Request investors to strictly comply with regulations on real estate business

​PORTAL - Following the direction of the Provincial People's Committee in Document No. 1333/UBND-KT dated April 2, 2021 on strengthening the management of the real estate market situation, the Department of Construction requested investors of real estate business projects strictly comply with the provisions of the law on land, investment, construction, housing, real estate business, etc. during the project execution in the province.

Only allow to organize capital mobilization and sale opening of houses formed in the future when there is a notification of eligibility to raise capital, sale, and lease, purchase houses formed in the future by the Department of Construction according to the provisions of the law on housing, real estate business.

Guarantee capital mobilization and payment in the purchase, sale, and lease-purchase of houses formed in the future as regulations; use the mobilized capital for the right purpose of housing construction in the project; investors are strictly prohibited from mobilizing in excess of the pre-advanced house purchase or lease purchase amount as prescribed by law. In case of misusing mobilized capital or appropriating capital already mobilized or mobilizing in excess of the advance purchase or lease purchase amount of the customer, the money raised in contravention of regulations must be refunded; must pay compensation (if causing damage) and be administratively sanctioned in accordance with the law on sanctioning of administrative violations or be examined for penal liability in accordance with law.

The initial capital mobilization must not exceed 30% of the contract value, the subsequent times must be consistent with the construction progress but the total amount must not exceed 70% of the contract value when the house has not been handed over to the customer and not collect more than 95% of the contract value when the buyer has not been granted the certificate of land use rights and ownership of houses and other land-attached assets, ensuring that they comply with the provisions of Article 57 of the Law on Real Estate Business.

Provide complete and accurate information about the project (name, location, scale, design, image, overall perspective, construction investment progress) at the project site.

Strictly implement to provide information about the project (implementation status, implementation results, real estate transaction situation) in accordance with the provisions of Decree No. 117/2015/ND-CP dated November 12, 2015 of the Government on the construction, management and use of information system on housing and real estate market in order to build  database on housing and real estate market in the province, step by step improve the information transparency of the real estate market.

The Department of Construction proposes departments, branches, People's Committees of districts, towns and cities to follow their functions and tasks to organize and implement the contents of the direction of the Provincial People's Committee in Document No. 1333/UBND-KT.
