Accordingly, implementation of regulations on retirement age in accordance with the Labor Code 2019 is effective from January 1, 2021, and from 2021, the retirement ages of employees in normal working conditions shall be 60 yeas 03 months for males and 55 years 04 months for females, and shall increase by 03 months for males and 04 months for females after every year. According to current regulations, agencies or units competent to manage public servants and public employees must issue notices of retirement 6 months in advance and issue retirement decisions 03 months prior to the time of public employees' retirement according to the law.
In order to ensure the united implementation of regulations on retirement age, in cases there is retirement after January 1, 2021, the retirement notice and the retirement decision are considered base on retirement age for civil servants and public employees in accordance with the Labor Code 2019. In case agencies or units competent to manage public servants and public employees have issued notices of retirement, it is not required to note again; the time of issuing retirement decision shall comply with the above regulations.
In cases there is retirement before January 1, 2021 and subject to delay of retirement as prescribed in Clause 2, Article 9 of Decree No. 46/2010/ND-CP and Clause 2, Article 40 Decree No. 29/2012/ND-CP, it is not allowed to increase the retirement age under the provisions of the Labor Code 2019; The time of issuing retirement notice and retirement decision must comply with current law.
