues according to its authority or submitting the issues to the competent authorities for handling violations; settlement of disputes, complaints, denunciations, fighting against corruption and wastefulness in the fields of state management of the Department in accordance with law or according to the assignment of the Provincial People's Committee. 17. Monitoring, summarizing and reporting on the basis of 6 months, 1 year and irregular basis on the implementation of assigned tasks to the Provincial People's Committee, the Ministry of Construction and other competent agencies as prescribed by law; complying with the general statistical reporting regime for construction industry according to the regulations of the Ministry of Construction and the assignment of the Provincial People's Committee. 18. Stipulating the functions, tasks, powers and organizational structure of the Office, the Inspectorate, the specialized and professional departments and non-business units under the Department; managing organizational structure, staffing, implementing the regimes of salary, treatment, reward, discipline and other regimes and policies for cadres, civil servants and public employees under the Department's management; organizing the professional training and fostering for cadres, civil servants and public employees under the Department's management in accordance with law. 19. Managing the assigned finance and properties and organizing the implementation of the State budget allocated in accordance with law and the decentralization of the Provincial People's Committee. 20. Performing other tasks as assigned, decentralized or authorized by the Provincial People's Committee.
POWERS 1. The Department acts as the legal entity with its own seal, funds for its operation and is allowed to open an account at the State Treasury. 2. Having the right to promulgate documents guiding the implementation of policies and regulations of the Government, the Ministry of Construction and the Provincial People's Committees and inspecting activities under the Department's management in accordance with law and as decentralized and authorized by the Ministry of Construction and the Provincial People's Committee. 3. Having the right to request individuals and organizations operating in the field of construction to provide information, make regular and irregular reports in accordance with law. 4. Having the right to propose or decide under its authority the regimes and policies for the Department's cadres, civil servants and public employees according to the State regulations and the provincial cadre management decentralization.

FUNCTIONS The provincial inspectorate advises and assists the provincial People's Committee in state management of inspection and settlement of complaints and denunciations; performs tasks and rights of inspection and settlement of complaints and denunciations and prevents and combats corruption within the State management scope of the provincial People's Committee. TASKS 1. Submitting to the Provincial People's Committee a) Drafting Decisions, Directives and other documents under the authority of the Provincial People's Committee in the field of inspection, settlement of complaints and denunciations, prevention and combating of corruption. b) Drafting 5-year and annual Planning, Plans, programs, schemes and measures to implement state administrative reform tasks in the fields under assigned state management. c) Drafting legal documents specifying title standards of heads and deputy heads of organizations under the Provincial Inspectorate, Chief Inspector, Deputy Chief Inspectors of departments, agencies, Chief Inspectors, Deputy Chief Inspectors of districts, towns. 2. Submitting to the Chairman of the provincial People's Committee a) Drafting the Decisions, the specific Directives on inspection, settlement of complaints, denunciations, prevention and combating of corruption under promulgating competence of the Chairman of the provincial People's Committee. b) Drafting annual inspection Programs, Plans and other programs and plans as prescribed by law. c) Drafting decisions on establishment, merger, dissolution of units under the Provincial Inspectorate. 3. Implementing legal documents, programs and plans on inspection, prevention and combating of corruption after being approved; informing, propagating, popularizing and educating laws on inspection, prevention and combating of corruption. 4. Guiding, inspecting and urging the Chairmen of district and town People's Committees and directors of departments and agencies in implementing the laws on inspection, settlement of complaints, denunciations and prevention and combating of corruption. 5. Directing, guiding and inspecting the organization, inspection profession, settlement of complaints and denunciations against Inspectors of districts and towns, Inspectors of Departments and agencies, and cadres in charge of inspection of agencies and units which are under the direct management of the Provincial People's Committee. 6. In terms of inspection a) Guiding, inspecting and urging the formulation and implementation of inspection programs and plans of Inspectors of district and towns, Inspectors of Departments and agencies; b) Inspecting the implementation of policies, laws and tasks of district and town People's Committees of and specialized agencies under the provincial People's Committee (collectively referred to as department); c) Inspecting cases related to the responsibilities of many district and town People's Committees or many departments; d) Inspecting other cases assigned by the Chairman of the Provincial People's Committee; e) Supervising, inspecting and urging the implementation of conclusions and recommendations; deciding to handle on inspection by provincial Inspectors and the Chairman of provincial People's Committee. 7. In terms of the settlement of complaints and denunciations a) Guiding the district and town People's Committees, agencies and units under the management of the provincial People's Committee to receive citizens, handle applications of complaints and denunciations, and settle complaints and denunciations; following the regime of citizen reception at the headquarter as prescribed; b) Supervising and inspecting responsibilities of Chairmen of district and town People's Committees, heads of agencies and units under the management of provincial People's Committee in receiving citizens, settling complaints and denunciations; proposing measures to rectify the settlement of complaints and denunciations under the management of the Chairman of the provincial People's Committee; c) Verifying, concluding and recommending the settlement of complaints and denunciations under the authority of the Chairman of the provincial People's Committee when assigned; d) Reviewing and concluding the denunciation contents that the Chairmen of district and town People's Committees or directors of the departments and agencies has resolved but violated the law; in case the conclusion that the settlement has violated the law, proposing the settling person to consider and settle again as regulated; e) Monitoring, inspecting and urging the implementation of decisions on the settlement of complaints and decisions on the handling of denunciations under competence of the Chairman of the provincial People's Committee. 8. In terms of prevention, combating of corruption a) Inspecting the implementation of the provisions of the law on the prevention and combating of corruption of departments, district and town People's Committees and units under management of the provincial People's Committee; b) Combining with state Audit agency, Investigation agency, People's Procuracy and People's Court in detecting acts of corruption, handling persons who have corrupt acts, and taking responsibility before law about their conclusions and decisions in the course of inspecting corruption cases; c) Managing asset and income declaration; verifying asset and income declaration as regulated by law on prevention, combating of corruption; d) Internally inspecting and supervising to prevent corruption acts in inspection and settlement of complaints and denunciations and prevention, combating of corruption. 9. Implementing international cooperation in the field of inspection, settlement of complaints and denunciations, prevention and combating of corruption as regulated by law and authorized by the provincial People's Committee and the Government Inspectorate. 10. Researching and applying scientific and technical advances; building a database to serve the state management and assigned professional skills. 11. Partially summing up, summing up, drawing experience from inspection, settlement of complaints and denunciations, prevention and combating of corruption. Informing, synthesizing, reporting the results of inspection, settlement of complaints, denunciations, prevention and combating of corruption as provided by the provincial People's Committee and the Government Inspectorate. 12. Managing personnel, implementing regimes of salary and policy, regimes of remuneration, training, fostering, commendation and disciplining of cadres and civil servants under management of the provincial Inspectorate as regulated by law and decentralized by the Provincial People's Committee. 13. FUNCTIONS Department of Home Affairs advises and assists the provincial People's Committee in performing the function of state management on home affairs, including: organization of apparatus; personnel of the State administrative and non-business agencies; administrative innovation; authorities at all levels; administrative border; State cadres, civil servants and officials, cadres, civil servants and officials of commune, ward, district; association organization, non-governmental organization; state archives affairs; religion; emulation and commendation. TASKS 1. Submitting to the provincial People's Committee draft decisions, directives, planning, long-term, 5-year, annual plans and schemes, projects and programs under the state management of the Department in the province. 2. Implementing approved legal documents, planning, plans, schemes, projects and programs; informing, propagandizing, instructing, popularizing, and educating the laws on the fields under its assigned state management. 3. In terms of organization of apparatus a) Submitting to the provincial People's Committee to decide decentralization of management of apparatus organization for specialized agencies, non-business units of provincial People's Committee and district People's Committees; b) Appraising and submitting to the Provincial People's Committee the regulations on functions, tasks, rights, organizational structure of specialized agencies, branches of the specialized agencies and state non-business units under the provincial People's Committees; scheme on establishment, merger and dissolution of state non-business units under the provincial People's Committees for the provincial People's Committee to decide as regulated; c) Appraising and submitting to the Chairman of the provincial People's Committee the decision on the establishment, dissolution and merger of interdisciplinary coordination organizations as stipulated by law. d) Advising and assisting the provincial People's Committee in building proposal for establishment, merger, dissolution of specialized agencies under the provincial People's Committee and district People's Committees as stipulated by law for the provincial People's Committee submit to the Provincial People's Council to decide under its competence; đ) Combining with specialized agencies under the provincial People's Committee to guide the district People's Committees in defining the functions, tasks, rights and organizational structure of specialized divisions and non-business units under the district People's Committees. e) Presiding, combining with relevant functional agencies of the province to guide, monitor, inspect the classification and rating of administrative agencies, state non-business units as regulated by law.
4. In terms of management, use of administrative and non-business personnel: a) Building, reporting the provincial People's Committee the provincial plans of personnel for the provincial People's Committee to decide the total non-business personnel and approve total provincial administrative personnel before submitting to competent authorities for decision. b) Submitting to the provincial People's Committee the decision on assigning norms of state administrative and non-business personnel; c) Guiding, managing, using personnel for specialized agencies under provincial People's Committee, district People's Committees and state non-business units as regulated by law. 5. In terms of government organization at all levels of the province a) Guiding to organize and operate the apparatus of local government at all levels in the province. b) Organizing and guiding the election of deputies to the People's Councils at all levels; combining with concerned agencies to organize and guide the election of deputies to the provincial National Assembly as regulated by law; summing up election results of deputies to People's Councils of all levels; c) Appraising and submitting to the provincial People's Committee to approve the election results of the Chairman, Vice Chairman and other members of the district People's Committee. Supporting the Provincial People's Council and People's Committee to submit to the Standing Committee of the National Assembly and the Prime Minister to approve election titles as regulated by law; d) Advising and assisting the provincial People's Council and People's Committee in training and fostering People's Council deputies and People's Committee members at all levels; making statistics on the quantity and quality of People's Council deputies and People's Committee members at all levels to synthesize, report as regulated. 6. In terms of administrative boundary and classification of administrative units a) Monitoring and managing the administrative boundary in the province as provided by law and guided by the Ministry of Home Affairs; preparing projects and procedures related to the establishment, merger, division, demarcation, renaming of administrative units and upgrading of urban centers in the province for submission to competent authorities to consider and decide; guiding and implementing after having approval decision of competent authorities. Supporting the Chairman of provincial People's Committee to perform, guide, approve the classification of administrative units at all levels as regulated by law; b) Synthesizing and managing documents, boundary maps, landmarks, administrative boundaries of the province as guided and regulated by the Ministry of Home Affairs; c) Guiding and inspecting the activities of quarters, villages, hamlets, self-managed residential groups as regulated by law and the Ministry of Home Affairs. 7. Guiding, inspecting and synthesizing to report the implementation of democracy regulations in communes, wards and towns and administrative agencies, state non-business units in the province as regulated by law. 8. In terms of cadres, civil servants, officials a) Assisting the Provincial People's Committee in state management of staff of state cadres, civil servants and officials; commune carders, civil servants; b) Advising and submitting to the provincial People's Committee to promulgate documents on recruitment, management, use, training, fostering and implement regimes and policies for state cadres, civil servants and official, commune carders, civil servants as regulated by law; c) Unifying to manage and perform the plans on training and fostering cadres, civil servants and officials domestically and internationally when being approved by the provincial People's Committees. Guiding, inspecting the recruitment, management, use and implementation of policies and regimes for cadres, civil servants and officials in the province; d) Submitting to the Chairman of the provincial People's Committee to decide or decide under his/her competence to recruit, evaluate, mobilize, appoint, re-appoint, rotate, commendation, discipline and other regimes and policies for state cadres, civil servants and officials managed by the provincial People's Committee. đ) Guiding and inspecting the implementation of the regulations on title standard and structure of State cadres, civil servants and officials; recruiting, managing and employing state civil servants and officials; commune cadres and civil servants as regulated by law and the Ministry of Home Affairs; the decentralization of document management of cadres, civil servants and officials is applied by regulations of law. 9. In terms of administrative reform a) Submitting to the provincial People's Committee the decision to assign specialized agencies under the provincial People's Committee to be in charge of the contents and tasks of administrative reform, including: reforming institution, reforming administrative apparatus organization, building and developing the staff of cadres and civil servants, reforming public finance and modernizing the administration; monitoring, urging and inspecting the implementation according to the decision of the provincial People's Committee; b) Submitting to the People's Committees and Chairman of the provincial People's Committee the decision on policies and methods to strengthen administrative reform, improving the effectiveness and efficiency of state administrative agencies in the province; presiding, combining with central vertical agencies in the province to implement administrative reform; c) Guiding, urging and inspecting professional agencies under the provincial People's Committee and district People's Committees to implement administrative reform according to the province's administrative reform programs and plans approved; the implementation of the one-stop and one-stop shop mechanism at the specialized agencies of the provincial People's Committee, the district and commune People's Committees as stipulated by law and as directed by provincial People's Committee; d) Assisting the Provincial People's Committee to synthesize generally the implementation of regulations on autonomy and self-responsibility on using personnel for state agencies and the autonomy and self-responsibility on performing tasks, organizing apparatus and personnel for public non-business units as regulated by law; đ) Preparing reports on administrative reform submitted to the monthly meeting of the Provincial People's Committee; assisting the provincial People's Committee in preparing report to the Prime Minister and the Ministry of Home Affairs on administrative reform as regulated by law. 10. In terms of organizing associations and non-governmental organizations a) Appraising and submitting to the Chairman of the provincial People's Committee the decisions to permit the establishment, dissolution and approval of the charter of associations and non-governmental organizations in the province as provided by law. b) Guiding and inspecting the implementation of the charter for associations, non-governmental organizations in the province. Submitting to the provincial People's Committee the settlement under the authority for the associations and non-governmental organizations violating the provisions of law and charter of association. c) Presiding, combining with specialized agencies to submit to the provincial People's Committee and Chairman of the provincial People's Committee the decision on support for stabilizing life and production and other regimes and policies for association organizations as regulated by law. 11. In terms of archives a) Guiding and inspecting administrative agencies, non-business units and state enterprises in the province to abide by the regimes and law provisions on archives; b) Guiding and inspecting professional knowledge on the collection, protection, preservation and use of archives for agencies and units in the locality and the provincial Archives Center; c) Appraising and submitting to the Chairman of the provincial People's Committee to approve "List of sources and components of documents under the category of submission to the provincial Archives Center"; verifying "List of invalid documents" of the provincial Archives Center and district Archives Center.
12. In terms of religious affairs a) Assisting the provincial People's Committee in directing, guiding, inspecting and organizing the implementation of the Party's guidelines and State policies and laws on religion and religious affairs in the province; b) Presiding, combining with relevant agencies in performing the tasks of state management of religion in the province as provided by law; c) Guiding professional skills on religious affairs; d) Acting as a focal point between local authorities and religious organizations in the province. 13. In terms of emulation and commendation a) Advising and assisting the provincial People's Committee and Chairman of the provincial People's Committee to direct and unify state management of emulation and commendation; concretizing the Party's guidelines and policies, the State's laws on emulation and commendation suitable to the actual situation of the province; performing permanent tasks of the provincial Emulation and Commendation Council; b) Advising the provincial People's Committee and the provincial Emulation and Commendation Council in organizing emulation movements; summing up partially, summing up emulation; combining with concerned agencies to propagate, disseminate and replicate advanced examples; implementing the Party and State's commendation policy; guiding to inspect the implementation of plans, contents of emulation and commendation in the province; organizing and rewarding forms of commendation as provided by law; c) Building, managing and using the emulation and commendation fund as provided by law; managing, allocating, revoking and exchanging commendation objects as decentralized and provided by law; d) Guiding professional skills on emulation and commendation. 14. Implementing international cooperation in home affairs and appointed fields as provided by law and as assigned by the provincial People's Committee. 15. Inspecting, supervising home affairs; settling complaints and denunciations; preventing and fighting against corruption and negative actions; practicing thrift and combating wastefulness and handling law violation in the fields as assigned by the provincial People's Committee and as provided by law.

Assisting the Provincial People's Committee to perform the state management function according to the assigned fields for organizations of the Ministries, Central Branches and other localities headquartered in the province.
17. Synthesizing and making statistics as guided by the Ministry of Home Affairs on the organization of administrative agencies and non-business units; the number of administrative units at district, commune, hamlet and residential quarter levels; the quantity and quality of staff of state cadres, civil servants and officials, and commune cadres and civil servants; state archives affairs; religion; emulation, commendation and other fields assigned.
18. Researching and applying scientific and technical advances; building a system of information, archives and data to serve the management and professional skills in the fields assigned.
19. Directing and guiding to organize public service activities in the fields under the Department's management.
20. Informing to report to the provincial People's Committee and the Ministry of Home Affairs on the implementation of assigned tasks as regulated.
21. Managing apparatus organization, personnel, implementing salary regimes and policies, remuneration, commendation, discipline, training and fostering in professional skills for cadres and civil servants, officials of the Department as prescribed.
22. Managing finance and assets of the Department as prescribed by law and decentralized by the provincial People's Committee.
23. Developing decisions on functions, tasks, rights, apparatus organization, working relationships and responsibilities of the heads of organizations under the Department as prescribed by law to submit to the Chairman of the provincial People's Committee for decision or to decide under its competence.
24. Performing other tasks assigned by the Provincial People's Committee, Chairman of the provincial People's Committee and as stipulated by law.
